Resolution No. 8816 . :0 t ,. 1 RESOLUTION NO. 8816 2 3 6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON FINDING THE CITY OF VERNON TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE CMP LOCAL DEVELOPMENT REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089 4 5 7 8 WHEREAS, the Los Angeles County Metropolitan Transportation 9 Authority ("MTA"), acting as the Congestion Management Agency for Los 10 Angeles County, adopted the 1997 Congestion Management Program (IICMplI) 11 on November 20, 1997 and adopted a 2004 CMP on July 22, 2004; and 12 WHEREAS, the CMP statute requires that the MTA annually 13 determine that the County and cities within the County conform to all 14 CMP requirements; and 15 WHEREAS, the MTA requires submittal of the CMP Local 16 Development Report by September 1 of each year; and 17 WHEREAS, the City Council of the City of Vernon held a 18 noticed public hearing on August 17, 2005, at which time all interested 19 persons were given an opportunity to be heard; and 20 WHEREAS, the City Council has heard and considered all 21 evidence, both written and oral, presented respecting Vernon's 22 conformance with the criteria in the Congestion Management Program as 23 established by the Los Angeles County Metropolitan Transportation 24 Authority. 25 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 26 CITY OF VERNON AS FOLLOWS: 27 SECTION 1: The City Council of the City of Vernon hereby 28 finds and determines that the recitals contained hereinabove are true . _l ( \ 1 and correct. SECTION 2: The City Council finds and determines that the 2 3 City of Vernon has taken all of the following actions, and that the 4 City is in conformance with all applicable requirements of the 2004 CMP 5 adopted by the MTA Board on July 22, 2004. 6 A. The City of Vernon has adopted and continues to 7 implement a transportation demand management ordinance, consistent with 8 the minimum requirements identified in the CMP Transportatlon Demand 9 Management chapter. 10 B. The City of Vernon has adopted and continues to 11 implement a land use analysis program, consistent with the minimum 12 requirements identified in the CMP Land Use Analysis Program chapter. 13 C. The City of Vernon has adopted a Local Development 14 Report ("LDR"), attached hereto as Exhibit A and incorporated by 15 reference, consistent with the requirements identified in the 2004 CMP. 16 This report balances traffic congestion impacts due to growth within 17 the City with transportation improvements, and demonstrates that the 18 City is meeting its responsibilities under the Countywide Deficiency 19 Plan consistent with the MTA Board adopted 2003 Short Range 20 Transportation Plan. STAFF REPORT CONGESTION MANAGEMENT PROGRAM 2005 CONFORMANCE REPORT July 26, 2005 In 1997, the Vernon City Council approved Ordinance No. 1015 adopting a trip reduction and travel demand program in order to implement the Congestion Management Program ("CMP") of the County of Los Angeles. The CMP was designed to alleviate traffic congestion caused by increases in new development. Pursuant to the CMP, each city has been required to self certify that it is in compliance with all elements of the program. Conformance with local CMP requirements is required for jurisdictions to receive their portion of state gas tax revenues allocated by Section 2105 of the California Streets and Highways Code. Eighty-eight cities and the County of Los Angeles collectively receive over $93 million annually for maintaining compliance. Failure to comply with the requirements of the program could result in a loss of state and federal funding for transportation projects. The Countywide Deficiency Plan requires local agencies to offset a portion of the impact of new local development has on the regional transportation system. Historically, each local jurisdiction's responsibilities had been tracked through a point system that reflected the impact of local growth ("debi ts") of transportation and benefits improvements ("credits"), of which cities were required to maintain a positive balance. In recent years, cities have -1- .; ? raised concerns regarding this Deficiency Plan approach, citing their difficulty in maintaining conformance and questioning its effectiveness. In 2003, the MTA Board authorized a Short Range Transportation Plan that authorized a nexus study to evaluate the feasibility of implementing a congestion mitigation fee. The fee would help ensure that new growth directly mitigated traffic impacts on the regional transportation system by helping fund needed local transportation improvements. Said fees would mirror mitigation fees implemented in Orange and Riverside Counties. The purpose of the nexus study was to identify and justify a mitigation fee that would meet CMP Deficiency Plan requirements. In 2004, reporting of new development activity and adopting a self-certification resolution will continue to be an annual reporting requirement. Jurisdictions ,are still required to track and report new development activity, which represents new net development after subtracting for building permit revocations or demolitions. However, cities will no longer be required to maintain the ~positive credit balance" as mentioned above. The study will further evaluate a range of issues raised by the CM:!? Policy Advisory Committee (~PAC") includes crafting subregional fees that reflect conditions, acknowledging local traffic impact fees, streamlining the administration of the program. which local and -2- J . Because of this change in reporting requirements, a new reporting form has been created called the Local Development Report ("LDR") . Based on the Local Implementation Report from previous reporting cycles, the new form only calls for information on new net development. The calculation of Countywide Deficiency Plan "debits" is not included. Therefore, the City Council is requested to adopt the attached Congestion Management Program Local Development Report, in accordance with California Government Code Section 65089. -3-
