February 15, 22, 2006 I uiij Intl!1lil Ims Isle nnl lilt III[ STAFF REPORT VACATION OF A SECTION OF 5e STREET JANUARY 2006 The City of Vernon is considering the vacation of a section of Se Street from Seville Avenue to Soto Street as shown in Exhibit "A". In accordance with Division 9 of the Streets and Highways Code (commencing with Section 8300) otherwise known as the Public Streets, Highways and Service Easements Vacation Law, the City of Vernon has the authority to vacate the street. BACKGROUND 50TH Street was created in 1924 as part of the approval of Tract No. 6452 recorded in map book 94-77-78, a copy of which is attached as Exhibit "C". J. B. Leonis, Inc., a California Corporation, granted this street to the City of Vernon in 1924 as a 40 foot right of way. The street starts at a "T" intersection with Seville on the west and continues east past Soto Street. The street was paved in 1926 and became part of the City of Vernon system of streets. In 1995, the street was reconstructed to create an asphalt concrete paved street with a centerline crown. The City of Vernon acquired Lot 7 of Tract No. 6452 in August 1931 for the purposes of constructing a municipal electric generating power plant and this lot occupies the complete frontage along the north right of way line along 50t' Street from Seville Avenue to Soto Street. In 2003, the City of Vernon began construction of the Malburg Generating Station and 5& Street was closed to through traffic. In 2005, the City acquired Lot 5 of Tract No. 6452 and this parcel occupies the complete frontage along the south right of way line along 50t' Street from Seville Avenue to Soto Street. The street is now completely closed since the street provides access only for the Malburg Generating Station and the plant staff. UTILITIES 50' Street currently contains the following utilities within the 40 foot right of way: City of Vernon 10 inch vitrified clay sewer line constructed in 1925, City of Vernon 8 inch cast iron water line also constructed in1925, City of Vernon 6 inch polyethylene gas line constructed in 2003, City of Vernon catch basins and laterals to a 33 inch storm drain line near Soto Street, City of Vernon 12 inch ductile iron recycled water line completed in 2004, City of Vernon electrical lines and underground cable tunnel, City of Vernon, Light and Power overhead utility lines with street lighting, and SBC overhead utility lines and SBC underground conduit. The vacation of 50'h Street will cause the reversion of the street to the City of Vernon as the owner of the contiguous lots and the successor to the original owners of these parcels. Therefore, the City of Vernon facilities will remain and be maintained by the City of Vernon departments since the utilities serve the Malburg Generating Station and the support facilities on the south. SBC utilities are extensive and services could not be provided from other sources nor could the existing facilities be removed without significant expense. SBC requested that they be able to maintain their existing facilities. An easement for the SBC facilities will be reserved over 50' Street until they are removed. The grant of the easement is attached as "Exhibit B" including a drawing of the easement area TRAFFIC 50th Street is shown on the City's master plan as a local street that carries east/west traffic with a west termination at a' T"' intersection at Seville Avenue and with a four approach intersection with Soto Street on the east. The street has been closed to throuh traffic since 2003 but before that the traffic counts show that a total of 1505 vehicles utilized 50 Street daily with 514 vehicles eastbound and 991 vehicles westbound. The AM peak occurred atl 1 AM eastbound with 45 vehicles per hour and at 5:45 AM westbound with 90 vehicles per hour. The PM peak occurred at 1:15 PM eastbound with 46 vehicles per hour and at 1:45 PM westbound with 81 vehicles per hour. The intersection of 50th Street and Seville Avenue has been controlled by a stop sign for 50th Street traffic only with free flow for the north/south movement. Similarly, the intersection of 50" Street and Soto Street has stop signs in the east/west direction with free flow north/south on Soto Street. The parallel street to the north is Leonis Blvd. and to the south is Fruitland Avenue, both are major collectors in the City with signalized intersections where both streets intersect Soto Street. If 50th Street is vacated, there is sufficient capacity on both Leonis Blvd. and Fruitland Avenue to carry the traffic that will be diverted to these streets. The level of service at the