Resolution No. 9095• 1 2 3 4 5 6 7 8 M 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 RESOLUTION NO.9095 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ACCEPTING THE WORK OF ROBISON-PREZIOSO, INC. IN ACCORDANCE WITH CONTRACT NO. 595 OF THE CITY OF VERNON WHEREAS, Robison-Prezioso, Inc. was awarded Contract No. 595 for the Reservoir 2-1 Roof Improvement pursuant to Resolution No. 8844 of the City of Vernon; and WHEREAS, Samuel Kevin Wilson, Director of Community Services and Water has reported to the City Council of the City of Vernon on September 7, 2005 that said work has been completed and recommends that the work be accepted and payment be made to the Contractor in accordance with the agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The work of Robison-Prezioso, Inc. pursuant to Contract No. 595 is hereby approved and accepted by the City Council of the City of Vernon. SECTION 3: The total expended amount is One Hundred Seventy Two Thousand Six Hundred Four Dollars and no cents ($172,604.00). Therefore, of the funds due to Robison-Prezioso, Inc. Twenty Six Thousand Two Hundred Thirty Four Dollars and Ten cents ($26,234.10) is now due. The remaining ten percent (10%) or the sum of Seventeen Thousand Two Hundred Sixty Dollars and Forty cents ($17,260.40) is payable thirty-five days after the adoption of this resolution. SECTION 4: The City Council of the City of Vernon hereby directs payment of said sums as set forth to Robison-Prezioso, Inc. and instructs the Acting City Clerk to file a notice of completion with the County Recorder. The final progress payment of Twenty Six Thousand Two Hundred Thirty Four Dollars and Ten cents ($26,234.10) is now due. The remaining ten percent (10%) or the sum of Seventeen Thousand Two Hundred Sixty Dollars and Forty cents ($17,260.40) shall be paid thirty-five (35) days after the adoption of this resolution, except such amounts as are required by law to be withheld by properly executed and filed notices to stop payment, or as may be authorized by the contract to be further retained.
