A RESOLUTION OF THE CITY COUNCIL
OF, THE CITY OF VERNON GRANTING A
CONDITIONAL USE PERMIT TO
SOUTHLAND BOX COMPANY FOR THE
OPERATION OF AN ACCESSORY
WAREHOUSE AT 4201 FRUITLAND AVENUE
WHEREAS, Southland Box Company ( "Southland Box ") has
applied for a conditional use permit to construct and operate an
accessory warehouse at 4201 Fruitland Avenue in the City of
Vernon; and
WHEREAS, Southland Box currently has manufacturing,
packaging, warehousing, and office space at 4955 Maywood Avenue.
WHEREAS, the City Council of the City of Vernon held
hearing on said application for a conditional use permit
August 3, 2005; and
WHEREAS, the proposed site is a permitted use in the
General Industry (M) Zone with approval of a conditional use
permit; and
WHEREAS, City staff has, determined that the project is
categorically exempt from the California Environmental Quality
Act pursuant to Section 15332, in -fill development projects; and
WHEREAS, the proposed use, as to location, operation and
design is consistent with the General Plan and Zoning Ordinance
of the City of Vernon; and
WHEREAS, a conditional use permit is required under the
Zoning Ordinance Section 26.3.5 -3(j) in order to operate an
accessory warehouse greater than 50,000 square feet in the M-
Zone; and

WHEREAS, the proposed operation will be an integral part of
the manufacturing operation and will include the storage of
goods produced in the Southland Box's manufacturing operation in
the City of Vernon; and
WHEREAS, Southland Box proposes to construct a new building
approximately 52,965 square feet on the site, and the site is
adequate in size, shape and topography for the proposed
operation and has adequate drainage; and
WHEREAS, the proposed site is surrounded by industrial,
warehouse, commercial, residential, and other uses which are
compatible with the proposed use and no adverse effects from
traffic, parking, noise, odors, dust, smoke, light or glare, or
risk of fire, infection or explosion is anticipated from the
proposed operation; and
WHEREAS, the site has access to Fruitland Avenue, which is
adequate in width and pavement type to carry the quantity of
traffic generated by the proposed use; and
WHEREAS, the proposed site will include an estimated sixty-
nine automobile parking spaces and nine truck spaces, and
therefore, the site will provide adequate on -site parking and
loading facilities in accordance with the Zoning Ordinance; and
WHEREAS, City staff has determined that the proposed site
and development of the property is consistent with the
applicable development standards, and therefore, all parking
activities will be maintained on -site within the premises and
will supply adequate parking and loading for the proposed
development; and

WHEREAS, the proposed use, as to location, operation and
design is consistent with the General Plan and Zoning Ordinance
of the City of Vernon and all applicable County, State, and
Federal law, rules and regulations; and
WHEREAS, the conditions imposed on the conditional use
permit will adequately protect the public health, safety and
general welfare and the operation is consistent with all
applicable rules and laws of the City of Vernon; and
WHEREAS, the City Council has received a Staff Report,
dated July 26, 2005 upon which it has relied on making the
foregoing recitals; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are
true and correct.
SECTION 2: Subject to the conditions set forth below, the
conditional use permit is hereby granted to Southland Box for
the operation of an accessory warehouse at 4201 Fruitland
Avenue.
SECTION 3: In order to adequately protect the public health
and general welfare the following conditions are required:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, and regulations,
and subject to permit fees as adopted by the City of Vernon not
otherwise addressed by this grant of a conditional use permit.

b. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation. Prior to occupancy
a business license and occupancy permit shall be obtained.
c. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately drained,
and kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be installed and maintained to meet City
standards. Adequate on -site parking shall be maintained so that
no on street parking or staging will occur.
d. The facility shall be operated in a manner that will
prevent unsanitary conditions, odors or other nuisances. The
property shall be provided with adequate refuse containers and
refuse disposal services.
e. The facility shall be operated and maintained in such a
manner that shall not cause, or threaten to cause, discharges of
pollutants to enter the street or storm drain system unless
specifically authorized by a National Pollutant Discharge
Elimination System (NPDES) permit.
f. The facility shall be operated in such a manner that
noise and vibration shall not be a nuisance to neighborhood
properties. At no time shall noise exceed 65db or vibration
exceeds four hundredths of an inch per second particle velocity
when measured at the property line.
g. Southland Box shall structurally maintain 4201 Fruitland
Avenue to exclude rodents and the property shall be maintained
rodent free.

h. Servicing of vehicles, including but not limited to,
washing, steam cleaning and repairing, shall not be permitted on
the premises. No inoperative vehicles shall be stored on -site.
All vehicles operated at the facility shall be tuned and
maintained in accordance with applicable emission standards.
i. No equipment or freight shall be stored or assembled on
the site other than in buildings or trailers (outside storage is
prohibited) .
j. The project site shall be constructed and maintained
substantially in compliance with the site plan submitted as part
of this conditional use permit application. No changes shall be
made in the site development except with the prior approval of
the Director of Community Services.
k. Adequate plans and materials must be available for
handling leaks or spills from vehicles during storage, loading
or transportation.
1. If required a hazardous materials permit shall be
obtained from the City of Vernon Environmental Health Department
for all hazardous materials /waste used, handled, or stored at
the site. Hazardous materials /waste shall be handled and managed
in compliance with all appropriate federal, state and local
laws.
m. The facility shall be operated in a manner that will not
impede traffic on Fruitland Avenue.
n. All required frontage improvements shall be constructed
and all existing cracked sidewalk, curb and gutter adjacent to
the site on Fruitland Avenue shall be repaired and maintained to
meet City Standards.

o. Any extension, expansion, change in use, change in
ownership interest, and /or the issuance of a new occupancy
permit shall require a new conditional use permit.
p. All on -site construction or improvements shall be in
compliance with the most current Building Codes (Building, Fire,
Mechanical, Plumbing and Electrical) and current Environmental
Health Codes and Regulations. The proponent shall obtain all
necessary building, fire, mechanical, plumbing, and electrical
permits from the City of Vernon Community Services Department in
addition to any required Vernon Environmental Health Department
clearance prior to commencement of construction.
SECTION 4: Southland Box and any successors in interest
shall indemnify, hold harmless, and defend the City of Vernon,
its officers, agents, and employees from and against any and all
claims, complaints, or petitions for:. (1) damages, losses,
expenses resulting from bodily injury, sickness, disease,
disability or death arising from the operation of the facility
excluding therefrom any such claim resulting from the sole
negligence or intentional wrongdoing of the City of Vernon, its
officers, agents or employees; (2) a peremptory writ or other
relief by way of injunction, mandamus, or administrative
mandamus; or (3) legal expenses and attorney's fees incurred by
the City of Vernon on behalf of any party in such actions or
proceedings. The City of Vernon does not waive its right to
participate in the defense of any such action.

SECTION 5: Not later than sixty (60) days from the date of
this Resolution, Southland Box shall indicate, in writing, its
acceptance of and agreement with the conditions contained in
Section 3 of this Resolution and the indemnification provision
contained in Section 4 of the Resolution.
SECTION 6: The City Clerk of the City of Vernon shall
certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.

Southland Box Company has submitted an application for a
conditional use permit. They are proposing to construct and operate an
accessory warehouse in excess of more than 50,000 square feet in the
building located at 4201 Fruitland Avenue in the City of Vernon.
Gentlemen:
After review of the application by the Community Services
Department, it is recommended that the conditional use permit be
granted.
Herewith for your consideration are the following supporting
documents:
1. Staff Report.
2. Request for conditional use permit and information
supporting the application.
3. Notice of Public Hearing, copies of notification letters to
owners and tenants in the area and affidavits of posting and
mailing.
The project is categorically exempt from CEQA because it is an
"In -fill Development Project" as described in Section 15332. Notice of
Exemption will be prepared. In my opinion the proposed operation will
pose no adverse effects to the City of Vernon and will have no
significant effects on the environment. The project is consistent with
the General Plan as Adopted by the City of Vernon.

