RESOLUTION NO. 9060
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AUTHORIZING THE CITY'S PARTICIPATION IN THE
COUNTY OF LOS ANGELES' REPORT OF WASTE DISCHARGE
APPLICATION SUBJECT TO THE FILING OF A LETTER OF
EXCEPTIONS BY THE CITY OF VERNON REGARDING THE
NPDES PERMIT AND AUTHORIZING THE CITY TO DO ALL
OTHER ACTIONS DEEMED NECESSARY OR ADVISABLE
CONCERNING THE ADMINISTRATIVE REVIEW PROCESS
WHEREAS, on December 13, 2001, the California Regional Water
Quality Control Board, Los Angeles Region ("Regional Board") adopted
Order No. 01-182, a National Pollutant Discharge Elimination System
("NPDES") Permit for Municipal Storm Water and Urban Runoff Discharges
within the County of Los Angeles and the incorporated cities therein,
except the City of Long Beach (hereinafter "NPDES Permit"); and
WHEREAS, the NPDES permit that was issued on December 13,
2001 will expire in December 2006 and the City of Vernon, together
with 83 other cities and the County of Los Angeles, must submit a
Report of Waste Discharge ("ROWD") to the Regional Board by June 12,
2006, that summarizes the events of the expiring permit and serves as
the basis for the new permit; and
WHEREAS, the attorneys for the Coalition for Practical
Regulation ("CPR") have reviewed the draft ROWD issued April 24, 2006
by the County of Los Angeles and a select committee of city
representatives and recommended extensive changes in order to protect
the position the cities have taken in various litigation on the
existing NPDES permit and other issues; and
WHEREAS, the County of Los Angeles has requested that each
city indicate their approval to be a part of the joint ROWD

application by June 8, 2006; and
WHEREAS, the Director of Community Services & Water by memo
dated May 25, 2006, has recommended that the City join in the County's
ROWD application, subject to the filing of a letter of exceptions to
portions of the ROWD that are unacceptable, in order preserve and
protect its rights in on -going legal actions and appeals and in
challenges to the 2006 NPDES Permit; and
WHEREAS, the City Council of the City of Vernon desires to
approve the City's participation with the County of Los Angeles in
filing an ROWD, under protest, and authorize the filing of an
exception letter by the Director of Community Services & Water
expressing the City's objections and concerns with certain portions of
Ithe ROWD.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves and authorizes participating with the County of Los Angeles
in the filing of a Report of Waste Discharge with the Regional Board,
subject to a letter of exceptions, and hereby instructs the Director
of Community Services & Water to write a letter to the County of Los
Angeles expressing the City's objections and exceptions regarding
certain unacceptable portions of the ROWD, subject to final approval
by the City Attorney.

SECTION 3: The City Council of the City of Vernon hereby
authorizes the Acting City Clerk, or his designee, to execute any
documents or take any action deemed necessary to implement and carry
out the purposes of this resolution.
SECTION 4: The Acting City Clerk of the City of Vernon
shall certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
