A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A
GRANT APPLICATION UNDER THE CALIFORNIA BEVERAGE
CONTAINER RECYCLING AND LITTER REDUCTION ACT TO THE
DEPARTMENT OF CONSERVATION'S DIVISION OF RECYCLING

7 WHEREAS, th~tate of California has enacted the California
8 Beverage Container Recycling and Litter Reduction Act that provides
9 funds to the cities and counties for beverage container recycling and
10 litter cleanup activities; and
11 WHEREAS, the California Department of Conservation's
12 Division of Recycling has been delegated the responsibility for the
13 administration of the program within the State and setting up
14 necessary procedures for cities and counties or their designees under
15 the program; and
16 WHEREAS, the City of Vernon has applied for grant funds
17 under the program since May of 2000; and
18 WHEREAS, the California Department of Conservation has
19 announced that the City of Vernon is eligible for Five Thousand
20 Dollars and No Cents ($5,000.00t in grant funds over fiscal year 2Q05-
.21 2006; and
22 WHEREAS, pursuant to Section 14581(a) (4) (E) of the
23 California Beverage Container Recycling and Litter Reduction Act, the
24 eligible participant must submit a Funding Request Form by a certain
25 due date in order to request funds from the Department of
26 Conservation's Division of Recycling; and
27 WHEREAS, by letter dated June 9, 2005" Bruce V. Malkenhorst,
28 City Administrator/City Clerk, recommended that the application
1 for the Beverage Container Recycling and Litter Reduction grant funds
2 be approved and executed.
3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
4 CITY OF VERNON AS FOLLOWS:
5 SECTION 1: The City Council of the City of Vernon hereby
6 finds and determines that the recitals contained hereinabove are true
7 and correct.
8 SECTION 2: The City Council of the City of Vernon hereby
9 approves and authorizes the electronic submittal of the "City/County
10 Funding Request Form (FRF) FY 2005/2006" ("Form"), in substantially
11 the same form as the copy which is attached hereto as Exhibit A and
12 incorporated by reference, to the Department of Conservation's
13 Division of Recycling for all available grant funds under the
14 California Beverage Container Recycling and Litter Reduction Act for
15 the period governing the grant program.
16 SECTION 3: The City Council of the City of Vernon hereby
17 authorizes the Director of Environmental Health to electronically
18 execute said Form for, and on behalf of, the City of Vernon.
19 SECTION 4: The Director of Environmental Health is hereby
20 authorized and empowered to execute all forms necessary to secure,
21 implement and carry out the purposes specified in Section
22 14581(a) (4) (A) of the California Beverage Container Recycling and
23 Litter Reduction Act and to provide information regarding this program
24 to the Department of Conservation's Division of Recycling, upon
25 request.
26 SECTION 5: The City Council of the City of Vernon hereby
27 directs the City Clerk, or his designee, to submit a fully executed
28 Form prior to June 30, 2005 to the California Department of

1 Conservation, Division of Recycling.

SECTION 6:
The City Clerk of the City of Vernon shall
3 certify to the passage of this resolution, and thereupon and
4 thereafter the same shall be in full force and effect.
5 APPROVED AND ADOPTED this 15th day of June, 2005.
