Resolution No. 8929 1 RESOLUTION 8929 2 5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO USA WASTE OF CALIFORNIA, INC. FOR THE OPERATION OF A TRUCKING TERMINAL AT 4280 BANDINI BOULEVARD 3 4 6 WHEREAS, USA Waste of California, Inc. (~USA Waste") has 7 applied for a conditional use permit to operate a truck terminal at 8 4280 Bandini Boulevard located in the City of Vernon; and 9 WHEREAS, the City Council of the City of Vernon held a hearing 10 on said application for a conditional use permit on December 21, 11 2005; and 12 WHEREAS, the proposed use is allowed in the M-2 Zone, Heavy 13 Industry and Section 26.3.6-3 of the Comprehensive Zoning Ordinance 14 requires a truck terminal to obtain a conditional use permit; and 15 WHEREAS, the proposed site is approximately 2.33 acres in size, 16 and is adequate in size, shape, topography and has adequate drainage 17 for the proposed operation; and 18 WHEREAS, the proposed site is surrounded by industrial and 19 commercial uses compatible with the proposed use and no adverse 20 effects from traffic, parking, noise, odors, dust, smoke, light or 21 glare, or risk of fire, infection or explosion is anticipated from 22 the proposed operation; and 23 WHEREAS, the site has adequate on-site parking and loading 24 facilities in accordance-with the Zoning Ordinance, therefore, does 25 not have an effect on off-street parking and loading facilities; and 26 WHEREAS, the site has access to Bandini Boulevard, and in 27 general traffic will generally travel on Bandini Boulevard to 28 established collection routes in and neighboring the City of Vernon. -1- 1 Bandini Boulevard is of adequate size and pavement-type to handle 2 the traffic generated from the proposed operations; and 3 WHEREAS, the neighboring facilities have similar uses that are 4 compatible with USA Waste proposed use, the number of traffic trips 5 is consistent with these sites, and the number of traffic trips 6 generated by USA Waste will not significantly impact the neighboring 7 facilities or public streets' ability to handle the traffic load 8 from the proposed operations; and 9 WHEREAS, the proposed use, as to location, operation and design 10 is consistent with the General Plan and Zoning Ordinance of the City 11 of Vernon; and 12 WHEREAS, the project is categorically exempt from the California 13 Environmental Quality Act (CEQA) as an existing facility pursuant to 14 Section 15301 of the California Environmental Quality Act Guidelines 15 and a Notice of Exemption will be prepared and filed with the County 16 Clerk; and 17 WHEREAS, the conditions imposed on the conditional use permit 18 as set forth herein will adequately protect the public health, 19 safety and general warfare and the operation is consistent with all 20 applicable rules and laws of the City of Vernon; and 21 WHEREAS, the City Council has received a Staff Report, dated on 22 December 14, 2005 upon which it has relied in making the foregoing 23 recitals; and 24 / / / 25 / / / 26 / / / 27 / / / 28 / / / -2- 1 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 2 OF VERNON AS FOLLOWS: 3 SECTION 1: The City Council of the City of Vernon hereby finds 4 and determines that the recitals contained hereinabove are true and 5 correct. 6 SECTION 2: Subject to the conditions set forth below, the 7 conditional use permit is hereby granted to USA Waste for the 8 operation of a truck terminal and other transportation-related uses 9 at 4280 Bandini Boulevard located in the City of Vernon. 10 SECTION 3: In order to adequately protect the public health and 11 general welfare the following conditions are required: 12 a. The facility shall be operated in accordance with, and made 13 to conform with all current codes, rules, and regulations and subject 14 to permit fees as adopted by the City of Vernon not otherwise 15 addressed by this grant of a conditional use permit. 16 b. All required federal, state, local and regulatory agency 17 permits shall be obtained prior to operation. Prior to occupancy a 18 business license and occupancy permit shall be obtained. 19 c. Any extension, change in use, change in ownership interest, 20 and/or the issuance of a new occupancy permit shall require a new 21 conditional use permit. 22 d. All parking and loading facilities shall be paved with a 23 hard durable surface material and shall be adequately drained, and 24 ,kept free of dust, mud, trash and weeds. Where parking or maneuvering 25 areas adjoin the public street a barrier wall or landscaping shall be 26 installed and maintained to meet City standards. Adequate on-site 27 parking shall be maintained so that no on street parking or staging 28 will occur. -3- 1 e. The facility shall be operated in a manner that will 2 prevent unsanitary conditions, odors, litter or other nuisances. 3 f. The facility shall be structurally maintained to exclude 4 rodents and the property shall be maintained rodent free. The site 5 shall maintain adequate drainage to eliminate potential mosquito 6 harborage. 7 g. Servicing of vehicles, including but not limited to, 8 washing, steam cleaning and repairing, shall not be permitted on the 9 premises and shall only be performed at facilities in compliance with 10 appropriate codes. No inoperative vehicles shall be stored on-site. 11 All vehicles operated at the facility shall be tuned and maintained 12 in accordance with applicable emission standards. 13 h. A National Pollutant Discharge Elimination System Permit 14 shall be obtained from the California State Board of Water Resources, 15 and a Storm Water Pollution Prevention Plan shall be prepared and 16 implemented. 17 i. Adequate plans and materials must be available for handling 18 leaks or spills from vehicles during storage or transportation. 