surrounding intersections is acceptable with minimal congestion. PARKING Prior to the closure of 50th Street, parking was permitted on both sides of the street and the employees of the former business at 2750 50th Street utilized the street for overflow parking but very few vehicles were parked at any onetime due to the large on -site parking lot that was available. The former business (Orval Kent) is now gone and the City of Vernon has purchased and occupied the property. Since the closure of the street for construction purposes of the Malburg Generating Station, only vehicles of the contractor of the Malburg Generating Station have used the on street parking. DISPOSITION OF THE VACATED STREET If 50th Street is vacated, the original grant deeds specify that the present owners of the contiguous lots are the successors to the original owner of these parcels. Since the City of Vernon owns the lots that border the street on the north and on the south, the City of Vernon will own the property vacated. Moreover, a search of present day records show that the original owners are no longer viable entities and would not be able to claim any rights. The ownership of the vacated street by the City of Vernon also maintains the public interest in this property. RECOMMENDATION Given the above facts, it is recommended that a section of 50th Street between Seville Avenue and Soto Street be vacated. On the basis of this initial evaluation: I find that the proposed vacation WOULD NOT have a significant effect on the environment, and a NEGATIVE DECLARATION will be prepared. X I find that although the, proposed ordinance could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the proposed ordinance. A NEGATIVE DECLARATION will be prepared. ❑ I find that the proposed ordinance MAY have a significant effect on the environment, and an ENVIRONMENTAL IMPACT REPORT is required. ❑ I find that the proposed ordinance MAY have a significant effects) on the environment, but at least one effect 1) has been adequately analyzed in an earlier document pursuant to applicable legal standards, and 2) has been addressed by mitigation measures based on the earlier analysis as described on attached sheets, if the effect is a "potentially significant impact" or "potentially significant unless mitigated." An ENVIRONMENTAL IMPACT REPORT is required, but it must analyze,AnY the effects that remain to be addressed. ❑ Si a Date Samuel Kevin Wilson City of Vernon Printed Name For -2. ENVIRONMENTAL CHECKLIST FORM Potentially Potentially Significant Less Than Significant Unless Significant No Impact Mitigated Impact Impact I. LAND USE AND PLANNING. Would the proposal: a) Conflict with general plan designation or zoning? ❑ ❑ ❑ X b) Conflict with applicable environmental plans or policies adopted by agencies with jurisdiction over the project? 0 ❑ ❑ X a and b. The proposed vacation area is zoned M-Zone, General Industrial. The City of Vernon is primarily made up of industrial and distribution type facilities. The proposed vacation conforms with the zoning ordinance as well as with the General Plan, local codes as they now exist. Therefore, it will not conflict with any environmental plans or policies. c) Affect agricultural resources or operations (e.g. impacts to soils or farmlands, or impacts from incompatible land uses)? ❑ 0 0 X c. The City of Vernon is an industrial city with no agricultural land use within its boundaries. Therefore, the proposed vacation, will not affect agricultural resources or operations. d) Disrupt or divide the physical arrangement of an established community (including a low income or minority community)? ❑ ❑ ❑ X d. The project ,has no residential units on it that will be affected by the proposed use. The proposed site will not impact any residents. The vacation site is surrounded by compatible uses and will not disrupt or divide the physical arrangement of any established communities. Adequate roadways will be maintained to ensure appropriate access to all businesses. Therefore, it is anticipated that the proposed street vacation will not disrupt or divide the physical arrangement of an established community. I. POPULATION AND HOUSING. Would the proposal: a) Cumulatively exceed official regional or local .3. population projections? ❑ ❑ ❑ X b) Induce substantial growth in an area either directly or indirectly (e.g. through projects in an undeveloped area or extension of major infrastructure)? ❑ ❑ ❑ X it and b. The population of the City of Vernon is approximately 95, with up to 60,000 people working in the City. The City of Vernon consists of highly industrialized and developed areas. It is anticipated that the street vacation will not impact population or housing. c) Displace existing housing, especially affordable housing? 