RESOLUTION NO. 8869
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPOINTING DONAL O'CALLAGHAN, DIRECTOR OF
LIGHT & POWER, AS THE CITY'S DESIGNATED
REPRESENTATIVE FOR UNITS Ml AND M2 OF THE MALBURG
GENERATING STATION
WHEREAS, the City of Vernon ("City") has constructed a 134
MW Combined Cycle Power Plant, the Malburg Generating Station (the

"Malburg projett"), for the purpose of installing additional
generating capacity that will yield an efficient, cost-effective, and
reliable source of electric generation to the City's inhabitants; and

WHEREAS, regulations of the United States Environmental
Protection Agency found at 40 C.F.R. Parts 72-78 require that a
"designated representative" be selected by the City pursuant to
written notice for the Malburg Project Units Ml and M2; and
WHEREAS, it is appropriate that the City's Director of Light
& Power, Donal O'Callaghan, be selected as the City's designated
representative under 40 C.F.R. Parts 72-78 for Units Ml and M2; and
WHEREAS, by this designation1 DonalO'Callaghan shall have
all necessary authority to carry out his duties and responsibilities
under the Clean Air Act, as amended, and under 40 C.F.R. Parts 72-78
on behalf of the City for the Malburg Project Units Ml and M2; and
WHEREAS, by its selection of a designated representative,
the City is bound by the actions, inactions, or submissions of Donal
O'Callaghan for the Malburg Project Units Ml and M2 and is bound by
any order issued to him by the permitting authority, court or
administrator; and
WHEREAS, on September 27, 2005, the Acting City Clerk
1 published a Notice in the Metropolitan News-Enterprise, which was
2 determined to be a newspaper of general circulation nearest to the
3 City most appropriate for this purpose; and
4 WHEREAS, a copy of the Declaration of Publication is
5 attached hereto as Exhibit A and incorporated by reference, for the
6 appointment of a designated representative.
7 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
8 CITY OF VERNON AS FOLLOWS:
9 SECTION 1: The City Council of the City of Vernon hereby
10 finds and determines that the recitals contained hereinabove are true
11 and correct.
12 SECTION 2: The City Council of the City of Vernon hereby
13 designates the Director of Light & Power, Donal O'Callaghan, as the
14 City's "designated representative" under 40 C.F.R. Parts 72-78
15 respecting the Malburg Generating Station Units Ml and M2.
16 SECTION 3: The City Council of the City of Vernon hereby
17 directs the Acting City Clerk to forward a copy of this resolution to
18 the Director of Light & Power in conformance with the recordkeeping
19 and reporting requirements under 40 C.F.R. Parts 72-78 to keep
20 documents respecting the appointment of a designated representative on
21 site for a period of five (5) years, or until such document is
22 superseded.

SECTION 4:
The Acting City Clerk of the City of Vernon
shall certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
