RESOLUTION NO. 8847
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF
AN AMENDMENT NO. TWO TO CONSULTING SERVICES
AGREEMENT BY AND BETWEEN THE CITY OF VERNON AND
MELVYN GREEN AND ASSOCIATES, INC.
7 WHEREAS, on March 24, 1998, the City Council of the City of
8 Vernon adopted Resolution No. 7104 approving and authorizing the
9 execution of an Agreement for Consulting Services (the "Agreement")
10 with Melvyn Green and Associates, Inc. ("Melvyn Green") for plan
11 checking services; and
12 WHEREAS, on July 24, 2002, the City Council of the City of
13 Vernon adopted Resolution No. 8026, approving and authorizing the
14 execution of an Amendment No. One to the Agreement providing for an
15 increase in the hourly rate;
16 WHEREAS, in accordance with Section 14.2 of the Agreement,
17 the City of Vernon and Melvyn Green desire to amend the Agreement to
18 increase the hourly rate for special consulting services; and
19 WHEREAS, the Director of Community Services & Water by memo
20 dated August 31, 2005, has recommended that an amendment to the
21 Agreement with Melvyn Green be approved and executed.
22 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
23 CITY OF VERNON AS FOLLOWS:

SECTION 1:
The City Council of the City of Vernon hereby
25 finds and determines that the recitals contained hereinabove are true
26 and correct.

SECTION 2:
The City Council of the City of Vernon hereby
28 approves the Amendment No. Two to Consulting Services Agreement with
1 Melvyn Green, a copy of which is attached hereto as Exhibit "A" and
3
2 made a part hereof.
SECTION 3:
The City Council of the City of Vernon hereby
4 authorizes the Mayor to execute said Amendment for, and on behalf of,
5 the City of Vernon and the Acting City Clerk is hereby authorized to
6 attest thereto.

SECTION 4:
The City Council of the City of Vernon hereby
directs the Acting City Clerk, or his designee, to send one fully

SECTION 5:
The Acting City Clerk of the City of Vernon

15 thereafter the same shall be in full force and effect.

RECITALS

WHEREAS, the City and Consultant are parties to an Agreement for Consulting Services
that was entered on or about April 2, 1998 (hereinafter referred to as the "Agreement") under which
Consultant provides the City with plan checking services; and
WHEREAS, said Agreement was amended July 31, 2002 to provide for an increase in
Consultant's hourly rate for special consulting with the remainder of the fee schedule remaining the same;
and

WHEREAS, the City and Consultant desire to again amend the Agreement to provide for
an increase in Consultant's hourly rate for special consulting with the remainder of the fee schedule
remaining the same; and
WHEREAS, Section 14.2 of the Agreement provides for amendments and modifications to
the Agreernent.
NOW, THEREFORE, IN CONSIDERATION OF THESE MUTUAL COVENANTS, THE
PARTIES HERETO AGREE AS FOLLOWS:

SECTION 1: This Amendment shall be effective on July 1, 2005, and will continue in
effect for a period of one (I) year or until terminated as provided in Agreement. City shall have the option
to extend the Agreement in one (1) year increments.
SECTION 2: Section 3 of the Agreement and Section 1 of Amendment No. One entitled
"COMPENSATION" is hereby amended by deleting the text and replacing it as set forth below:
The City agrees to pay the Consultant for its services hereunder and the
Consultant agrees to work for 50% ofthe City charged plan check fee where the
fee exceeds $200.00 and 80% of the plan check fee where the fee is $200 or less.
The plan review fee will be 80% of the City charge when performing both
structural and non-structural plan review. Fee includes shipping plans from
Consultant to City. For special consulting the fee shall be $160 per hour
including travel time where applicable.
SECTION 3: In allother respects, the terms and conditions of the Agreement shall be
renewed in its entirety.
