A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON ACCEPTING THE WORK OF EC
CONSTRUCTION COMPANY IN ACCORDANCE
WITH CONTRACT NO. 568 OF THE CITY OF VERNON

WHEREAS, EC Construction Company was awarded Contract No. 568 for Civic

Center Yard Improvements pursuant to Resolution No. 8361 of the City of Vernon; and

WHEREAS, Samuel Kevin Wilson, Director of Community Services and Water
has reported to the City Council ofthe City of Vernon on January 25,2005 that said work has
been completed and recommends that the work be accepted and payment be made to the

Contractor in accordance with the agreement.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon hereby finds and
14
determines that the recitals contained hereinabove are true and correct.

SECTION 2: The work ofEC Construction Company pursuant to Contract No.
568 is hereby approved and accepted by the City Council of the City of Vernon.
SECTION 3: The total expended amount is Three Hundred Seventy Six
Thousand One Hundred Two Dollars and Eleven cents ($376,102.11). The remaining ten
percent (10%) or the sum of Thirty Seven Thousand Six Hundred Ten Dollars and Twenty-one
cents ($37,610.21) is payable thirty-five days after the adoption ofthis resolution.
SECTION 4: The City Council of the City of Vernon hereby directs payment of
said sums as set forth to EC Construction Company and instructs the City Clerk to file a notice of
completion with the County Recorder.

1 SECTION 5: The City Clerk of the City of Vemon shall certify to the passage of
2 this resolution and thereupon and thereafter the same shall be in full force and effect.
