RESOLUTION NO. 9170
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A
FOURTH AMENDMENT TO AGREEMENT NUMBER C-107783 BY
AND BETWEEN THE CITY OF VERNON AND THE CITY OF LOS
ANGELES REGARDING THE USE OF 2003 URBAN AREAS
SECURITY INITIATIVE GRANT FUNDS
WHEREAS, on December 15, 2004, the City Council of the City
of Vernon adopted Resolution No. 8620 approving an Agreement (the
"Agreement") with the City of Los Angeles ("Los Angeles") for the
distribution of 2003 Urban Areas Security Initiative grant funds to
the Police and Fire Departments for equipment; and
WHEREAS, on July 12, 2005, the City Council of the City of
Vernon adopted Resolution No. 8800 approving a First Amendment to the
Agreement with Los Angeles extending the time of performance and
providing for the replacement of equipment; and
WHEREAS, on June 7, 2006, the City Council of the City of
Vernon adopted Resolution No. 9064 approving a Second Amendment to the
Agreement with Los Angeles providing for the replacement of equipment;
and
WHEREAS, on October 4, 2006, the City Council of the City of
Vernon adopted Resolution No. 9139 approving a Third Amendment to the
Agreement with Los Angeles extending the time of performance of the
Agreement; and
WHEREAS, City staff have recommended that a fourth amendment
to the Agreement with Los Angeles be approved and executed to lower
the cost of Personal Protective Equipment, Detection Equipment CBRNE-
Hazardous Materials (HazMat) Equipment, and Interoperable

Communications Equipment and to add the savings of $1,846.90 to line
item Interoperable Communications, Incident Commander's Radio
Interface, in order to upgrade and replace existing analog mobile
radios.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION l: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves the Fourth Amendment to Agreement Number C-107783 of City of
Los Angeles Contract, in substantially the same form as the copy which
is attached hereto as Exhibit A and incorporated by reference.
SECTION 3: The City Council of the City of Vernon hereby
authorizes the Mayor to execute said Amendment for, and on behalf of,
the City of Vernon and the Acting City Clerk is hereby authorized to
attest thereto.
SECTION 4: The City Council of the City of Vernon hereby
authorizes the Acting City Clerk, or his designee, to make whatever
nonsubstantive, administrative and/or text changes, upon advice of
counsel, to the Agreement.
SECTION 5: The City Council of the City of Vernon hereby
directs the Acting City Clerk, or his designee, to send two executed
Amendments to:

SECTION 6: The Acting City Clerk of the City of Vernon
shall certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.

CITY OF LOS ANGELES CONTRACT
BETWEEN
THE CITY OF LOS ANGELES
AND
THE CITY OF VERNON
THIS FOURTH AMENDMENT to Agreement Number C-107783 of City of Eros
Angeles Contract is made and entered into by and between the City of Los Angeles, a
municipal corporation (hereinafter called the "City,"), and the City of Vernon, a
municipal corporation (hereinafter called "City of Vernon" or "Contractor").
WITNESSfaTH
WHEREAS, the City and the City of Vernon have entered into an Agreement
wherein the City of Vernon shall provide certain services; said Agreement effective April
28, 2004, shall hereinafter be referred to as the Agreement; and
WHEREAS, Section §505 of the Agreement provides for amendments to the
Agreement; and
WHET AS, the City and the City of Vernon are desirous of amending the
Agreement as authorized by Section 14.8 of the Los Angeles Administrative Code which
authorizes the City to prepare and execute an amendment to the Agreement for the
purpose of: (a) making minor revisions to the budget and (b) making such other changes
as are required in connection with the foregoing, all as detailed elsewhere in this
Agreement; and
WHEREAS, this Amendment is necessary and proper to continue and/or
complete certain activities authorized under the Agreement.
NOW, THEREFORE, the City and the City of Vernon agree that the Agreement
be amended upon execution as follows:

AMENDMENT
§1. Amend Exhibit F, Contractor's Authorized Expenditures, by deleting $9,730 from
line item 108A, Personal Protective Equipment Powered Air Purifying Respirator,
and replacing it with the new amount of $9,159.29
This amendment subtracts $570.71 from line item 108A. .
§2. Amend Exhibit F, Contractor's Authorized Expenditures, by deleting $28,182
from line item 1.48, Detection Equipment CBRNE — fl:azardous Materials
(HazMat) Equipment,' Detection Equipment, Decontamination Equipment, Tools,
Sampling Equipment, Response Kits and replacing it with the new amount of
$27,597.66.
This amendment subtracts $584.34 from line item 148.
§3. Amend Exhibit F, Contractor's Authorized Expenditures, by deleting $11,678
from line item 86G, Interoperable Communications Equipment, Incident
Commander's Radio Interface and replacing it with the new amount of
$10,986.15.
This amendment subtracts $691.85 from line item 86G.
§4. Amend Exhibit F, Contractor's Authorized Expenditures by deleting $12,500
from line item 86B, Interoperable Communications, Incident Commander's Radio
Interface, and replacing it with the new amount of $14,346.90.
This amendment subtracts $570.71 from line item 108A, $584.34 from line item
148, and $691.85 from line item 86G and adds it to line item 86B.
§5. Except as herein amended, all terms and conditions of the Agreement shall
remain in full force and. effect.
§6. This Amendment is executed in two (2) duplicate originals, each of which is
deemed to be an original. This Amendment includes three (3) pages which
constitute the entire understanding and agreement of the parties.

SUBJECT: Urban Area Security Initiative Grant FY 03 Part II Contract Modification
The attached two duplicate contracts prepared by the City of Los Angeles, is the fourth amendment
agreement between the City of Los Angeles and the City of Vernon regarding the Urban Area Security
Initiative Grant FY 03 Part II (UASI). The UASI agreement was approved by the City Council on
December 15, 2004, Resolution #8620. The police department has requested to amend the contract in
order to use the cost savings from each equipment line item towards the purchase of a digital mobile
police radio. The new mobile digital radio will be used to upgrade and replace an existing analog mobile
radio from our patrol fleet. I am requesting that this fourth amendment by reviewed and approved by the
City Council. Upon execution of the agreement, please forward them to Lt. Calleros and he will ensure
return of the signed original to your office.