19 j. The facility shall be operated in a manner that will not 20 impede traffic on Bandini Boulevard. All vehicles shall enter and 21 exit the site in a front forward manner. No maneuvering shall take 22 place on the public street. 23 k. All existing cracked sidewalk, driveways, curb and gutter 24 adjacent to the site on Bandini Boulevard shall be repaired and 25 maintained to meet City standards. 26 1. No Refuse shall be transported to or received at this 27 facility. 28 / / / -4- 1 m. USA Waste shall construct 8" thick concrete access curb 2 ramp per Caltrans Standard Plan No. A88A. Remove or relocate any 3 conflicting improvements. 4 n. USA Waste shall submit a Lot Merger application combining 5 the three properties into one lot. 6 o. Use of welding, cutting, and other hot work equipment shall 7 not be performed in any building on the premises. 8 p. Noncompliance with any condition set forth in the 9 conditional use permit shall be grounds for voiding the permit 10 pursuant to Section 26.5.2-10 of the Comprehensive Zoning Ordinance. 11 SECTION 4: USA Waste and any successors in interest shall 12 indemnify, hold harmless, and defend the City of Vernon, its 13 officers, agents, and employees from and against any and all claims, 14 complaints, or petitions for: (1) damages, losses, expenses 15 resulting from bodily injury, sickness, disease, disability or death 16 arising from the operation of the facility excluding therefrom any 17 such claim resulting from the sole negligence or intentional 18 wrongdoing of the City of Vernon, its officers, agents or employees; 19 (2) a peremptory writ or other relief by way of injunction, 20 mandamus, or administrative mandamus; and/or (3) legal expenses and 21 attorney's fees incurred by the City of Vernon on behalf of any 22 party in such actions or proceedings. The City of Vernon does not 23 waive its right to participate in the defense of any such action 24 SECTION 5: Not later than sixty (60) days from the date of this 25 Resolution, USA Waste shall indicate, in writing, its acceptance of 26 and agreement with the conditions contained in Section 3 of this 27 Resolution and the indemnification provision contained in Section 4 28 of the Resolution. -5- 1 SECTION 6: The Acting City Clerk of the City of Vernon shall 2 certify to the passage of this resolution and thereupon and 3 thereafter the same shall be in full force and effect. 4 APPROVED AND ADOPTED this 21st day of December, 2005. 5 7 ~' ~~~" . ---i.eoniS c. After review of the application by the Community Services Department, it is recommended that the conditional use permit be granted. Herewith for your consideration are the following supporting documents: 1. Staff Report. 2. Request for conditional use permit and information supporting the application. 3. Notice of Public Hearing, copies of notification letters to owners and tenants in the area and affidavits of posting and mailing. The project is categorically exempt from CEQA because it is an existing facility as described in Section 15301. A Notice of Exemption will be prepared and filed with the County Clerk. In my opinion the proposed operation will pose no adverse effects to the City of Vernon and will have no significant effects on the environment. The project is consistent with the General Plan as adopted by the City of Vernon. CONDITIONAL USE PERMIT TO OPERATE A TRUCK TERMINAL AT 4280 BANDINI BOULEVARD December 14, 2005 USA Waste of California, Inc. ("USA Waste") has submitted an application for a conditional use permit, as required by the Comprehensive Zoning Ordinance Section 26.3.6-3(c) to operate a truck terminal and other transportation-related uses at 4280 Bandini Boulevard. Klistoff and Sons, Inc. previously occupied this site as a truck terminal. USA Waste has purchased the assets of Klistoff and Sons and is proposing a minor expansion of its operation. The proposed site will be used as a staging area for USA Waste's trucks and used for light maintenance and repair and to dispatch trucks. The facility's operating hours will be twenty-four hours a day, seven days a week. 1. GENERAL PLAN The proposed use conforms to the Comprehensive Zoning Ordinance and is in accordance with the General Plan. The site is located in the M-2 Zone, Heavy Industry. A truck terminal is allowed in this zone with a conditional use permit. 2. SITE The site is 2.33 acres and contains one 15,223 square foot building (main building) and one 3,750 square foot wash rack canopy. The applicant has not proposed any changes to the size, shape or topography of the existing site. The site plans for the proposed operation indicates the site is adequate in size, shape, topography, including drainage and landscaping. The canopy will be used for truck washing and maintenance. 3. ADVERSE EFFECT The proposed site is surrounded by industrial uses compatible with the proposed use. No potentially significant impacts are expected to result from traffic, parking, noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion from the project. The project is categorically exempt under Section 15301 of the California Environmental Quality Act because it is an existing facility with no expansion of use. A Notice of Exemption will be prepared and filed with the County Clerk. 4. ACCESS The site will have two driveways located on Bandini Boulevard at opposite ends of the property. Bandini Boulevard is 100 feet wide and is of adequate size to handle the traffic generated from the proposed operation. 