Resolution No. 8876 ~r~ 1 2 3 4 5 6 RESOLUTION NO. 8876 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON REQUIRING ALL CITY OF VERNON BENEFIT AND COMPENSATION POLICIES TO BE ADMINISTERED ONLY IN THE MANNER SPECIFICALLY AUTHORIZED IN APPROVED AND ADOPTED RESOLUTIONS AND ORDINANCES OF THE CITY OF VERNON 7 WHEREAS, the City Council of the City of Vernon has 8 previously approved and adopted various resolutions and ordinances 9 which specifically govern various benefits, terms and conditions of 10 employment with the City of Vernon, and that address the manner in 11 which the benefits and compensation policies of City employees are to 12 be administered; and 13 WHEREAS, such resolutions and ordinances of the City of 14 Vernon also, in certain instances, specifically delegate to various 15 City personnel the authority to administer the manner in which 16 benefits and compensation policies of the City of Vernon are to be 17 applied to City employees; and 18 WHEREAS, the City Council of the City of Vernon desires to 19 adopt this resolution to set forth, adopt or otherwise clarify the 20 requirements necessary to adopt, implement and/or otherwise establish 21 practices, policies and plans related to the work premises, and the 22 terms and conditions governing employment with the City of Vernon, or 23 to obtain authority for the administration of the benefits and 24 compensation policies of the City pertaining to such matters, 25 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 26 CITY OF VERNON AS FOLLOWS: 27 SECTION 1: The City Council of the City of Vernon hereby 28 finds and determines that the recitals contained hereinabove are true 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 .21 22 23 24 25 26 27 28 and correct. SECTION 2: The City Council of the City of Vernon hereby declares: a, No employment-related plan affecting the terms and conditions of employment with the City of Vernon will be enforced or otherwise recognized unless and until it shall have been reduced to a writing and approved by the City Council. b. No delegation of authority to administer benefits and compensation, including, without limitation, the level, quantity and eligibility therefore, and amount of such benefits, will be recognized by the City of Vernon unless such authorization has previously been obtained through an adopted resolution or ordinance of the City of Vernon or is specifically authorized pursuant to and in accordance with a future approved and adopted resolution or ordinance of the City of Vernon. c. Only plans, policies and practices that comply with this Resolution will be recognized, and only so long as the manner of administration of such benefits complies with formal resolutions and ordinances approved and adopted by the City Council. Only those City personnel specifically designated as having authority to administer the manner in which benefit and compensation policies are applied in past or future approved and adopted resolutions or ordinances shall be recognized as having the ability to administer such benefits and compensation policies. d. Nothing in this Resolution is intended to alter or modify the "at the will and pleasure" status of City of Vernon employees, which permits either the City of Vernon or the employee to terminate his/her employment at any time, with or without cause and - 2 - 1 with or without notice, 2 SECTION 3: The Acting City Clerk of the City of Vernon 3 shall certify to the passage of this resolution, and thereupon and 4 thereafter the same shall be in full force and effect. 5 APPROVED AND ADOPTED this 19th day of October, 2005. 6 7 8 9 10 11 12 13 ~I , ,kfk6~/ .,.,- LEONISC.
