A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 VERNON RESCINDING RESOLUTION NO. 8755 REGARDING AN
4 EQUIPMENT PURCHASE AND SERVICES CONTRACT WITH
GACELA GROUP FOR DIGITAL VOICE RECORDERS FOR POLICE
5 DEPARTMENT

7 WHEREAS, on May 18, 2005, the City Council of the City of
8 Vernon adopted Resolution No. 8755 approving an Equipment Purchase and
9 Services Contract dated May 18, 2005, in form (the "Draft Agreement")
10 with Gacela Group ("Gacela") for the purchase of digital recorders
11 together with audio system, licenses, software, support, installation
12 and training services (collectively, the "Recorders"); and
13 WHEREAS, following the City Council's approval of the Draft
14 Agreement and after the actual agreement was signed by the City on
15 June 14, 2005, it was determined by the Police Department that Gacela
16 misrepresented the Recorders, their function, security features and
17 database software and that the Recorders did not meet the Department's
18 requirements; and
19 WHEREAS, the City desires to rescind its prior approval of
20 the Draft Agreement.
21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
22 CITY OF VERNON AS FOLLOWS:
23 SECTION 1: The City Council of the City of Vernon hereby
24 finds and determines that the recitals contained hereinabove are true
25 and correct.
26 SECTION 2: The City Council of the City of Vernon hereby
27 rescinds Resolution No. 8755 and the Equipment Purchase and Services
28 Contract with Gacela. Any resolution not consistent with or in
conflict with this resolution is hereby repealed.
SECTION 3: The Acting City Clerk of the City of Vernon
shall certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.

Vernon, do hereby certify that the foregoing Resolution, being
Resolution No. 8922, was duly adopted by the City Council of the City
of Vernon at an adjourned regular meeting of the City Council duly held
on Wednesday, January 4, 2006, and thereafter was duly signed by the
Mayor Pro Tem of the City of Vernon.
