Resolution No. 87071 2 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION 8707 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT FOR JAM -MART INTERNATIONAL DBA: CRYSTAL PROMOTIONS TO OPERATE A RETAIL FACILITY LOCATED AT 4400 SOTO STREET WHEREAS, Jam -Mart International, dba: Crystal Promotions (hereinafter referred to as "Crystal Promotions ") has applied for a conditional use permit to operate a retail facility located at 4400 Soto Street in the City of Vernon; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on May 4, 2005; and WHEREAS, the proposed site is located in the M -Zone, General Industrial. Generally, retail uses are permitted in the M -Zone. However, according to Section 26.3.5 -3(a) of the Comprehensive Zoning Ordinance retail and commercial uses with a floor area of more than 10,000 square feet may be permitted in the M -Zone with the approval of a conditional use permit; and WHEREAS, the proposed site is adequate in size, shape and topography for the proposed operation and has adequate drainage; landscaping, if required, will be installed pursuant to the Vernon City Code; and WHEREAS, the proposed site is surrounded by industrial and commercial uses compatible with the proposed use and the proposed use will not have an adverse affect upon adjacent or abutting properties in terms of traffic, parking, noise, odors, dust, smoke, light or glare; and /1/ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the site has access to Soto Street and 44th Street, traffic will generally travel on both Soto Street and 44th Street to the retail facility, and Soto Street and 44th Street are of adequate size and pavement -type to handle the traffic generated from the proposed operation; and WHEREAS, the proposed site will include an estimated forty -one automobile parking spaces and three truck spaces; and WHEREAS, the site, as proposed, has adequate on -site parking and loading facilities in accordance with the Zoning Ordinance; and WHEREAS, City staff has determined that the proposed site and development of the property is consistent with the applicable development standards, and therefore, all parking activities will be maintained on -site within the premises and will supply adequate parking and loading on -site for the proposed development. WHEREAS, the proposed use, as to location, operation and design is consistent with the General Plan and Zoning Ordinance of the City of Vernon; and WHEREAS, the Community Services Department has performed an Initial Study to determine whether the proposed project will have adverse impacts on the environment and has determined that the proposed project will not have a significant adverse effect on the environment, and the Director of Community Services & Water has recommended that a Negative Declaration be adopted in compliance with the California Environmental Quality Act; and WHEREAS, the conditions imposed on the conditional use permit as set forth herein will adequately protect the public health, safety and general welfare and the operation is consistent with all applicable rules and laws of the City of Vernon; and 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the City Council has received a Staff Report, dated March 21, 2005 upon which it has relied in making the foregoing recitals; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: Subject to the conditions set forth below, the conditional use permit is hereby granted to Crystal Promotions for the operation of a retail facility at 4400 Soto Street located in the City of Vernon. SECTION 3: In order to adequately protect the public health and general welfare the following Conditions are required: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, and regulations and subject to permit fees as adopted by the City of Vernon not otherwise addressed by this grant of a conditional use permit. b. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall or landscaping shall be installed and maintained to meet City standards. Prior to occupancy, Crystal Promotions shall obtain a sales tax permit from the State Board of Equalization bearing the City of Vernon Tax number and a City of Vernon business license. d. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. Prior to occupancy a business license and occupancy permit shall be obtained. e The facility shall be operated in a manner, which will not impede traffic on Soto Street or 44th Street. All vehicles shall enter and exit the site in a front forward manner. No maneuvering or vehicle parking shall take place on the public street. f. Dedicate to the City, by grant deed, property for the enlargement of the curb return at the southeast corner of 44th Street and Soto Street to provide for a 52 -foot property line radius. The Grant Deed, legal description and maps shall be reviewed and approved by the City and recorded. Prior to occupancy the curb return at the southeast corner of Soto Street and 44th Street shall be enlarged to a 60' foot radius and a 52' foot property line radius. The existing driveway on Soto Street shall be removed and replaced with curb and gutter, and sidewalk. All existing cracked sidewalk, driveways, curb and gutter adjacent to the site on Soto Street or 44th Street shall