A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON VACATING A PORTION OF 50TH STREET BETWEEN
SEVILLE AVENUE AND SOTO STREET
WHEREAS, that certain portion of 50th Street between Seville
Avenue and Soto Street located within the City of Vernon is deemed no
longer necessary for present or prospective street purposes; and
WHEREAS, said portion of said street was dedicated for
public use by subdivision map of Tract No. 6452 in the County of Los
Angeles and is depicted on Exhibit A which is attached hereto and
incorporated by reference; and
WHEREAS, the City Council has examined the location,
purpose, and extent of said portion of said street and has reviewed
the conformity of said proposed vacation with the General Plan and the
Zoning Ordinance of the City of Vernon as required by California
Government Code Section 65402; and
WHEREAS vacating said portion of said street will allow the
better and more efficient use of the parcels of land abutting thereon;
and
WHEREAS, said portion of said street does not constitute
major traffic arteries or collector streets, are not useful as non -
motorized transportation facilities, and are unnecessary for present
or prospective public use except that public utility easements need to
be reserved and excepted therein; and
WHEREAS, the vacation of 50th Street will cause the reversion
of the street to the City of Vernon as the owner of the contiguous
lots and successor to the original owners of the parcels; and

WHEREAS, due to the minimal utilization of 50th Street and
the availability of alternative routes, it is not in the public
interest, now or in the future, to continue to maintain 50th Street;
land
WHEREAS, the Acting City Clerk set a public hearing
regarding the proposed vacation of a portion of 50th and gave notice of
the City's intent to adopt a negative declaration for Wednesday,
March 15, 2006, at 5:00 p.m., as continued to March 22, 2006; and
WHEREAS, notice of this hearing was published on
February 15, 2006 and February 22, 2006, and was posted in locations
in the vicinity of the street vacation in accordance with Section 8323
of the Streets and Highways Code of the State of California on
February 16, 2006, as well as on three official bulletin boards of the
City of Vernon on February 13, 2006; and
WHEREAS, this matter was duly presented on the City
Council's agenda for March 22, 2006, at 5:00 p.m., at which time the
public hearing was held; and
WHEREAS, the City of Vernon has provided notice of its
intent to adopt a negative declaration for the street vacation and has
provided a public review period of not less than 20 days, as required
by the California Environmental Quality Act ("CEQA") and the State
CEQA Guidelines; and
WHEREAS, the Community Services and Water Department has
performed an Initial Study to determine the potential adverse impacts
on the environment that may be caused by the proposed street vacation
and determined that the proposed street vacation will not have a
significant effect on the environment and recommended that a Negative
Declaration be adopted in compliance with CEQA; and

WHEREAS, in accordance with Section 711.4(c) of the Fish and
Game Code, no evidence has been found that the proposed street
vacation will have the potential for adverse effects on wild life
resources, and is therefore exempt from the fees otherwise payable
under Section 711.4; and
WHEREAS, the street vacation is consistent with the General
Plan and Zoning Ordinance of the City of Vernon; and
WHEREAS, the City Council has heard and considered all
evidence, both written and oral, presented in consideration of the
proposed vacation of a portion of 50th Street between Seville Avenue
and Soto Street in the City of Vernon.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon finds
that the portion of 50th Street between Seville Avenue and Soto Street
in the City of Vernon is no longer necessary for public road purposes.
SECTION 3: The City Council of the City of Vernon finds
that the vacation of said portion of said street as described is in
the public interest.
SECTION 4: The City Council of the City of Vernon further
finds that all persons have had the opportunity to be heard or to file
written comments to the proposed 50th Street vacation and after due
consideration of all the evidence submitted at the public hearing
determines that there are compelling reasons to justify vacating a
portion of 50th Street between Seville Avenue and Soto Street in the

SECTION 5: The City Council of the City of Vernon further
finds on the basis of the whole record before it (including the
initial study) that there is no substantial evidence that the street
vacation will have a significant effect on the environment
individually or cumulatively, and that the Negative Declaration
reflects the City's independent judgment and analysis, and on the
basis of said findings the City Council hereby approves and adopts the
Negative Declaration for the street vacation.
SECTION 6: Pursuant to Section 711.4(c) of the Fish and
Game Code, the City has found no evidence that the proposed street
vacation will have the potential for adverse effects on wildlife
resources and the street vacation is therefore exempt from the fees
otherwise payable under Section 711.4.
SECTION 7: The City Council hereby approves the Initial
Study and Environmental Checklist Form dated January 19, 2006, a copy
of which documents have been submitted to the City Council
concurrently herewith, and the Acting City Clerk is directed to
receive and file them. Such documents and other materials which
constitute the record of proceedings in this matter shall be
maintained in the office of the Acting City Clerk who is and shall be
the custodian thereof.
SECTION 8: The City Council of the City of Vernon hereby
directs the Acting City Clerk, or his designee, to file a Notice of
Determination and DeMinimis Impact Finding in regard to the
environmental impact of said street vacation.