0 ❑ ❑ X c. The proposed vacation will not create any new housing. Thus, the proposed vacation will not displace housing. M. TRANSPORTATION/CIRCULATION. Would the proposal result in: a) Increased vehicle trips or traffic congestion? ❑ ❑ ❑ X a. The vacating portion of said street does not constitute major traffic arteries or collector streets. SOd' Street is a local street with very light traffic loads and terminates at Seville Avenue at this time. The neighboring intersections operate at an acceptable level of service. If 50d' Street is vacated traffic will be diverted to either Leonis Boulevard or Fruitland Avenue. The street has been temporarily closed during the construction of the Malburg Generating Station. The additional traffic loads did not and will not adversely affect the level of service at surrounding intersections. Therefore, the proposed vacation will not increase vehicle trips or traffic congestion. b) Hazards to safety from design features (e.g. sharp curves or dangerous intersections) or incompatible uses (e.g. farm equipment)? ❑ ❑ 0 X b. No safety hazard resulting from incompatible uses are expected. c) Inadequate emergency access or access to nearby uses? p ❑ ❑ X c. The proposed vacation will require that emergency access be maintained. Unimpeded emergency access will still be provided on Seville Avenue and Soto Street. d) Results in inadequate parking capacity? ❑ 0 ❑ X d. The vacation of 50d' Street will result in the loss of some on street parking. The zoning 511 code of the City of Vernon however requires each property to provide sufficient parking for all officers, employees, vendors, salesman visitors and other persons normally transacting business at each property. On street parking will be allowed to continue on streets in the vicinity including portions of Seville Avenue and Fruitland Avenue. The street was temporarily closed during the construction of the Malburg Generating Station with no adverse effects. e) Hazards or barriers for pedestrians or bicyclists? 0 ❑ ❑ X f) Conflicts with adopted policies supporting alternative transportation (e.g. bus turnouts, bicycle racks)? ❑ ❑ ❑ X g) Rail, waterborne or air traffic impacts? 0 0 0 X e through g. The proposed vacation will not have bicyclists or public pedestrians. Alternative routes are available. The vacation will not conflict with any City or State polices and will not impact air or waterborne traffic. IV. NOISE. Would the proposal result in: a) Increases in existing noise levels? 0 ❑ ❑ X b) Exposure of people to severe noise levels? ❑ ❑ ❑ X a and b. 500' Street is within an industrial area where the surrounding manufacturing and warehousing uses are not noise sensitive. The street vacation will not result in any noise impacts. V. PUBLIC SERVICES. Would the proposal have an effect upon, or result in a need for new or altered government services in any of the following areas: a) Fire protection? ❑ 0 ❑ X b) Police protection? 0 0 0 X c) Schools? ❑ ❑ ❑ X a through c. The vacation is located in a highly industrialized and developed area. The proposed street vacation will not pose a need for new or altered fire, police or school services within the City of Vernon. Seville Avenue provides direct access for services on the west and Soto Street provides direct access for services on the east. The vacation of 50d' Street will not result in an increase in response time for Police or Fire, since emergency vehicles have not used 50t` Street as an emergency route. -5- VI. AESTHETICS, Would the proposal: a) Affect a scenic vista or scenic highway? ❑ ❑ ❑ X b) Have a demonstrable negative aesthetic effect? ❑ 0 ❑ X a and b. The proposed vacation will have no impacts on the aesthetics of the City. VH. GEOPHYSICAL. Would the proposal result in or expose people to potential impacts involving: a) Seismicity: fault rupture? 0 ❑ ❑ X b) Seismicity: ground shaking or liquefaction? ❑ ❑ ❑ X c) Seismicity: seiche or tsunami? ❑ ❑ ❑ X d). Landslides or mudslides? ❑ ❑ ❑ X e) Erosion, changes in topography. or unstable soil conditions from excavation, grading or fill? ❑ ❑ ❑ X f) Subsidence of the land? ❑ ❑ 0 X g) Expansive soils? ❑ ❑ ❑ X h) Unique geologic or physical features? ❑ ❑ ❑ X a. through h. The topography of the City of Vernon is relatively level. Although there are no known earthquake faults in the City, Vernon is in a seismically active region and several faults in the area are likely to cause moderate ground shaking in Vernon. To ensure life safety, all new construction is required to be in compliance with (Zone 4) seismicity requirements of the Uniform Building Code. There will not be any significant changes to the geologic substructure or topography. VIH. WATER. Would the proposal result in: a) Changes in absorption rates, drainage patterns, or the rate and amount of surface runoff. ❑ ❑ ❑ X b) Exposure of people or property to water related hazards such as flooding? 