Resolution No. 87661 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 8766 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON DETERMINING THE TAX ON ALL PARCELS SUBJECT TO THE SPECIAL PARCEL TAX IMPOSED BY ORDINANCE NO. 1076 FOR FISCAL YEAR 2005 -2006 WHEREAS, Articles XIIIA and XIIIC of the California Constitution require special taxes to be submitted to the voters for approval; and WHEREAS, Ordinance No. 1057, which imposed a special tax, was approved on April 14, 1998 by the City of Vernon voters and added Section 5.45 to the City of Vernon Municipal Code; and WHEREAS, Section 5.45 established a special parcel tax on warehouses, truck terminals, freight terminals and other distribution facilities; and WHEREAS, the maximum tax rate that was established in Ordinance No. 1057 was $1.00 per 100 square foot of gross area of land; and WHEREAS, the revenues raised from this special tax were and are to be used for construction, improvement and maintenance of streets, bridges, and other public right -of -way, including acquisition of land; and WHEREAS, on August 17, 1999, the City Council of the City of Vernon approved the submission of Ordinance No. 1076, (Measure A) to its voters for approval and adoption; and WHEREAS, Ordinance No. 1076 amended the special parcel tax by increasing the maximum tax rate imposed on warehouses, truck terminals, freight terminals, railroad facilities and other distribution facilities from the tax rate established in Ordinance No. 1057; and • 1 WHEREAS, on November 16, 1999 a Special Municipal Election 2 was held; and 3 WHEREAS, Ordinance No. 1076 received the required approval of 4 at least two - thirds of the voters of the City voting thereon and became 5 effective; and 6 WHEREAS, Section 5.45(c) of the Code of the City of Vernon, 7 as amended by Ordinance No. 1076, established a new maximum tax rate 8 for the special parcel tax of $20.00 per 100 square feet of gross area 9 of land; and 10 WHEREAS, the Los Angeles Superior Court and California Court 11 of Appeal have determined that the tax is a proper tax; and 12 WHEREAS, Section 5.45(e) of the Code of the City of Vernon, 13 as amended by Ordinance No. 1076, provides that the City Council is 14 authorized to determine, by ordinance or resolution, the special tax to 15 be imposed on warehouses, truck terminals, freight terminals, railroad 16 facilities and other distribution facilities for each fiscal year; and 17 WHEREAS, the City Council has determined that the current 18 parcel tax rate of $20.00 per 100 square feet of gross area of land is 19 necessary to equitably distribute the cost of maintaining the City's 20 infrastructure to those placing the greatest demand on the 21 infrastructure; and 22 WHEREAS, the City Council has determined that the tax to be 23 imposed for fiscal year 2005 -2006 should remain at the maximum rate of 24 $20.00 per 100 square feet of gross area of land; and 25 WHEREAS, a list containing all parcels subject to the special 26 parcel tax, including the assessor's parcel number and the total amount 27 of tax to be paid by each parcel, calculated at the rate of $20.00 per 28 100 square feet of gross area of land is attached hereto and 1 incorporated by reference as Exhibit A. 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 3 CITY OF VERNON AS FOLLOWS: 4 SECTION 1: The City Council of the City of Vernon hereby 5 finds and determines that the recitals contained hereinabove are true 6 and correct. 7 SECTION 2: The City Council of the City of Vernon hereby 8 determines the special tax for fiscal year 2005 - 2006, for each parcel 9 subject to said tax, as shown on the list attached hereto as Exhibit A. 10 SECTION 3: The City Clerk, or his designee, is hereby 11 directed to transmit a copy of this resolution, together with such 12 other information as may be required for placement of the special tax 13 on the County property tax bills, to the Department of Auditor- 14 Controller of the County of Los Angeles addressed as follows, or to any 15 other address specified by the Auditor - Controller's guidelines: 16 County of Los Angeles Auditor- Controller, Tax Division 17 Direct Assessment Processing Unit 18 500 W. Temple Street, Room 153 Los Angeles, California 90012 19 20 within the time frame set by the Auditor - Controller and in a manner 21 consistent with the Auditor - Controller's guidelines. 22 SECTION 4: The City Clerk is hereby authorized to amend 23 the aforesaid list to add any parcel subject to the tax omitted 24 therefrom, with said tax calculated at the rate of $20.00 per 100 25 square feet of gross area of land, and to delete any parcel erroneously 26 included. 