Resolution No. 90771 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9077 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON VACATING A PORTION OF ATLANTIC BOULEVARD, APPROXIMATELY 600 FEET NORTHEAST OF BANDINI BOULEVARD WHEREAS, that certain portion of Atlantic Boulevard, approximately 600 feet northeast of Bandini Boulevard located within the City of Vernon is deemed no longer necessary for present or prospective street purposes; and WHEREAS, said portion of said street was a right-of-way established by three official records: O.R. 864/317-320 recorded in 1922, O.R. 3927/83 recorded in 1925 and O.R. 13900/29 recorded in 1935 in the County of Los Angeles, was annexed by the City of Vernon in 1999 and is shown on Parcel Map attached as Exhibit A and incorporated by reference; and WHEREAS, the City Council has examined the location, purpose, and extent of said portion of said street and has reviewed the conformity of said proposed vacation with the General Plan and the Zoning Ordinance of the City of Vernon as required by California Government Code Section 65402; and WHEREAS vacating said portion of said street will allow the better and more efficient use of the parcels of land abutting thereon; and WHEREAS, said portion of said street does not constitute major traffic arteries or collector streets, are not useful as non - motorized transportation facilities, and are unnecessary for present or prospective public use except that public utility easements need to be reserved and excepted therein; and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the vacation of a portion of Atlantic Boulevard, approximately 600 feet northeast of Bandini Boulevard will cause the, reversion of the street to the City of Vernon as the owner of the contiguous lots and successor to the original owners of the parcels; Iand WHEREAS, due to the minimal utilization of the portion of Atlantic Boulevard approximately 600 feet northeast of Bandini Boulevard as an access road to existing utilities and the availability of alternative routes, it is not in the public interest, now or in the future, to continue to maintain the portion of Atlantic Boulevard; and WHEREAS, on March 1, 2006, the City Council of the City of Vernon approved Tentative Parcel Map No. 063140 which, among other things, created one parcel and proposed vacating a portion of "old" Atlantic Boulevard that was no longer in use; and WHEREAS, the Acting City Clerk set a public hearing regarding the proposed vacation of a portion of Atlantic Boulevard and gave notice of the City's intent to adopt a negative declaration for Wednesday, June 21, 2006, at 5:00 p.m.; and WHEREAS, notice of this hearing was published on May 25, 2006 and June 1, 2006, and was posted in locations in the vicinity of the street vacation in accordance with Section 8323 of the Streets and Highways Code of the State of California on May 23, 2006, as well as on three official bulletin boards of the City of Vernon on May 23, 2006; and WHEREAS, this matter was duly presented on the City Council's agenda for June 21, 2006, at 5:00 p.m., at which time the public hearing was held; and - 2 - 1 2 3 4 5 6 7 8 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the City of Vernon has provided notice of its intent to adopt a negative declaration for the street vacation and has provided a public review period of not less than 20 days, as required by the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines; and WHEREAS, the Community Services and Water Department has performed an Initial Study to determine the potential adverse impacts on the environment that may be caused by the proposed street vacation and determined that the proposed street vacation will not have a (significant effect on the environment and recommended that a Negative Declaration be adopted in compliance with CEQA; and WHEREAS, in accordance with Section 711.4(c) of the Fish and Game Code, no evidence has been found that the proposedstreet vacation will have the potential for adverse effects on wild life resources, and is therefore exempt from the fees otherwise payable under Section 711.4; and WHEREAS, the street vacation is consistent with the General Plan and Zoning Ordinance of the City of Vernon; and WHEREAS, the City Council has heard and considered all evidence, both written and oral, presented in consideration of the proposed vacation of a portion of Atlantic Boulevard, approximately 600 feet northeast of Bandini Boulevard in the City of Vernon. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. - 3 - 2 3 4 5 611 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 2: The City Council of the City of Vernon finds that the portion of Atlantic Boulevard, approximately 600 feet northeast of Bandini Boulevard in the City of Vernon is no longer necessary for public road purposes. SECTION 3: The City Council of the City of Vernon finds that the vacation of said portion of said street as described is in the public interest. SECTION 4: The City Council of the City of Vernon further finds that all persons have had the opportunity to be heard or to file written comments to the proposed Atlantic Boulevard vacation and after due consideration of all the evidence submitted at the public hearing determines that there are compelling reasons to justify vacating a portion of Atlantic Boulevard, approximately 600 feet northeast of Bandini Boulevard in the City of Vernon. SECTION 5: The City Council of the City of Vernon further finds on the basis of the whole record before it (including the initial study) that there is no substantial evidence that the street vacation will have a significant effect on the environment individually or cumulatively, and that the Negative Declaration reflects the City's independent judgment and analysis, and on the basis of said findings the City Council hereby approves and adopts the Negative Declaration for the street vacation. SECTION 6: Pursuant to Section 711.4(c) of the Fish and Game Code, the City has found no evidence that the proposed street vacation will have the potential for adverse effects on wildlife resources and the street vacation is therefore exempt from the fees otherwise payable under Section 711.4. - 4 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 7: The City Council hereby approves the Initial Study and Environmental Checklist Form dated May 22, 2006, a copy of which documents have been submitted to the City Council concurrently herewith, and the Acting City Clerk is directed to receive and file them. Such documents and other materials which constitute the record of proceedings in this matter shall be maintained in the office of the Acting City Clerk who is and shall be the custodian thereof. SECTION 8: The City Council of the City of Vernon hereby directs the Acting City Clerk, or his designee, to file a Notice of Determination and DeMinimis Impact Finding in regard to the environmental impact of said street vacation. SECTION 9: The City Council of the City of Vernon hereby authorizes the Mayor to execute a Grant of Easement granting to California Water Service (one 12-inch water line), Southern California Gas (one 8-inch gas line) and Southern California Edison (one down guy anchor), public utility easements over the street vacation in Atlantic Boulevard, approximately 600 feet northeast of Bandini Boulevard. SECTION 10: The City Council of the City of Vernon does hereby order the vacation of that portion of Atlantic Boulevard, approximately 600 feet northeast of Bandini Boulevard as more particularly shown on Parcel Map attached as Exhibit A. The vacation of said portion of Atlantic Boulevard, approximately 600 feet northeast of Bandini Boulevard ,is pursuant to the provisions of Division 9 of the Streets and Highways Code of the State of California (commencing with Section 8300) otherwise known as the Public Streets, Highways and Service Easements Vacation Law. SECTION 11: The City Council of the City of Vernon hereby ireserves and excepts an easement for public utilities, installation, - 5 - 1 2 3 4 5 6 7 8 9 10 11 12 13' 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 and maintenance purposes over Atlantic Boulevard, approximately 600 feet northeast of Bandini Boulevard, for existing California Water IlService, Southern California Gas and Southern California Edison 11facilities. SECTION 12: The Acting City Clerk of the City of Vernon is hereby instructed to cause a certified copy of this Resolution of vacation, attested by the Acting City Clerk under the seal of the City of Vernon, to be recorded without acknowledgement, certificate of acknowledgment, or further proof in the office of the County Recorder Ilof the County of Los Angeles, and said recordation shall be exempt from recording fees. SECTION 13: From and after the date on which this Resolution is recorded with the County Recorder of the County of Los Angeles, the vacation of a portion of Atlantic Boulevard, approximately 600 feet northeast of Bandini Boulevard, reserving and excepting therefrom a public utilities easement with California Water Service, Southern California Gas and Southern California Edison, shall be complete and no longer constituted as a street in the City of Vernon. SECTION 14: The Acting City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. JUNE 2006 The City of Vernon is considering the vacation of a portion of Atlantic Blvd., approximately 600 feet northeast of Bandinin Blvd. by Parcel Map 063140, as shown in Exhibit "A". In accordance with Division 9 of the Streets and Highways Code (commencing with Section 8300) otherwise known as the Public Streets, Highways and Service Easements Vacation Law, the City of Vernon has the authority to vacate a portion of the street. BACKGROUND The portion of Atlantic Blvd. that is proposed to be vacated was created in 1922 as Pasadena Avenue by a grant of to the County of Los Angeles by the Arcadia Bandini de Baker Estate Company for public road and highway purposes. In 1935, Atlantic Blvd. was realigned and the BNSF Railroad bridge over Atlantic Blvd. was constructed in 1936. The bridge forced Atlantic Blvd. below the existing grade with slopes on each side to the original grade. The proposed portion to be vacated was left at the original grade on the east and provided access for service vehicles to facilities owned by City of Bell and various utilities. The City of Vernon annexed this area in 1999 and at