be repaired and maintained to meet City standards. Remove, place or relocate including but not limited to trees, power poles, signs and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 fire hydrants, that conflict with proposed improvements and construct curb access ramps. h. Completely remove conflicting water vault on 44th Street and any abandoned utilities in the public right-of-way and adjoining the site. i. Prior to occupancy remove the driveway on Soto Street and replace with concrete curb, gutter, and sidewalk. Relocate the driveway on 44th Street in accordance with the site plan submitted. All subject work shall be in accordance with City Standards. j The project site shall be constructed and maintained substantially in compliance with the site plan submitted as part of this conditional use permit application. k. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. The property shall be provided with adequate refuse containers and refuse disposal services. A City of Vernon franchised solid waste hauler shall perform collection service. 1. Any extension, change in use, change in ownership interest, and/or the issuance of a new occupancy permit shall require a new conditional use permit. m. The facility's building shall be structurally maintained to exclude rodents and the property shall be maintained rodent free. The site shall maintain adequate drainage to eliminate potential mosquito harborage. n. Servicing of vehicles, including but not limited to, washing, steam cleaning and repairing, shall not be permitted on the premises. All vehicles operated at the facility shall be tuned and maintained in accordance with applicable emission standards. o. No equipment or freight shall be stored on the site other than in buildings, trailers, or on the docks (outside storage is prohibited). Outdoor display of merchandise shall be prohibited. All on -site construction or improvements shall be in compliance with the 1997 Building Codes (Building, Fire, Mechanical, Plumbing and Electrical). The proponent shall obtain all necessary building, fire, mechanical, plumbing, and electrical permits from the City of Vernon Community Services Department prior to commencement of construction. SECTION 4: Crystal Promotions and any successors in interest shall indemnify, hold harmless, and defend the City of Vernon, its officers, agents, and employees from and against any and all claims, complaints, or petitions for: (1) damages, losses, expanses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the sole negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. (60) days from the date of this indicate, in writing, its conditions contained in Section 3 of this Resolution and the indemnification provision contained in Section 4 of the Resolution. SECTION 7: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. Kathleen Rea 4400 Operations Report The applicant, Jam Mart:International, doing business as Crystal Promotions, is a retail seller of household furniture and furnishings including electronics and appliances. Crystal Promotions has been in business since 1980, operating out of their current downtown Los Angeles location at 1820 S. Grand Avenue since 1996. Continuing market success has led- to a need to expand their showroom and warehouse areas to meet customer demand. Crystal Promotions is now proposing to expand to the facility at 4400 Soto Street in Vernon. The proposed facility is an existing one story masonry building of approximately 24,000 square feet with 16,000 square feet being proposed for retail use and 8,000 square feet as warehouse. The majority of the 16,000 square feet of retail area space will be set up as furniture displays. The remainder will be sales counters and displays of small appliances, electronics, etc., a few offices, restrooms, and an employee lunch room. The proposed facility will employ a total of 10 to 12 sales people, office workers, and warehouse laborers. The operating hours of the facility will be from 10:00 am to 7:00 pm, seven days per week. Warehouse operation will be from 7:00 am to 7:00 pm. The monitoring station nearest to the City of Vernon is the Pico Rivera station. Readings at the station are used to characterize air quality in the City of Vernon. The site is currently utilized as a warehouse and it is not anticipate that the proposed use will create any additional air quality impacts. b) Expose sensitive receptors to pollutants? b. To the north is the Santa Ana (I -5), Santa Monica (I -10) and the Hollywood (I -101) freeways, to the west is the Harbor Freeway (I -110), and to the east is the Long Beach Freeway (I -710). The streets surrounding the proposed use are adequate in width and are improved as necessary to carry the traffic expected by this proposed use. Soto Street, arterial roadway, serves the subject site with a right -of -way of 80 feet in width, respectively. Both streets are adequate size and pavement type to handle the traffic generated by the new facilities. Therefore, there will be no impact on transportation during operation due to increased traffic trips. b) Hazards to safety from design features (e.g. sharp curves or dangerous intersections) or incompatible uses (e.g. farm equipment)? ❑ ❑ ❑ X b.