SECTION 9: The City Council of the City of Vernon hereby
authorizes the Mayor to execute a Grant of Easement granting to
Pacific Bell Telephone Company, dba SBC, California ("SBC"), a public
utility easement over the street vacation in 50th Street between
Seville Avenue and Soto Street to construct, maintain, operate,
replace, remove and renew the existing aerial and underground
communication facilities until said facilities are removed as
requested by the Director of Community Services & Water and approved
by the City Council.
SECTION 10: The City Council of the City of Vernon does
hereby order the vacation of that portion of 50th Street between
Seville Avenue and Soto Street as more particularly described in
Exhibit A attached hereto. The vacation of said portion of 50th Street
between Seville Avenue and Soto Street is pursuant to the provisions
of Division 9 of the Streets and Highways Code of the State of
California (commencing with Section 8300) otherwise known as the
Public Streets, Highways and Service Easements Vacation Law.
SECTION 11: The City Council of the City of Vernon hereby
reserves and excepts an easement for public utilities, installation,
and maintenance purposes over 50th Street between Seville Avenue and
Soto Street for existing SBC facilities.
SECTION 12: The Acting City Clerk of the City of Vernon is
hereby instructed to cause a certified copy of this Resolution of
vacation, attested by the Acting City Clerk under the seal of the City
of Vernon, to be recorded without acknowledgement, certificate of
acknowledgment, or further proof in the office of the County Recorder
of the County of Los Angeles, and said recordation shall be exempt
from recording fees.

SECTION 13: From and after the date on which this Resolution
is recorded with the County Recorder of the County of Los Angeles, the
vacation of a portion of 50th Street between Seville Avenue and Soto
Street, reserving and excepting therefrom a public utilities easement
with SBC, shall be complete and no longer constituted as a street in
the City of Vernon.
SECTION 14: The Acting City Clerk of the City of Vernon
shall certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.