Therefore, it is recommended that the City Council determine:

granted subject to the following conditions:

Southland Box Company (hereafter referred to as
"Southland Box ") is a cardboard box manufacturer in the City
of Vernon, presently operating at 4955 Maywood Avenue.
Southland Box is proposing to expand its operation by
acquiring additional property located at 4201 Fruitland
Avenue. They are proposing to construct a new 52,965 square
foot building adjoining their existing facility located at
4955 Maywood Avenue. The new building will be used as an
accessory warehouse. The accessory warehouse will operate as
an integral part of Southland Box's manufacturing process
and store goods produced in the City.
In order to comply with the Comprehensive Zoning
Ordinance and operate an accessory warehouse greater than
50,000 square feet in the M -Zone, a conditional use permit
is required.
1. GENERAL PLAN The proposed use conforms to the
Zoning Ordinance and the General Plan with the granting of a
conditional use permit. The site of the proposed use is
located in the M -zone, General Industrial. An accessory

warehouse in excess of 50,000 square feet is permitted in
the M -Zone with a conditional use permit. As defined in
Section 26.3.5.3(j), an accessory warehouse is an integral
part of a manufacturing operation located in the City of
Vernon and storing goods produced in that operation.
2. SITE The subject property is located at 4201
Fruitland Avenue. The proposed project is for a 52,965
square foot building used as an accessory warehouse for
their existing manufacturing facility. It is anticipated
that up to 37,397 square feet will be used as an accessory
warehouse with the remainder being office use (approx.
15,568 sq. ft.). The site currently contains a vacant
structure previously occupied by Rancho Foods. This existing
building will be demolished and a new building constructed.
The new building and Southland Boxes existing building will
adjoin each other and four openings will be made connecting
the two structures providing efficient movement of product
from one to the other. The proposed site will be supported
by a sixty -nine stall surface parking lot and five truck
parking /loading stalls. City staff has determined that the
proposed site and development of the property is consistent
with the applicable development standards. Therefore, all
parking activities will be maintained on -site within the

premises and will supply adequate parking and loading for
the proposed development. The proposed site is of adequate
size, shape, topography and drainage for the operation.
3. ADVERSE EFFECT The proposed use is surrounded by
industrial, warehouse, commercial, residential, and other
uses that are compatible with the proposed use. No adverse
impacts from traffic, parking, noise, odor, dust, smoke,
light or glare, or risk of fire, infection or explosion are
expected to occur to the adjacent or abutting properties.
Pursuant to Section 15332, Class 32, "In -fill Development
Projects" of the California Environmental Quality Act, this
project is categorically exempt from CEQA. Therefore,
Notice of Exemption will be filed with the County Clerks
office.
4. ACCESS The project site, as proposed, will have
access to one driveway that fronts Fruitland Avenue.
Fruitland Avenue, which is 60 feet in width and is adequate
in size and pavement type to handle the traffic generated by
the operation.
5. VEHICLE MOVEMENTS The proposed site is located on
Fruitland Avenue just east of Downey Road. There is proposed
driveway into the site. Southland Box estimates that
approximately four (4) trucks per day will deliver and pick-

