RESOLUTION NO. 8773
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON RESCINDING RESOLUTION NO. 8625 REGARDING AN
AGREEMENT WITH NEW AGE FUEL, INC. IN CONNECTION
WITH THE CITY'S PUBLIC BENEFIT PROGRAM
6 WHEREAS, on December 15, 2004, the City Council of the City
7 of Vernon adopted Resolution No. 8625 approving an Equipment Purchase
8 and Constructiop Agreement, in form (the "Draft Agreement") with New
9 Age Fuel, Inc. for the design, acquisition and construction of biomass
10 processing facilities (the "Project"); and
11 WHEREAS, following the City Council's approval of the Draft
12 Agreement, but before an actuaL agreement was signed by the City, the
13 Project was considered an unviable proposition; and
14 WHEREAS, the City desires to rescind its prior approval of
15 the Draft Agreement.
16 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
17 CITY OF VERNON AS FOLLOWS:

SECTION 1:
The City Council of the City of Vernon hereby
19 finds and determines that the recitals contained hereinabove are true
20 and correct.

SECTION 2:
The City Council of the City of Vernon hereby
22 rescinds Resolution No. 8625 and the Equipment Purchase and
23 Construction Agreement dated December 15, 2004. Any resolution not

consistent
repealed.

with or in conflict with this resolution is hereby

SECTION 3:
The City Clerk of the City of Vernon shall
2 ce~tify to the passage of this resolution, and thereupon and
3 thereafter the same shall be in full force and effect.
4 APPROVED AND ADOPTED this 15th day of June, 2005.