0 0 0 X c) Discharge into surface waters or other alteration of surface water quality (e.g. temperature, dissolved oxygen or turbidity)? ❑ ❑ ❑ X d) Changes in the amount of surface water in any water body? 0. 0 0 X e) Changes in currents, or the course or direction of water movements? ❑ ❑ ❑ X -6. f) Change in the quantity of ground waters, either • through direct additions or withdrawals, or through interception of an aquifer by cuts or excavations? 0 0 ❑ X g) Altered direction or rate of flow of groundwater? 0 0 ❑ X h) Impacts to groundwater quality? ❑ 0 ❑ X a through h. The proposed vacation will have no impact on the hydrology, water quality or water consumed in the City. IX. AIR QUALITY: Would the proposal: a) Violate any air quality standard or contribute to an existing or projected air quality violation? ❑ ❑ ❑ X b) Expose sensitive receptors to pollutants? 0 ❑ ❑ X c) Alter air movement, moisture, or temperature, or cause any change in climate? ❑ ❑ ❑ X d) Create objectionable odors? ❑ ❑ ❑ X a through d. The proposed vacation will have no impact on air quality. The City of Vernon is located within the South Coast Air Basin of California. The basin covers a 6,600- square mile area within Orange County, non -desert portions of Los Angeles County, Riverside County, and San Bernardino County. Air quality in the basin is monitored by the South Coast Air Quality Management District ("AQMI)') at 35 monitoring stations throughout the area. The monitoring station nearest to the City of Vernon is the Pico Rivera station. Readings at the station are used to characterize air quality in the City of Vernon. X. BIOLOGICAL RESOURCES: Would the proposal result in impacts to: a) Endangered, threatened or rare species or their habitats (including but not limited to plants, fish, insects, animals, and bids)? ❑ ❑ ❑ X b) Locally designated species (e.g. heritage trees)? ❑ 0 ❑ X c) Locally designated natural communities (e.g. oak forest, (e.g. oak forest, coastal habitat, etc.)? 0 0 0 X d) Wetland habitat (e.g. marsh, riparian and vernal pool)? ❑ ❑ ❑ X -7- e) Wildlife dispersal or migration corridors? ❑ ❑ ❑ X a through e. Vernon is in a highly developed industrial area. The proposed vacation will not affect such resources. XI. ENERGY AND MINERAL RESOURCES: Would the proposal: a) Conflict with adopted energy conservation plans?❑ ❑ ❑ X a. The proposed vacation will have no impact on energy conservation plans. b) Use non-renewable resources in a wasteful and inefficient manner? ❑ ❑ 0 X b. The proposed vacation will have no impact on energy consumed or mineral resources. MI. HAZARDS. Would the proposal involve: a) A risk of accidental explosion or release of hazardous substances (including, but not limited to oil, Pesticides, chemicals or radiation)? ❑ ❑ ❑ X b) Possible interference with an emergency response plan or emergency evacuation plan? ❑ ❑ ❑ X c) The creation of any health hazard or potential health hazard? ❑ 0 0 X d) Exposure of people to existing sources of potential health hazards? ❑ ❑ ❑ X e) Increased fire hazard in areas with flammable brush, grass, or tees? 0 0 ❑ X a through e. The proposed vacation will not result in any additional hazards. The local Certified Unified Program, Agency (CUPA) regulates use and storage of hazardous materials at any facility within the City of Vernon, which is the City of Vernon Environmental Health Department. All facilities within the City are regularly inspected by the Vernon Fire and Environmental Health Departments for code violations. The inspections are made to reduce the potential for urban fires and chemical releases. The Vernon Fire Department has a fully. manned hazardous materials unit. All personnel are trained in hazardous material response. The proposed vacation will not impact existing regulations and permitting requirements. Therefore, this impact will be less than significant. XIII. UTILITIES AND SERVICE SYSTEMS. Would the -s- proposal result in a need for new systems, or substantial alterations to the following utilities: a) Power or natural gas b) Communications systems? c) Local or regional water treatment or distribution facilities? d) Sewer or septic tanks? e) Sterm water drainage? fl Solid waste disposal? 