up product. The truck traffic and delivery activity is
currently traveling to Southland Boxes Maywood Avenue
facility will be redirected to the new facility at the same
level. Other than normal levels of noise from truck traffic
and forklift operation, similar to existing levels, there
will be no added impacts to the immediate vicinity.
Therefore, due to the low volume of vehicular traffic the
City anticipates no impact on transportation system from
Southland Box's operation.
6. OPERATIONS Southland Box is an existing
manufacturing facility in the City of Vernon that is
proposing to expand its operation by acquiring additional
property at 4201 Fruitland Avenue. They are proposing to
construct a new 52,965 square foot building adjacent to
there existing facility located at 4955 Maywood Avenue. The
new building will be used as an accessory warehouse. The
accessory warehouse will operate as an integral part of
Southland Box's manufacturing process and store goods
produced in the City. The facilities operating hours will
remain 7:00 a.m. to 9:00 p.m. Monday through Friday, with
occasional Saturdays.
7. STATE OR FEDERAL CONDITIONS All Federal, State,
and local regulatory permits shall be obtained as required
for the operation.
8. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the
public interests:

BURDEN OF PROOF
The applicant is required to establish the following before submitting a Conditional Use Permit
application:
A) The site for the proposed use is adequate in size, shape and topography, including drainage
and landscaping. The site is adequate in size shape and topography to support the proposed
building footprint while allowing adequate circulation and access to the users. Surface and
subsurface drainage control will adequately control onsite drainage. Landscaping will be pro-
vided at the property frontage in excess of that required by development standards.
B) The proposed use will not have an adverse effect upon adjacent or abutting properties in
terms of traffic, parking noise, odors, dust, smoke, light or glare, or risk of fire, infection or
explosion. The proposed use will not generate excessive truck or automobile traffic, noise,
dust or other hazards that may impact adjacent properties. The building will be provided with
automatic fire sprinklers to protect the subject property as well as adjacent properties.
C) The proposed use will be compatible with the permitted uses of surrounding and adjacent
properties. The proposed warehouse & accessory office use will be consistent with the uses
present on the adjacent surrounding properties, which include warehouse, public / private util-
ities, cold storage warehousing, and manufacturing. The proposed office and warehouse uses are
accessory to the adjacent (box) manufacturing use.
D) The site has sufficient access to streets and highways, which are adequate in width and
pavement type to carry the quantity of traffic generated by the proposed use, and that the routes
which vehicles will have to follow to reach the site are adequate in width and pavement type to
carry the volume of traffic generated by the proposed use.
The access to the property from Fruitland Ave is sufficient to serve the truck and vehicular
access requirements and is adequate in width and pavement type for the anticipated level of
traffic.
E) The site has adequate off - street parking and loading facilities.
The 69 passenger vehicle parking spaces, 4 truck loading spaces and 5 truck parking spaces
provide onsite parking in conformance with the development standards established by the zoning
code of the City of Vernon.
F) The use, as to location, operation and design, is consistent with the general plan, any
applicable specific plan and the zoning regulations of the City of Vernon and all applicable
County, State and federal law, rules and regulations.
The proposed accessory warehouse use is consistent with the General Plan and the regulations
established for the (M) manufacturing Zoning designation of the property .

Environmental Setting
33. The Project Site
The project site prior to the proposed project consists of two parcels that were at one time fully
improved. The topography is generally flat with a gradual slope to the southeast. There are no
cultural, historic or scenic aspects related to the property that were identified through our
property research, or reported.
The southern parcel, 4201 Fruitland Ave.,contains the Rancho Foods Facility and paved yard
area. The 22,000 sf foot building was situated on an approximately 68,000 sf parcel. The entire
parcel outside of the building footprint was paved with asphalt or concrete paving. There is no
landscaping provided.
The Rancho Foods building has been vacated and closed, abated of asbestos containing material
and is in the final stages of demoliton at this time. The property will then be clear of buildings
and ready for comprehensive site development.
The northern parcel, 4151 Fruitland Ave., was formerly a co- generation plant. The plant had
been removed prior to the purchase of this property by the current owner. The site had been
cleared but was left with the grade in a depressed state that created ponding during rainy
conditions. Within the past six months the grade has been raised and capped with a gravel base
cap to prevent ponding until such time that the property is comprehensively developed. As with
the southern parcel there is no onsite landscaping that currently exists.

