Resolution No. 90271 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9027 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A GRANT APPLICATION UNDER THE CALIFORNIA BEVERAGE CONTAINER RECYCLING AND LITTER REDUCTION ACT TO THE DEPARTMENT OF CONSERVATION'S DIVISION OF RECYCLING WHEREAS, the State of California has enacted the California Beverage Container Recycling and Litter Reduction Act that provides funds to the cities and counties for beverage container recycling and litter cleanup activities; and WHEREAS, the California Department of Conservation's Division of Recycling has been delegated the responsibility for the administration of the program within the State and setting up necessary procedures for cities and counties or their designees under the program; and WHEREAS, the City of Vernon has applied for grant funds under the program since May of 2000; and WHEREAS, the California Department of Conservation has announced that the City of Vernon is eligible for Five Thousand Dollars and No Cents ($5,000.00) in grant funds over fiscal year 2006- 2007; and .WHEREAS, pursuant to Section 14581(a)(4)(E) of the California Beverage Container Recycling and Litter Reduction Act, the eligible participant must submit a Funding Request Form by a certain Jue date in order to request funds from the Department of :onservation's Division of Recycling; and WHEREAS, by memo dated April 20, 2006, the Director of ]nvironmental Health recommended that the application for the Beverage 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Container Recycling and Litter Reduction grant funds be approved and executed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby approves and authorizes the electronic submittal of the "City/County Funding Request Form (FRF) FY 2006/2007" ("Form"), in substantially the same form as the copy which is attached hereto as Exhibit A and incorporated by reference, to the Department of Conservation's Division of Recycling for all available grant funds under the California Beverage Container Recycling and Litter Reduction Act for the period governing the grant program. SECTION 3: The City Council of the City of Vernon hereby authorizes the Director of Environmental Health to electronically execute said Form for, and on behalf of, the City of Vernon. SECTION 4: The Director of Environmental Health is hereby authorized and empowered to execute all forms necessary to secure, implement and carry out the purposes specified in Section 14581(a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act and to provide information regarding this program to the Department of Conservation's Division of Recycling, upon request. SECTION 5: The City Council of the City of Vernon hereby iirects the Acting City Clerk, or his designee, to submit a fully executed Form prior to June 30, 2006 to the California Department of - 2 - Conservation, Division of Recycling. SECTION 6: The Acting City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect.