0 ❑ ❑ X 0 0 ❑ X 0 0 ❑ X 0 ❑ 0 X 0 0 ❑ X 0 ❑ ❑ X a through L The proposed vacation is located in an area that is fully urbanized and served by an existing extensive electrical and gas infrastructure. The vacation will not result in the need for new power lines or natural gas systems. Existing utilities within the 50& Street right- of-way will be maintained in place or relocated. An easement will be maintained for all utilities to remain. XIV. RECREATION. Would the proposal. - a) Increase the demand for neighborhood or regional parks or other recreational facilities? ❑ ❑ ❑ X b) Affect existing recreational opportunities? ❑ ❑ ❑ X a and b. The proposed vacation will not result in an increase in residential population in Vernon. No impact on the demand for recreation opportunities is anticipated. XV. CULTURAL RESOURCES. Would the proposal: a) Disturb paleontological resources? ❑ b) Disturb archaeological resources? ❑ c) Affect historical resources? ❑ d) Have the potential to cause a physical, change which would affect unique ethnic cultural values? 0 e) Restrict existing religious or sacred uses within the potential impact area? . ❑ ❑ ❑ X ❑ ❑ X ❑ ❑ X ❑ 0 X 0 ❑ X a through e. Vernon is highly industrialized; no known unique historic, archeological, paleontological ethnic cultural resources, or religious or sacred uses exist in the vacation area. Therefore, no impact is expected. XVL MANDATORY FINDINGS OF SIGNIFICANCE. -9- a) Does the project have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods of California history or prehistory? ❑ ❑ 0 X a. The City of Vernon is primarily made up of industrial and distribution type facilities with limited plant life. Plant life is limited to non-native and ornamental species, which are used for landscaping. Animal life in Vernon and nearby urban communities consists of bird, reptile and mammal species that live in close proximity to man. There are no endangered species in Vernon. There is no evidence or important examples of major periods of California history in Vernon. Therefore, the proposed vacation will create no impact. b) Does the project have the potential to achieve short-term, to the disadvantage of long-term, environmental goals? ❑ ❑ ❑ X b. There will not be an impact on long-term environmental goals. c) Does the project have impacts that are individually limited, but cumulatively considerable? ("Cumulatively considerable" means that the incremental effects of a project are considerable when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects) ❑ ❑ ❑ X c. The proposed vacation will not cause a cumulative impact to air quality, traffic, noise, groundwater, surface water, or exposure to hazardous materials, and will not create any impact to sensitive receptors. Therefore, the cumulative impact will be less than significant. d) Does the project have environmental effects which will cause substantial adverse effects on human beings, either directly or indirectly? ❑ ❑ ❑ X d. The proposed vacation will allow the better and more efficient use of the parcels of land abutting the existing street. There are no environmental impacts caused by the vacation that will cause adverse effects on human beings. Therefore it is anticipated that the proposed vacation will not have a cumulative adverse impact on the environment of the community. Chester Avenue Room 202 <u Pasadena, CA 91106-3104 626.396.7045 Fax ° af- This is with reference to your letter of September 14, 2005; regarding the proposed vacation of 50"' Street between Seville Avenue and Soto Street. According to SBC's Design Engineer, Ms. Leslie Donaldson, (310) 515-4044, SBC currently maintains communication facilities within the subject area, and asks that an easement be obtained over the entire area. Therefore, we do object to this proceeding until a reservation for our facilities can be included within the Resolution. Our -suggestion for the appropriate language is: "An easement for Pacific Bell Telephone Company, doing business as SBC California to from time to time construct, maintain, operate, replace, remove, and renew such aerial and underground communication facilities (including ingress thereto and egress therefrom) consisting of poles, anchors, guys, cables, wires, crossarms, conduits, manholes, hndholes, markers, pedestals, terminal equipment cabinets, electrical conductors and necessary fixtures and appurtenances." We will require a copy of the recorded Resolution once the vacation is completed in order to maintain our records. Thank you for notifying SBC California.
