A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A
REIMBURSABLE TRAINING SERVICES AGREEMENT BY AND
BETWEEN THE CITY OF VERNON AND THE STATE OF
CALIFORNIA ACTING BY AND THROUGH THE DEPARTMENT OF
CALIFORNIA HIGHWAY PATROL
WHEREAS, on November 7, 1989, the City Council of the City
of Vernon adopted Resolution No. 5686 authorizing the City
Administrator/City Clerk to execute Training Agreements on behalf of
the City of Vernon with the State of California, Department of
California Highway Patrol ("CHP"); and
WHEREAS, the Vernon Police Department desires to participate
in training classes sponsored and administered by the CHP from
March 13, 2006 to March 24, 2006; and
WHEREAS, in order for the City to participate in said
training classes, the CHP requires the City to enter into a
Reimbursable Training Services Agreement; and
WHEREAS, by memo dated January 24, 2006, Sol Benudiz, Chief
of Police, recommended that an agreement with the CHP be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves the Reimbursable Training Services Agreement with the CHP
(Log # T-06-062-009), a copy of which is attached hereto as Exhibit A

and incorporated herein by reference.
SECTION 3: The City Council of the City of Vernon hereby
authorizes the Mayor to execute said Agreement for, and on behalf of,
the City of Vernon and the Acting City Clerk is hereby authorized to
attest thereto.
SECTION 4: The City Council of the City of Vernon hereby
directs the Acting City Clerk, or his designee, to send two signed
Agreements, together with tuition of $1,300.00, to:

SECTION 5: The Acting City Clerk of the City of Vernon
shall certify to the passage of this resolution, and thereupon and

THIS AGREEMENT, Training Services Control (TSC) Log # T-06-062-009 made and entered into this 20th day
of January 1 2006 , by and between the State of California, acting by and through the Department of California
Highway Patrol, hereinafter called CHP, and Vernon Police Department , hereinafter called
VPD
WITNESSETH: By and in consideration of the covenants and conditions herein contained,
VPD and CHP do hereby agree to the following terms and conditions:
CHP Coordinator shall be Officer Ivan Jacome , telephone number (916) 445-1865
2. The CHP agrees to allow 2 trainee(s) to attend
Allied Agency Commercial Enforcement training class(es) during the period of
03/13/2006 to 03/24/2006

Training shall be conducted at the following location(s):
CHP Academy, 3500 Reed Avenue, West Sacramento, CA
I-80 Antelope Platform Scales, I-80 at Antelope Road, Sacramento, CA
4. Cost of training: $ 650.00 per trainee, total $ 1,300.00 for
trainee(s) (includes 2 training class, ❑ meals/housing, ❑ other
5. Rates charged to VPD shall in no event exceed the actual costs to the
CHP to perform the requested services. In consideration for the instruction and facilities provided,
VPD agrees to pay CHP in advance.
6. Payment must be received prior to the commencement of class. Checks shall be made payable to the California
Highway Patrol and be accompanied with the following information: TSC Log #, date of class, and name of aftendee(s).
7. All cancellation notices to CHP must be made during normal CHP business hours of 8:00 a.m. to 5:00 p.m., Monday
through Friday, excluding legal holidays. Cancellation notices shall only be accepted by the CHP Coordinator or
designee.
8. In the event of a disaster or unforeseen emergency, this agreement may be canceled without prior notice by CHP.
9. This agreement may be amended by mutual consent of the parties hereto.
10. The VPD agrees to indemnify, defend, and save harmless the state, its
officers, agents and employees from any and all claims and losses accruing or resulting to any and all contractors,
subcontractors, suppliers, laborers, and any other person, firm or corporation furnishing or supplying work services,
materials, or supplies in connection with the performance of this Agreement, and from any and all claims and losses
accruing or resulting to any person, firm or corporation who may be injured or damaged by
VPD in the performance of this agreement.
11. The VPD shall be responsible for paying any cost incurred by CHP
for facility damage caused by the willful or malicious misconduct of any VPD
trainee(s).

12. No additional gifts, donations, or gratuities may be accepted by CHIP employees on their behalf or on behalf of the
Department, informal squad fund, or other local funds.
13. Notices and communications hereunder shall be sent to the addresses appearing below the signatures.
14. MOTORCYCLE TRAINING ONLY: Trainee(s) must possess a valid Class M driver license or a proper endorsement for
motorcycle operation to attend training classes.