that time the proposed portion to be vacated was fenced with an opening for these same service vehicles and the City of Vernon service vehicles to access their respective facilities. The proposed portion of Atlantic Blvd. to be vacated has been used as an access road only with no public travel. UTILITIES The portion of Atlantic Blvd. that is proposed to be vacated has the following utilities located within its boundaries: California Water Service, one 12 inch water line, Southern California Gas, one 8 inch gas line; a Southern California Edison, one down guy anchor. The grant of easements for all three utility lines will be recorded upon the recordation of the final parcel map. Atlantic Blvd. is shown on the City's master plan as an arterial that carries north/south traffic through the eastern portion of the City of Vernon. However, the portion of Atlantic Blvd. that is proposed to be vacated has been used only as an access road for the City of Vernon and various utilities to service the facilities owned by the City and utilities and not used as a public street. The portion of Atlantic Blvd. that is proposed to be vacated will require the service vehicles of the utilities to use the new 26a' Extension from Bandini Blvd. that will be completed in the near future. In fact, the 26t' Street Extension will relieve some of the traffic congestion along Atlantic Blvd. and Bandini Blvd. Therefore, the portion of Atlantic Blvd. that is proposed to be vacated is unnecessary for present or prospective public use. The service vehicles access is sporadic and their use of Atlantic Blvd. and Bandinin Blvd. will not increase the traffic congestion at the intersection of Atlantic Blvd. and Bandini Blvd. The closure of this portion of Atlantic Blvd. will not eliminate any parking since the roadway was used as only an access road and no parking was permitted. DISPOSITION OF THE VACATED STREET If this portion of Atlantic Blvd. is vacated, the vacation removes the easement for road and highway purposes since the original easement deeds specify that the easements were only for public road and highway purposes. The vacated parcel created would be owned by the successor owner of the underlying fee. The City of Vernon owns the acreage that borders the portion of Atlantic Blvd that is proposed to be vacated, therefore, the City of Vernon will become the owner of the vacated portion of Atlantic Blvd. Moreover, the City of Vernon will own the parcel that will be created by Parcel Map 63140 which includes the vacated portion of Atlantic Blvd. RECOMMENDATION Given the above facts, it is recommended that a portion of Atlantic Blvd., approximately 600 feet northeast of Bandini Blvd. be vacated. If this portion of street is vacated, the service vehicles will access the respective facilities from the new 26t' Street roadway extension that will be completed in the very near future. Easements will be reserved for the existing utility lines. The service vehicles will not adversely affect the level of service at surrounding intersections since their trips are infrequent. Therefore, the proposed vacation will not increase vehicle trips or traffic congestion. b) Hazards to safety from design features (e.g. sharp curves or dangerous intersections) or incompatible uses (e.g. farm equipment)? ❑ 0 ❑ X b. The basin covers a 6,600- square mile area within Orange County, non -desert portions of Los Angeles County, Riverside County, and San Bernardino County. Air quality in the basin is monitored by the South Coast Air Quality Management District ("AQMD") at 35 monitoring stations throughout the area. The monitoring station nearest to the City of Vernon is the Pico Rivera station. Readings at the station are used to characterize air quality in the City of Vernon. X. The local Certified Unified Program Agency (CUPA) regulates use and storage of hazardous materials at any facility within the City of Vernon, which is the City of Vernon Environmental Health Department. All facilities within the City are regularly inspected by the Vernon Fire and Environmental Health Departments for code violations. The inspections are made to reduce the potential for urban fires and chemical releases. The Vernon Fire Department has a fully manned hazardous materials unit. All personnel are trained in hazardous material response. The proposed street vacation will not impact existing regulations and permitting requirements. Therefore, this impact will be less than significant. XIII. UTILITIES AND SERVICE SYSTEMS. Plant life is limited to non-native and ornamental species, which are used for landscaping. Animal life in Vernon and nearby urban communities consists of bird, reptile and mammal species that live in close proximity to man. There are no endangered species in Vernon. There is no evidence or important examples of major periods of California history in Vernon. Therefore, the proposed street vacation will create no impact. b) Does the project have the potential to achieve short-term, to the disadvantage of long-term, environmental goals? ❑ ❑ ❑ X b. There will not be an impact on long-term environmental goals. c) Does the project have impacts that are individually limited, but cumulatively considerable?
