A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND RATIFYING THE ACTIONS TAKEN
REGARDING RENEWAL OF PUBLIC EMPLOYEE CRIME POLICY
WITH HARTFORD FIRE INSURANCE COMPANY

6 WHEREAS, the City's current Public Employee Crime Policy
7 with Hartford Fire Insurance Company ("Hartford") for dishonesty,
8 forgery and fraud expires on June 22, 2005; and
9 WHEREAS, the City desired to renew the policy of insurance
10 with Hartford to protect the City; and
11 WHEREAS, the City employed the services of Arthur J.
12 Gallagher & Co. Insurance Brokers of California, Inc. ("Arthur J.
13 Gallagher") to act as the City's broker to structure and obtain the
14 appropriate insurance coverage; and
15 WHEREAS, Arthur J. Gallagher has recommended that the City
16 enter into an arrangement with Hartford for the provision of
17 insurance; and
18 WHEREAS, in order to meet the urgent need for renewal of the
19 insurance policy, the City Administrator authorized the annual payment
20 of $1,164.00 and the execution of any document necessary to implement
21 the insurance policy, subject to ratification by the City Council; and
22 WHEREAS, by letter dated May 26, 2005, Bruce V. Malkenhorst,
23 the City Administrator/City Clerk, recommended that the actions taken
24 to obtain the necessary insurance coverage for the Public Employee
25 Crime Policy with Hartford Fire Insurance Company, issuing the annual
26 premium payment and executing any forms necessary to implement the
27 insurance with Hartford, be ratified; and

1 WHEREAS, the City Council desires to approve and ratify any
2 document executed by the City Administrator and/or his designee and
3 the annual premium payment in accordance therewith; and
4 WHEREAS, the City Council of the City of Vernon has
5 determined that, pursuant to the provisions of subsection (a) of
6 Section 2.27 of the Vernon City Code, it is in the public interest and
7 necessity to ratify renewal of Public Employee Crime Policy Insurance
8 with Hartford Fire Insurance Company, through Arthur J. Gallagher.
9 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
10 CITY OF VERNON AS FOLLOWS:

SECTION 1:
The City Council of the City of Vernon hereby
12 finds and determines that the recitals contained hereinabove are true
13 and correct.

SECTION 2:
The City Council of the City of Vernon hereby
15 ratifies and authorizes the City Administrator, or his designee, to
16 execute any and all documents necessary for the purpose of securing
17 the renewal of the insurance and to implement and carry out the
18 purposes specified in the insurance renewal on behalf of the City of
19 Vernon.

SECTION 3:
The City Council of the City of Vernon hereby
21 approves and ratifies the annual premium payment of $1,164.00 in
22 accordance with the terms of the insurance renewal.

SECTION 4:
The City Council of the City of Vernon hereby
24 directs the City Clerk, or his designee, to send a copy of this
25 Resolution to:

SECTION 5:
The City Clerk of the City of Vernon shall
2 certify to the passage of this resolution, and thereupon and
3 thereafter the same shall be in full force and effect.

to keep this policy in place. This has been reviewed by the City
Attorney and it is hereby recommended that the actions taken by the

I recommend the City purchase a renewal of the Public Employee Crime
Policy with Hartford Fire Insurance Company, through Vernon's
broker, Arthur J. Gallagher & Co. for the period June 22, 2005
through June 22, 2006. The annual premium for this policy is
$1,164.00.
I further recommend that you execute any documents necessary to put
this insurance policy in place, subject to ratification by the City
Council.
It is necessary to act quickly in this matter to protect the City's
interest as the existing policy expires June 22, 2005.
