Resolution No. 8887 1 2 3 4 RESOLUTION NO. 8887 5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE PURCHASE OF ONE 2006 FORD ESCAPE HYBRID VEHICLE FOR THE HEALTH DEPARTMENT 6 7 WHEREAS, the Environmental Health Department has determined 8 that it needs. a new vehicle to replace and older vehicle; and 9 WHEREAS, the Environmental Health Department purchased a 10 Ford Escape Hybrid last year and has determined that a 2006 Ford 11 Escape Hybrid vehicle running on a gasoline engine, electric battery 12 power or both together meeting the Super Ultra Low Emission Vehicle 13 and Partial Zero Emission Vehicle emission standards is the best 14 replacement vehicle to meet its needs; and 15 WHEREAS, on October 25, 2005, the Finance Committee 16 considered the request to seek formal bids for the purchase of a 2006 17 Ford Escape Hybrid; and 18 WHEREAS, a bid specification for the purchase of the 2006 19 Ford Escape Hybrid has been presented to the City Council of the City 20 of Vernon; and 21 WHEREAS, the City Council of the City of Vernon has 22 determined that it is in the best interests of the City of Vernon that 23 bids be solicited in accordance with the Vernon City Code. 24 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 25 CITY OF VERNON AS FOLLOWS: 26 SECTION 1: The City Council of the City of Vernon hereby 27 finds and determines that the recitals contained hereinabove are true 28 and correct. 1 SECTION 2: The bid specification, which is attached hereto 2 as Exhibit A and incorporated by reference, is hereby approved by the 3 City Council of the City of Vernon. 4 SECTION 3: The Acting City Clerk of the City of Vernon is 5 hereby directed to give notice, in writing, inviting sealed proposals 6 or bids for the purchase of one 2006 Ford Escape Hybrid vehicle, in 7 accordance with the bid specification, and in accordance with this 8 resolution. 9 SECTION 4: There being no newspaper of general circulation 10 printed, published or circulated in the City of Vernon, the Acting 11 City Clerk is hereby directed to post said notice, or cause the same 12 to be posted, in three of the most public places in the City of 13 Vernon, to wit: the northwest corner of 38th Street and Santa Fe 14 Avenue, the northeast corner of Leonis Boulevard and Pacific 15 Boulevard, and on the bulletin board located outside on the wall near 16 the second floor entrance to the City Hall of said City, located at 17 4305 Santa Fe Avenue, all in the City of Vernon, County of Los 18 Angeles, State of California. 19 SECTION 5: The Acting City Clerk of the City of Vernon is 20 hereby directed to post said notice forthwith and the first posting of 21 said notice shall be at least ten (10) days before the opening of the 22 bids for the proposed contract. DUCKWORTH Acting City Treasurer CityofVemon TECHNICAL SPECIFICATIONS FORA 2006 FORD ESCAPE HYBRID FRONT WHEEL DRIVE (FWD) INTENT It is the intent of this specification to provide for the purchase of one (1) new and unused 2006 Ford Escape Hybrid Front Wheel Drive with a 2.3L 14 Atkinson cycle engine and continuously variable transmission. The City of Vernon has evaluated different types of vehicles and has determined that this product is best suited for the department's needs in safety, quality, performance, and standardization. The department previously purchased an Escape Hybrid in 2005. In comparing proposals, consideration will not be confined to price only. The successful bidder will be one whose product is judged shall best serve the interests of the City of Vemon when price, product, safety, quality and delivery are considered. The City of Vernon reserves the right to reject any or all bids or any part thereof, and to waive any minor technicalities. A contract will be awarded to the bidder submitting the lowest qualified and responsible bid meeting the requirements of this specification. The City requires the successfQl bidder to provide proof of insurance, including a standard certificate of insurance, in at least the amounts and coverage indicated on the insurance schedule. In addition to the standard certificate of insurance, proof of general and umbrella liability coverage shall also be furnished in the form indicated on the attached insurance schedule (Exhibit "A"). EOUIVILENTPRODUCT Bids will be accepted for the consideration on any make or model that is equal or superior to the vehicle specified. Decisions of equivalency will be at the sole interpretation of the City. A blanket statement that equipment proposed will meet all requirements will not be sufficient to establish equivalency. Original manufacturer's brochures of the proposed unit are to be submitted with the proposal. All modifications made to the standard production unit described in the manufacturer's brochures must be certified by the manufacturer and submitted with the bid, or the bid will be deemed ''non-responsive'' and tJd~"e(J 'abUlttia( rejected without further review. Bidder must be prepared to demonstrate a unit similar to the one proposed, if requested. INTERPRETATIONS In order to be fair to all bidders, no oral interpretations will be given to any bidder as to the meaning of the specification docwnents or any part thereof. Every request for such a consideration shall be made in writing to the City of Vemon. Based on such inquiry, the City may choose to issue an Addendwn. Unauthorized conditions, limitations, or provisions shall be cause for rejection. Any dispute related to this Contract shall be adjudicated in a state court serving the County of Los Angeles, California. 9. Arbitration. The parties agree that any and all disputes arising out of or in -2- 1 relation to this Contract, including without limitation any action in tort, shall be resolved exclusively, 2 finally and conclusively by arbitration in Los Angeles County, California under the auspices of and 3 pursuant to the rules ofthe Judicial Arbitration & Mediation Services Inc. (JAMS). Each party will 4 select an arbitrator. Those two arbitrators will then select a third. The three-member panel will make 5 the final decision. All decisions of the arbitrators shall be in writing, and the arbitrators shall provide 6 written reasons for their decision. The arbitration decision shall be final and binding on the parties. 7 Notwithstanding the foregoing, the parties shall be permitted to access the court system to enforce any 8 arbitration award or to obtain injunctive relief. The exclusive jurisdiction and venue for any such action 9 shall be the Superior Court of California, Los Angeles County.