STAFF REPORT
VACATION OF A SECTION OF 5e STREET
JANUARY 2006
The City of Vernon is considering the vacation of a section of Se Street from Seville Avenue
to Soto Street as shown in Exhibit "A". In accordance with Division 9 of the Streets and Highways
Code (commencing with Section 8300) otherwise known as the Public Streets, Highways and Service
Easements Vacation Law, the City of Vernon has the authority to vacate the street.
BACKGROUND
50TH Street was created in 1924 as part of the approval of Tract No. 6452 recorded in map
book 94-77-78, a copy of which is attached as Exhibit "C". J. B. Leonis, Inc., a California
Corporation, granted this street to the City of Vernon in 1924 as a 40 foot right of way. The street
starts at a "T" intersection with Seville on the west and continues east past Soto Street. The street was
paved in 1926 and became part of the City of Vernon system of streets. In 1995, the street was
reconstructed to create an asphalt concrete paved street with a centerline crown. The City of Vernon
acquired Lot 7 of Tract No. 6452 in August 1931 for the purposes of constructing a municipal electric
generating power plant and this lot occupies the complete frontage along the north right of way line
along 50t' Street from Seville Avenue to Soto Street. In 2003, the City of Vernon began construction
of the Malburg Generating Station and 5& Street was closed to through traffic. In 2005, the City
acquired Lot 5 of Tract No. 6452 and this parcel occupies the complete frontage along the south right
of way line along 50t' Street from Seville Avenue to Soto Street. The street is now completely closed
since the street provides access only for the Malburg Generating Station and the plant staff.
UTILITIES
50' Street currently contains the following utilities within the 40 foot right of way: City of
Vernon 10 inch vitrified clay sewer line constructed in 1925, City of Vernon 8 inch cast iron water
line also constructed in1925, City of Vernon 6 inch polyethylene gas line constructed in 2003, City of
Vernon catch basins and laterals to a 33 inch storm drain line near Soto Street, City of Vernon 12 inch
ductile iron recycled water line completed in 2004, City of Vernon electrical lines and underground
cable tunnel, City of Vernon, Light and Power overhead utility lines with street lighting, and SBC
overhead utility lines and SBC underground conduit. The vacation of 50'h Street will cause the
reversion of the street to the City of Vernon as the owner of the contiguous lots and the successor to
the original owners of these parcels. Therefore, the City of Vernon facilities will remain and be
maintained by the City of Vernon departments since the utilities serve the Malburg Generating Station
and the support facilities on the south. SBC utilities are extensive and services could not be provided
from other sources nor could the existing facilities be removed without significant expense. SBC
requested that they be able to maintain their existing facilities. An easement for the SBC facilities will
be reserved over 50' Street until they are removed. The grant of the easement is attached as "Exhibit
B" including a drawing of the easement area
TRAFFIC
50th Street is shown on the City's master plan as a local street that carries east/west traffic with
a west termination at a' T"' intersection at Seville Avenue and with a four approach intersection with
Soto Street on the east. The street has been closed to throuh traffic since 2003 but before that the
traffic counts show that a total of 1505 vehicles utilized 50 Street daily with 514 vehicles eastbound
and 991 vehicles westbound. The AM peak occurred atl 1 AM eastbound with 45 vehicles per hour
and at 5:45 AM westbound with 90 vehicles per hour. The PM peak occurred at 1:15 PM eastbound
with 46 vehicles per hour and at 1:45 PM westbound with 81 vehicles per hour. The intersection of
50th Street and Seville Avenue has been controlled by a stop sign for 50th Street traffic only with free
flow for the north/south movement. Similarly, the intersection of 50" Street and Soto Street has stop
signs in the east/west direction with free flow north/south on Soto Street. The parallel street to the
north is Leonis Blvd. and to the south is Fruitland Avenue, both are major collectors in the City with
signalized intersections where both streets intersect Soto Street. If 50th Street is vacated, there is
sufficient capacity on both Leonis Blvd. and Fruitland Avenue to carry the traffic that will be diverted
to these streets. The level of service at the surrounding intersections is acceptable with minimal
congestion.
PARKING
Prior to the closure of 50th Street, parking was permitted on both sides of the street and the
employees of the former business at 2750 50th Street utilized the street for overflow parking but very
few vehicles were parked at any onetime due to the large on -site parking lot that was available. The
former business (Orval Kent) is now gone and the City of Vernon has purchased and occupied the
property. Since the closure of the street for construction purposes of the Malburg Generating Station,
only vehicles of the contractor of the Malburg Generating Station have used the on street parking.
DISPOSITION OF THE VACATED STREET
If 50th Street is vacated, the original grant deeds specify that the present owners of the
contiguous lots are the successors to the original owner of these parcels. Since the City of Vernon
owns the lots that border the street on the north and on the south, the City of Vernon will own the
property vacated. Moreover, a search of present day records show that the original owners are no
longer viable entities and would not be able to claim any rights. The ownership of the vacated street
by the City of Vernon also maintains the public interest in this property.
RECOMMENDATION
Given the above facts, it is recommended that a section of 50th Street between Seville Avenue
and Soto Street be vacated.

Seville Avenue to Soto Street in accordance with Division 9 of the Streets and
Highways Code of the State of California (commencing with Section 8300) otherwise
known as the Public Streets, Highways and Service Easements Vacation law; and (2)
the adoption of a Negative Declaration in accordance with the California
Environmental Quality Act determining that the proposed street vacation will not have
a significant effect on the environment.
A copy of the proposed street vacation and proposed negative declaration will be available for
public review during normal business hours in the Vernon Community Services & Water Department,
located at 4305 Santa Fe Avenue, Vernon, California, from January 17, 2006 to February 15, 2006.
The public is also invited to submit written comments prior to the hearing. You may submit
written comments on the proposed negative declaration until 5:00 p.m. on February 15, 2006.
Comments received after that date may not receive full consideration.
If you challenge the adoption of the proposed street vacation, and the adoption of the Negative
Declaration you may be limited to raising only those issues you or someone else raised at the hearing

proposed site will not impact any residents. The vacation site is surrounded by compatible uses

