A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE DESIGN OF
BILLBOARDS TO CELEBRATE THE ONE HUNDREDTH
ANNIVERSARY OF THE CITY OF VERNON.

6 WHEREAS, on September 15, 2005, the City of Vernon will
7 celebrate its One Hundredth Anniversary; and
8 WHEREAS, on September 15, 2005, the City of Vernon will hold
9 a Grand Opening of the Malburg Generating Station ("MGS"), a 134
10 megawatt power plant that will directly supply electricity to the
11 City's residents and businesses; and
12 WHEREAS, on April 5, 2005, the Finance Committee approved
13 that the City enter into a services agreement with ClearChannel
14 Outdoor for the production and posting of two billboards adjacent to
15 the Malburg Generating Station for the period of July 4, 2005 through
16 September 26, 2005 to celebrate the opening of MGS and the One
17 Hundredth Anniversary; and
18 WHEREAS, the proposed design of the billboards has been
19 completed and said design includes the names of the five (5)
20 Councilmen; and
21 WHEREAS, there have not been and will not be any general or
22 special election(s) in the 2005 calendar year; and
23 WHEREAS, the City Attorney's office has reviewed the
24 proposed design and opined that where there is no nexus between the
25 proposed design and any political activity said design may contain the
26 names of the five (5) Councilmen.
27 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
28 CITY OF VERNON AS FOLLOWS:

The City Council of the City of Vernon hereby
SECTION 1:
2 finds and determines that the recitals contained hereinaboye are true
3 and correct.

SECTION 2:
The City Council of the City of Vernon hereby
5 approves the design of the celebratory billboards, which includes the
6 names of the five (5) Councilmen.

The City Council of the City of Vernon hereby
SECTION 3:
8 authorizes the use of the design for the celebratory billboards and
9 furthermore authorizes the City Administrator and/or his designee to
10 make whatever non-substantive, administrative and/or text changes,
11 upon advice of counsel, to the billboard design.

The City Clerk of the City of Vernon shall
SECTION 4:
13 certify to the passage of this resolution, and thereupon and
14 thereafter the same shall be in full force and effect.
15 APPROVED AND ADOPTED this 1st day of June, 2005.