5. VEHICLE MOVEMENTS USA Waste proposes to operate a truck terminal and park their thirty-seven refuse collection vehicles on-site. Operating hours will be twenty-four hours a day, seven days a week. Traffic to and from the site will primarily stem from the movements of thirty-seven refuse trucks. These refuse trucks will be dispatched at different times throughout the day. The refuse trucks will exit/enter the facility on the northerly side of the property located at 4280 Bandini Boulevard. The site will have 110 daily truck and automobile trips per day (55 inbound and 55 outbound). The employee vehicles and refuse trucks will enter and exit the site by one of the two driveways on Bandini Boulevard. The refuse collection vehicles pick up commercial and residential refuse and are limited to non-hazardous waste. As part of their conditional use permit they will not be allowed to bring any refuse to the proposed site. There will be ample on-site parking available for all the vehicles and all gates will remain open during business hours. 6. OPERATIONS USA Waste will use the facility to operate a truck terminal, maintain their vehicles and storage of their personal trash bins. The refuse collection vehicles will be empty while on-site and will not bring any refuse to the site. According to the Comprehensive Zoning Ordinance, the project as proposed requires 17 car parking spaces, 1 truck parking space and 2 truck loading spaces. The current site plan has ample space for parking and maneuvering as required by the Comprehensive Zoning Ordinance. All office functions will take place in the designated office area located on the north end of the main building facing Bandini Boulevard. This area will include a reception area, four offices, and restroom facilities. Truck maintenance and trash bin repair will be conducted in the portion of the main building approved for this use by the City of Vernon as required by the 2000 Uniform Building Codes. Truck service in this area will include changing brake pads, oil, filters, fluids, and making minor adjustments. All major maintenance is done off-site. Trash bin repair not requiring an open flame may also be done in this section of the building. All trash bin assembly involving an open flame shall take place in the portion of the main building approved for this use. This room shall be separate from the truck maintenance area and shall comply will all applicable regulations set by the 1997 Uniform Building Code. Activity in this area will include open flame assembly of trash bins and trash bin repair for the sole use of USA Waste. The canopy located at the south end of the property may be used as a wash rack for the washing and maintenance of USA Waste trucks. Typically trucks will be washed and may be steam cleaned on occasion. Light maintenance may occur in areas as allowed by the Uniform Building Code and in compliance with NPDES standards. The wash rack will be equipped with a drainage system that drains to an approved wastewater treatment system before discharging into the sewer main. 7. STATE OR FEDERAL CONDITIONS All Federal, State, and local regulatory permits shall be obtained as required for the operqtion. 8. Klistoff and Sons, Inc. have operated the site since the CUP was issued. The site is located in the Heavy Industrial, M2 Zone. The site functions as a truck terminal, along with other ancillary activities, for a refuse/recycling company. On site activities include: Truck Departure and Return Truck Maintenance Truck Washing Truck and Employee Vehicle Parking A Small Office for Clerical and Managerial Staff Refuse and Recycling Container Storage, Washing and Maintenance Refuse and Recycling Container Delivery and Return No delivery or storage of solid waste beyond that which generated by the office and maintenance activities necessary for the operation occurs. USA Waste of California, Inc. has assumed operations of the site. With the exception of Refuse and Recycling Container Storage, Washing and Maintenance, and Container Delivery and Return, all listed activities will continue. Presently, the eastern driveway is not used. The western driveway is located directly opposite from the terminus of Bonnie Beach PI. at Bandini Blvd. It is controlled by a traffic signal that was installed per the Agreement of January 5, 1993 between the City of Vernon and the Phillips Family Trust. Trucks and cars accessing the site enter and exit by the western driveway. USA Waste proposes to openthe eastern driveway to provide an additional point of ingress ,and egress. All vehicles leaving the facility will be required to do so as follows: Vehicles traveling eastbound will leave from either the eastern or western driveway by making a right turn on Bandini Blvd. Vehicles traveling westbound will leave from the western driveway only by making a left turn on Bandini Blvd. at the traffic light controlling the driveway intersection. They include but are not limited to: Preventive maintenance (Oil changes, services, etc.) Parts replacement or repair Welding and use of Acetylene/Oxygen torches Use of air compressors and impact wrenches Sanding and or grinding Tire repair Etc. i .. " Page 5 Maintenance activities require on site storage of various chemicals such as motor and hydraulic oils, antifreeze and solvents. In addition, they result in the generation of used oil, antifreeze and solvents that must be properly removed. Separate plans such as the . Hazardous Materials Inventory/Business Plan, a Stormwater Pollution Prevention Plan and a Spill Prevention, Control and Countermeasure Plan are submitted under separate cover. Most of the maintenance activities occur during Shift 4 when trucks are off the routes. Wash Rack The site has a wash rack that has typically been used to wash both trucks and containers. Trucks will continue to be washed on site. All container maintenance on site, including washing will be discontinued. Wastewater from the wash rack is discharged to the sanitary sewer system after passing through a clarifier. Sludge from the clarifier is pumped periodically by a licensed industrial waste hauler and appropriately disposed. . .
