Resolution No. 8972I RESOLUTION NO. 8972 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ADOPTING THE NATIONAL INCIDENT MANAGEMENT 4 SYSTEM AS THE CITY'S STANDARD FOR INCIDENT MANAGEMENT 5 6 WHEREAS, the President in Homeland Security Directive-5, 71 directed the Secretary of the Department of Homeland Security to g develop and administer a National Incident Management System ("NIMS"), 9 which would provide a consistent nationwide approach for federal, 10 state, local and tribal governments to work together more effectively 11 and efficiently to prevent, prepare, prepare for, respond to, and 12 recover from disasters, regardless of cause, size, or complexity; and 13 WHEREAS, California pioneered the development of 14 standardized incident management systems to respond to a variety of 15 catastrophic disasters, including fires, earthquakes, floods, and 16 landslides; and 17 WHEREAS, in the early 1970s, the California Fire Service, in 18 partnership with the federal government, developed the seminal 19 emergency incident command system that has become the model for 20 incident management nationwide; and 21 WHEREAS, in 1993, California was the first state to adopt a 22 statewide Standardized Emergency Management System ("SEMS") for use by 23 every emergency response organization, and implemented a system to 24 ensure the continual improvement of SEMS; and 25 WHEREAS, on May 20, 1997, the City Council of the City of 26 Vernon adopted Resolution No. 6961 approving a revised SEMS Multi- 27 Hazard Functional Plan; and 28WHEREAS, California emergency management professionals have I contributed their expertise to the development of the new NIMS; and 2 WHEREAS, it is essential for disaster response and homeland 3 security that federal, state, local, and tribal organizations utilize 4 standardized terminology, standardized organizational structures, 5 interoperable communications, consolidated action plans, unified 6 command structures, uniform personnel qualification standards, uniform 7 standards for planning, training, and exercising, comprehensive 8 resource management, and designated incident facilities during 9 emergencies or disasters; and 10 WHEREAS, the California SEMS substantially meets the 11 objectives of the NIMS; and 12 WHEREAS, the National Commission on Terrorist Attacks (9-11 131 Commission) recommended adoption of a standardized Incident Command 14 System nationwide; and 15 WHEREAS, in Executive Order 5-2-05, the Governor of the 16 State of California directed the State's Office of Emergency Services 17 and Office of Homeland Security, in cooperation with the SEMS Advisory 18 Board, to develop a program to integrate the NIMS, to the extent 19 appropriate, into the State's emergency management system; and 20 WHEREAS, adopting the NIMS standardized procedures for 21 managing personnel, communications, facilities, and resources will 22 improve the City's ability to utilize federal funding to enhance local 23 readiness, maintain first responder safety, and streamline incident 24 management processes; and 25 WHEREAS, failure to adopt the NIMS as the requisite 26 emergency system may preclude reimbursement to the City for costs 27 expended during and after a declared emergency or disaster and for 28 training and preparation for such disasters or emergencies; and - 2 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the Incident Command System components of the NIMS are already an integral part of various incident management activities throughout the City, including current emergency management training programs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City of Vernon will integrate the National Incident Management System, to the extent appropriate, into its emergency management system. SECTION 3: The City of Vernon utilizes the National Incident Management System, which shall be consistent with the integration of the National Incident Management System and the SEMS in California. SECTION 4: The Acting City Clerk is hereby directed to send a copy of this resolution to the California Office of Emergency Services, 3650 Schriever Avenue, Mather, CA 95655. SECTION 5: The Acting City Clerk of the City of Vernon shall certify to the passage of this Resolution, and thereupon and thereafter the same shall be in full force and effect. Adopt the attached Resolution that formally recognizes National Incident Management System (NIMS) and adopts NIMS principles and policies into the County's emergency management system. 2. Direct the Chief Administrative Office, through its Office of Emergency Management, to work with the appropriate County departments to develop a program to integrate the National Incident Management System, to the extent appropriate, into the County's emergency management system, identify statutes or regulations that may need to be repealed or amended to facilitate implementation of the National Incident Management System, and report back to the Board in June 2006 on the status of the integration of the National Incident Management System into -the County's emergency management system. PURPOSE OF RECOMMENDED ACTION The Federal Department of Homeland Security requires the adoption of NIMS to be eligible to receive 2006 Homeland Security Grant Program funds. Adoption of this Resolution will meet that requirement. JUSTIFICATION The Department of Homeland Security has released grant monies to enhance local emergency, prevention and response agencies' ability to prepare for and respond to incidents of terrorism involving weapons of mass destruction. The continued receipt of these funds is essential for the County and its cities to continue terrorism preparedness efforts. "To Enrich Lives Through Effective And Caring Service" Honorable Board of Supervisors October 11, 2005 Page 2 FISCAL IMPACT/FINANCING None FACTS AND PROVISIQNS/LEGAL REQUIREMENTS The Federal Government has identified additional NIMS State and local government compliance requirements in order to be eligible to receive future funds. OEM has developed a NIMS Implementation Plan that identifies the actions necessary to meet present and future requirements. OEM will take the lead in assisting all County departments with meeting NIMS compliance by the deadlines established by the Federal Government. To assist departments, OEM developed guidelines outlining actions which departments must take to become NIMS compliant. I have approved the County NIMS Implementation Plan and instructed all County departments to comply with NIMS requirements. County Counsel has approved the attached Resolution as to form. IMPACT ON CURRENT SERVICES (OR PROJECTS) This Resolution is required to maintain the County's continued participation in the Homeland Security and Emergency Management Performance Grant Programs. CONCLUSION Upon execution by the Board of Supervisors, please send an adopted copy of this action to the Chief Administrative Officer's Office of Emergency Management for processing.
