RESOLUTION NO. 9004
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING RESOLUTION NOS. 8841 AND 8940 WHICH
DESIGNATED EMPLOYEES AUTHORIZED TO PURCHASE AND
SELL ELECTRIC ENERGY, NATURAL GAS AND FINANCIAL
HEDGES AND ENTER'INTO CONTRACTS FOR SAID SERVICES
WHEREAS, on September 7, 2005, the City Council of the City
of Vernon adopted Resolution No. 8841 authorizing certain employees of
the City to purchase and sell electric energy and natural gas and
enter into agreements for said service, subject to ratification of the
City Council; and
WHEREAS, on December 21, 2005, the City Council of the City
of Vernon adopted Resolution No. 8940 clarifying and defining the
roles, responsibilities and authority of employees and officials
charged with the trading of natural gas and/or electric power; and
WHEREAS, on April 5, 2006, the City Council of the City of
Vernon adopted Resolution No. 9003 creating the position of Capital
Project Administrator in the Light & Power Department and appointing
the Assistant City Attorney to serve in said position; and
WHEREAS, the City Council desires to amend Resolution Nos.
8841 and 8940 to change the designated employees charged with entering
into agreements for the purchase and sale of gas and electricity and
the trading of natural gas and/or electric power.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.

read as follows:

SECTION 3: The City Council of the City of

Vernon hereby authorizes the Capital Project
5
Administrator, or his designee, to enter into
6
purchase and/or sale contracts with various
7
vendors for periods of one day to fifteen
8
years, subject to ratification by the City
9
Council.

SECTION 4: The Capital Project Administrator,
11
or his designee, may enter into purchase and/or
12
sale contracts with various vendors for up to
13
one (1) year.

SECTION 3: the City Council of the City of Vernon hereby
15
amends Section 2 of Resolution No. 8940, to read as follows:
16
SECTION 2: The City Council of the City of
17
Vernon hereby authorizes the Capital Project
18
Administrator, or his designee, to purchase,
19
sell and trade electric energy, natural gas and
20
financial hedges and enter into agreements for
21
said services, subject to ratification of the
22
City Council.

SECTION 4: All resolutions or parts of resolutions not
24
consistent
with or in conflict with this Resolution, specifically
25
Resolution
Nos. 8841 and 8940, are hereby repealed.

SECTION 5: The Acting City Clerk of the City of Vernon
shall certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