Therefore, it is anticipated that the proposed street vacation will not disrupt or divide the
physical arrangement of an established community.

people working in the City. The City of Vernon consists of highly industrialized and developed
areas. It is anticipated that the street vacation will not impact population or housing.

not displace housing.
M. TRANSPORTATION/CIRCULATION.
Would the proposal result in:

a. The vacating portion of said street does not constitute major traffic arteries or collector
streets. SOd' Street is a local street with very light traffic loads and terminates at Seville Avenue
at this time. The neighboring intersections operate at an acceptable level of service. If 50d'
Street is vacated traffic will be diverted to either Leonis Boulevard or Fruitland Avenue. The
street has been temporarily closed during the construction of the Malburg Generating Station.
The additional traffic loads did not and will not adversely affect the level of service at
surrounding intersections. Therefore, the proposed vacation will not increase vehicle trips or
traffic congestion.
b) Hazards to safety from design features (e.g. sharp
curves or dangerous intersections) or incompatible
uses (e.g. farm equipment)? ❑ ❑ 0 X
b. No safety hazard resulting from incompatible uses are expected.

c. The proposed vacation will require that emergency access be maintained. Unimpeded
emergency access will still be provided on Seville Avenue and Soto Street.

d. The vacation of 50d' Street will result in the loss of some on street parking. The zoning

code of the City of Vernon however requires each property to provide sufficient parking for all
officers, employees, vendors, salesman visitors and other persons normally transacting business
at each property. On street parking will be allowed to continue on streets in the vicinity
including portions of Seville Avenue and Fruitland Avenue. The street was temporarily closed
during the construction of the Malburg Generating Station with no adverse effects.

NOTICE OF PUBLIC HEARING REGARDING THE PROPOSED
VACATION OF PORTION OF Se STREET AND NOTICE OF INTENT
TO ADOPT NEGATIVE DECLARATION
The City of Vernon will conduct a Public Hearing, which you may attend.
PLACE: Vernon City Hall City Council Charmers 4305 Santa Fe Avenue Vernon,
CA 90058
DATE & Wednesday, Febrmry 15, 200� at 5:00 p.m (or as soon thereafter as the
TIME: matter can be heard)
PURPOSE: To consider. (1) The City of Vernon intends to vacate a section of NP Street
from Seville Avenue to Soto Street in accordance with Division 9 of the
Streets and Highways Code of the Stab of California (commencing with
Section 8") otihermsL known as the Public Streets, Highways and
Service Easements Vacation law, and (2) the adoption of a Negative
Declaration in accordance with the CaNfomia Environmental Quality Act
determining that the proposed street vacation will not have a significant
effect on the environment.
A copy of the proposed street vacation and proposed negative declaration will be
available for public review during normal business hours in the Vernon Community Services
& Water Departrrrent, located at 4305 Santa Fe Avenue, Vernon, California, from January 17,
2006 b February 15, 2006.
The public is also invited to submit written comments prior to the hearing. You may
smut written comments on the proposed negative declaration until 5:00 p.m on February
15, 2006. Comments received after that date may not receive full gyration.
If You challenge the adoption of the proposed street vacation, and the adoption of the
Negative Declaration you may be timtted to raising only those issues you or someone else
raised at the hearing described in this notice or in written correspondence delivered to the
City of Vemon at, or prior to, the meeting.
The hearing may be continued or a*wmed to a stated time and place without further
notice of a public hearing.

This is with reference to your letter of September 14, 2005; regarding the proposed vacation of
50"' Street between Seville Avenue and Soto Street.
According to SBC's Design Engineer, Ms. Leslie Donaldson, (310) 515-4044, SBC currently
maintains communication facilities within the subject area, and asks that an easement be
obtained over the entire area. Therefore, we do object to this proceeding until a reservation for
our facilities can be included within the Resolution.
Our -suggestion for the appropriate language is:
"An easement for Pacific Bell Telephone Company, doing business
as SBC California to from time to time construct, maintain, operate,
replace, remove, and renew such aerial and underground communication
facilities (including ingress thereto and egress therefrom) consisting
of poles, anchors, guys, cables, wires, crossarms, conduits, manholes,
hndholes, markers, pedestals, terminal equipment cabinets, electrical
conductors and necessary fixtures and appurtenances."
We will require a copy of the recorded Resolution once the vacation is completed in order to
maintain our records.
