RESOLUTION NO. 8865
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON ACCEPTING THE WORK OF
SULLY MILLER CONTRACTING COMPANY IN
ACCORDANCE WITH CONTRACT NO. 570 OF
THE CITY OF VERNON

WHEREAS, Sully Miller Contracting Company was awarded Contract No. 570
for Bandini Boulevard, Leonis Boulevard, 37th Street and 38th Street Improvements pursuant to

Resolution No. 8508 of the City of Vernon; and
WHEREAS, Samuel Kevin Wilson, Director of Conimunity Services and Water
has reported to the City Council of the City of Vernon on October 3, 2005 that said work has been
completed and recommends that the work be accepted and payment be made to the Contractor in
accordance with the agreement.

NOW, THEREFORE, BE IT RESOLVED BYTHE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon hereby finds and

determines that the recitals contained hereinabove are true and correct.
SECTION 2: The work of Sully Miller Contracting Company pursuant to
Contract No. 570 is hereby approved and accepted by the City Council of the City of Vernon.
SECTION 3: The total expended amount is Two Million Thirteen Thousand
Seven Hundred Seventy Nine Dollars and Four cents ($2,013,779.04). Therefore, of the funds
due to Sully Miller Contracting Company Eighty Thousand Nine Hundred Forty One Dollars and
Eighty Three cents ($80,941.83) is now due. The remaining ten percent (10%) or the sum of
Two ij:undred and One Thousand Three Hundred Seventy Seven Dollars and Ninety cents
($201,377.90) is payable thirty-five days after the adoption of this resolution.
SECTION 4: The City Council of the City of Vernon hereby directs payment of
said sums as set forth to Sully Miller Contracting Company and instructs the City Clerk to file a
notice of completion with the County Recorder.

1 SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of
2 this resolution and thereupon and thereafter the same shall be in full force and effect.