34. The Surrounding Properties.
The surrounding properties can generally be described as a mix of manufacturing (to the east), .
cold storage warehouse (to the north), railroad right of way (directly to the east) , public / private
services and utility yards (to the west), ware house and distribution facilities (to the northwest
and southwest) and small industrial and manufacturing uses (to the south across Fruitland Ave in
the City of Maywood. Properties, other than a small grass area in front of the City of Vernon
electrical power distribution station, are fully developed and do not provide landscaped open
area.
There are no cultural, historic or scenic aspects related to the surrounding properties that were
identified through our property research, or reported.

Traffic Report.
The subject project is an accessory building associated with the Southland Box Company located
on the directly adjacent property to the east and addressed as 4955 Maywood Avenue, Vernon
CA. The purpose of the new paper roll storage warehouse and accessory offices is to improve
the function of the adjacent facility by allowing the stored paper materials to be concentrated in
the new building thus reclaiming area for the manufacturing and storage of the completed box
products in the existing building. It will also allow the relocation of the corporate offices into the
new (more modern) building.
There will be no additional traffic generated by the new facility as all of the paper roll storage
deliveries are currently being made at the existing facility. There will be no significant additional
trips generated by office workers as they presently office in the existing building.
Operations Report
The Proposed building will serve as the primary receiver and storage location of roll paper used
by the Southland Box Company in the adjacent manufacturing facility on Maywood Avenue.
Activities at this location will include the material receiving function via truck and rail line, the
warehousing of the roll paper material, the movement of the stock roll paper material from the
warehouse to the corrugating and cardboard box manufacturing processes located in the adjacent
main building, and the corporate office function which will be re- located from the existing
building to the new building.
Operating Hours for the Company (at this facility) are from 7:00 am to 9:00 pm Monday through
Friday (sometimes Saturday). Two shifts are utilized; 7:00 am to 3:00 pm; and 3:00 pm to 9 :00
pm. The early shift includes the office workers who, for the most part, work only the first shift.
Total employees located at the new building will not exceed 40 during the morning shift and will
not exceed 20 during the evening shift. Due to the lack of second shift primary office workers.
The primary material received, stored and moved to the manufacturing facility is "brown" haft
type paper that is received by the roll. Each roll is approximately 8' high on edge and between
50" and 60" in diameter.
The average(high) number of deliveries per day is (4) four. Each delivery may include up to 8
paper rolls that are placed into stock or delivered directly to the manufacturing process. The

majority of the delivered rolls will go to stock in the warehouse area. There is no outside storage
proposed for this facility.
The proposed warehouse layout will accommodate approximately 2,000 paper rolls is a stacked
configuration.
As mentioned earlier, the truck traffic and delivery activity is currently present at the existing
facility and is being relocated to this proposed new facility at the same levels. Other than normal
levels of noise from truck traffic and forklift operation, similar to existing levels, there will be no
added impacts to the immediate vicinity.
Hazardous Materials
There will be no hazardous materials delivered, stored, produced, or used by any process at this
proposed facility.
The activities included at this location include the delivery and storage of roll paper and general
office activities.

warehouse in excess of 50,000 sf to be located at 4201 Fruitland Avenue, Vernon CA.
This Letter will serve as our acceptance of and agreement with the stated conditions
contained in Section 3 of Council Resolution No. 8815 and the indemnification provision
contained in Section 4 of said resolution.
A copy of the Letter of Approval with stated conditions and a "draft" copy of Resolution
No. 8815 have been included as attachments for reference. Please forward a fully executed copy
of the resolution as soon as it is available.
We look forward to the completion of this project which will be a valuable asset to the
Southland Box Company as well as the City of Vernon. We also look forward to our continued
positive relationship with the City of Vernon and we progress through the development and
construction stages of our project.
