A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING RESOLUTION NO. 8473, AS REAFFIRMED
AND AMENDED BY RESOLUTION NO. 8780, BY AMENDING
SECTION 12c OF SAID RESOLUTION WHICH FIXED THE
COMPENSATION FOR CERTAIN EMPLOYEES OF SAID CITY
AND AUTHORIZED CERTAIN EXPENSE ALLOWANCES

7 WHEREAS, on June 30, 2004, Resolution No. 8473 was adopted
8 by the City Council of the City of Vernon to be effective on July 1,
9 2004; and
10 WHEREAS, on June 29, 2005, Resolution No. 8780 was adopted
11 by the City Council of the City of Vernon reaffirming and amending
12 Resolution No. 8473 to be effective on July 1, 2005; and
13 WHEREAS, Section 12c of Resolution No. 8473 provides for an
14 additional in lieu holiday for Fire Department employees assigned to
15 24-hour shift schedules if the City Council during a fiscal year
16 provides an additional holiday to miscellaneous/general employees; and
17 WHEREAS, the City Council of the City of Vernon desires to
18 amend Section 12c of Resolution No. 8473 to provide a second
19 additional in lieu holiday for Fire Department employees assigned to
20 24-hour shift schedules if the City Council during a fiscal year
21 provides a second additional holiday to miscellaneous/ general
22 employees; and
23 WHEREAS, Section 2.4 of the Memorandum of Understanding
24 adopted on March 15, 1988, between the Municipal Employees Relations
25 Representative and the Vernon Police Officers' Benefit Association, as
26 amended by various Side-Letter Agreements (the "MOU"), provides, in
27 part, for cost of living adjustments effective September 1 if cost of
28 living increases were received by Police Administration employees
. .
1 of the City in a fiscal year; and
2 WHEREAS, the City Council of the City of Vernon wishes to
3 reaffirm page 12 of Schedule II, Schedule IV and Schedule V adopted by
4 Resolution No. 8780 pertaining to Group 2 employee salaries, court
5 time pay and uniform allowances for the 2005-2006 fiscal year.
6 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
7 CITY OF VERNON AS FOLLOWS:

SECTION 1:
The City Council of the City of Vernon hereby
9 finds and determines that the recitals contained hereinabove are true
10 and correct.

SECTION 2:
The City Council of the City of Vernon hereby
12 reaffirms page 12 of Schedule II, Schedule IV and Schedule V adopted
13 by Resolution No. 8780 pertaining to Group 2 employee salaries, court
14 time pay and uniform allowances for the 2005-2006 fiscal year
15 effective as of September 1, 2005.

SECTION 3:
Effective July 1, 2005, Section 12c of
17 Resolution No. 8473 is hereby amended to read as follows:

Entitlement Up to Two Additional In Lieu Holidays
- Fire Department Employees Assigned to 24-Hour
Shift Schedule.

20 Effective July 1, 2005, Fire Department personnel
21 assigned to 24-hour shift schedule shall receive, during the fiscal
22 year, up to two additional "in lieu" holiday(s) (for a maximum of 12
23 hours each shift per "in lieu" holiday) if the City Council, during
24 such fiscal year, provides any additional holiday(s) to
25 miscellaneous/general employees in addition to those holidays provided
26 for in Resolution No. 8764, Vacation and Holidays. The employee's
failure to use the "in-lieu" holiday hours prior to the end of the

fiscal year shall be deemed a waiver by the employee of the right to

1 take the same or to be compensated for said unused accumulated vacation
2 benefit.

SECTION 4:
The provisions of Resolution Nos. 8473, 8517
4 8530, 8594, 8613, 8644, 8659, 8690, 8780 and 8822 not consistent with
5 or in conflict with this resolution are hereby repealed; in all other
6 respects, Resolution No. 8473, as amended by Resolution Nos. 8517,
7 8530, 8594, 8613, 8644, 8659, 8690, 8780 and 8822 shall remain in full
8 force and effect.

SECTION 5:
The Acting City Clerk of the City of Vernon
10 shall certify to the passage of this resolution, and thereupon and
11 thereafter the same shall be in full force and effect.

As directed by the City Administrator during the June 2005 "meet and confer"
process with the Fire Department; the Fire Department Employees assigned to a 24-Hour
Shift Schedule shall receive a second additional 12 hour shift offifthe City Council
provides a second "in-lieu" holiday to miscellaneous/general employees during such
fiscal year.
