RESOLUTION NO. 9061
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AUTHORIZING THE FILING OF SMALL CLAIMS
ACTIONS ON BEHALF OF THE CITY BY THE ACTING RISK
MANAGER
WHEREAS, the small claims divisions within each superior
court provide a forum to resolve minor civil disputes wherein the
recovery of money does not exceed $5,000.00 and grant equitable relief
in the form of rescission, restitution, reformation, and specific
performance in lieu of, or in addition to, money damages; and
WHEREAS, the City of Vernon is self -insured in its general
and automobile liability program; and
WHEREAS, in order to expedite the recovery of money owed to
the City, the Acting Risk Manager has requested authorization to file
small claims actions on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves and authorizes the filing of small claims actions by the
Acting Risk Manager on behalf of the City and authorizes the payment
of filing fees and other court costs necessary in the prosecution of
the small claims action.
SECTION 3: The City Council of the City of Vernon hereby
28 Ilauthorizes the Acting Risk Manager to execute any documents necessary

to process small claims actions for, and on behalf of, the City of
Vernon.
SECTION 4: The City Council of the City of Vernon hereby
authorizes the Acting Risk Manager to represent the City in all small
claims actions with authority to settle all matters within the scope
of said representation.
SECTION 5: The Acting City Clerk of the City of Vernon
shall certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