27 / / / 28 / / / 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. Temple Street, Room 153 Los Angeles, California 90012 -2766 15 16 RECITALS 17 WHEREAS, the City requires the LAC Auditor - Controller to 18 provide the service of placement of a special parcel tax on the Secured 19 Tax Roll and distribution of collections to the City; and 20 WHEREAS, the City and the LAC Auditor - Controller entered 21 into an Agreement for Billing of Special Parcel Taxes on August 18, 22 1999; and 23 WHEREAS, in accordance with the LAC Auditor - Controller's 24 Direct Assessment Submission Procedure Manual, April 2003, certain 25 fees have been revised necessitating a new agreement being entered 26 into with the LAC Auditor- Controller for the services hereinafter 27 described. 28 NOW, THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE AS 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SET FORTH HEREIN: I. PROPERTY TAX SERVICES. Los Angeles County will place special parcel taxes on the Secured Tax Roll and distribute collections to the City at the same time and in the same manner as Los Angeles County property taxes are collected and distributed. The City will adhere to the policies and procedures established by the LAC Auditor- Controller as outlined in the Direct Assessment Submission Procedure Manual. Fee for Billing Services. For billing of special parcel taxes, the LAC Auditor - Controller shall collect the following charges: Diskette /CD Input Manual Input - $0.20 per assessment per parcel - $1.40 per assessment per parcel For correction of special parcel taxes requested by the City after extension of the tax roll, the LAC Auditor - Controller will collect $13.00 per correction. The LAC Auditor - Controller will charge an additional fee for extended services provided to the City that are outlined in the Auditor- Controller Direct Assessment Submission Procedure Manual. II. COLLECTION OF AUDITOR - CONTROLLER FEES. Direct Assessment billing charges are collected once a year, on the January 10th advance distribution. Any additional charges are deducted on the next available distribution of monies. III. ACCOUNTING SERVICES. The LAC Auditor - Controller has available a report of special parcel taxes levied for the tax year by parcel and will be provided to the City. Accounting Services beyond this will be considered extended services and will be subject to additional charges and fees. 1 IV. MODIFICATION OF COLLECTION FEES AND CHARGES. 2 The LAC Auditor - Controller reserves the right to increase or 3 decrease any charges herein provided, in proportion to any changes in 4 costs incurred by the Auditor - Controller in providing the services 5 described herein, provided that written notice of any increase or 6 decrease in charges is given to the City. 7 V. AUTHORITY FOR LEVY AND COMPLIANCE WITH LAW. 8 The authority for such levy, (i.e. resolution, ordinance or 9 election), shall accompany requests for the levy of special parcel 10 taxes. The City warrants that the taxes, fees, or assessments imposed 11 by the City and collected pursuant to this Agreement comply with all 12 requirements of state law, including but not limited to Articles XIIIC 13 and XIIID of the California Constitution (Proposition 218). 14 The City hereby releases and forever discharges Los Angeles 15 County and its officers, agents and employees from any and all claims, 16 demands, liabilities, costs and expenses, damages, causes of action, 17 and judgments, in any manner arising out of the City's responsibility 18 under this Agreement or other action taken by the City in establishing 19 a special tax, fee, or assessment and implementing collection of 20 special taxes, fees, or assessments as contemplated in this'Agreement. 21 The City agrees to and shall defend, indemnify and save 22 harmless Los Angeles County and its officers, agents and employees 23 ( "indemnified parties ") from any and all claims, demands, liabilities, 24 costs and expenses, damages, causes of action and judgment, in any 25 manner arising out of any of the City's responsibility under this 26 Agreement, or other action taken by the City in establishing a special 27 tax, fee, or assessment and implementing collection of special taxes, 28 fees, or assessments as contemplated in this Agreement. 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 If any judgment is entered against any indemnified party as a result of action taken to implement this Agreement, the City agrees that Los Angeles County may offset the amount of any judgment paid by Los Angeles County or by any indemnified party from any monies collected by Los Angeles County on the City's behalf, including property taxes, special taxes, fees, or assessments. Los Angeles County may, but is not required to, notify City of its intent to implement any offset authorized by this paragraph. VI. TERMS OF AGREEMENT. All existing agreements between Los Angeles County- Controller and City pertaining to the collection of special parcel taxes shall be terminated upon the execution of this Agreement. This Agreement shall continue from year to year and shall be subject to cancellation by either party by giving a thirty (30) day written notice to the other party of cancellation.
