FROM SECTION 26.4.6-7 OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 2825 SANTA FE AVENUE IN THE CITY OF VERNON WHEREAS, On Santa Fe Partners, LLC.("On Santa Fe Partners"), owns property located at 2825 Santa Fe Avenue in the City of Vernon (the "Property") and is requesting a variance from Section 26.4.6-7, Automatic Expiration of Nonconforming Buildings, of the Comprehensive lZoning Ordinance; and WHEREAS, the Property is located in the CM -Zone; and WHEREAS, On Santa Fe Partners property consists of approximately 205,000 square feet of floor area; and WHEREAS, the site was developed in 1962 for manufacturing and continued to be used for the same purpose until 2004; and WHEREAS, in November 2004, the building located at 2825 Santa' Fe Avenue was severely damaged by a water leak, which damaged the structure (walls & concrete slab) to the extent that the structural strength was materially less than it was before the catastrophe and no longer met the minimum requirements of the building code; and WHEREAS, the City advised the property owner that the building at 2825 Santa Fe Avenue was unsafe and dangerous and ordered On Santa Fe Partners to make immediate repairs to restore the building to a safe condition or demolish the structure; and WHEREAS, while in the process of hiring contractors and consultants to evaluate the scope of work, the building remained vacant. On January 11, 2005 plans were submitted to the City for the repair of the structure. On October 1, 2005 a third water line ruptured causing additional damage to the existing slab and tilt -up walls; and WHEREAS, On Santa Fe Partners were aware of the Code Section 26.4.6-7 and the need to reoccupy the building, but due to the three consecutive water main ruptures claims that they were unable to make the repairs in a timely manner and reoccupy the structure; and WHEREAS, On Santa Fe Partners wishes to reoccupy this portion of their Property without being required to bring the building into full conformity; and WHEREAS, Section 26.4.6-7 of the Comprehensive Zoning Ordinance states that a non -conforming building or a portion of a non- conforming building which is vacant for a continuous period of at least one year shall not thereafter be occupied except in the case that it has been brought into conformity with all of the regulations of the zone in which it is located; and WHEREAS, On Santa Fe Partners is requesting a variance from the requirements of Section 26.4.6-7 (one year vacancy) be waived due to the extraordinary circumstances caused by three independent water main breaks causing an unwarranted hardship in getting the repairs completed within the one year time frame; and WHEREAS, upon reoccupying the building that has been vacant for more than one year, On Santa Fe Partners shall comply with the parking, loading and maneuvering requirements of the Comprehensive Zoning Ordinance, including regulations regarding disability accessibility, seismic and fire code regulations; and - 2 - 1 2 3 4 M 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 WHEREAS, the City Council has received a Staff Report dated December 7, 2006, upon which it has relied in making the foregoing recitals; and WHEREAS, City staff is of the opinion that the repairs could have been made within a one year time period if the property owner had made a diligent effort in completing the repairs and the property protected his building against potential subsequent damage; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a variance on December 20, 2006; and WHEREAS, the variance is not consistent with the objectives of the Comprehensive Zoning Ordinance in bringing all property in the City into conformity; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council makes the following findings pursuant to Section 26.4.6-7 of the Vernon City Code: 1) Based on the information provided by the applicant, the proposed site does not comply with Section 26.4.6-7 of the Comprehensive Zoning Ordinance, which states that a non conforming building or a portion of a non -conforming building which is vacant for a continuous period of at least one year shall not thereafter be occupied except in the case that it has been brought into conformity with all of the regulations of the zone in which it is located. In order to - 3 - I obtain a variance, the City Council must make findings 2 consistent with the requirements of Section 26.5.1-6. 3 2) On September 14, 2005, the property owner was made aware of 4 the Vernon Municipal Code Section 26.4.6-7. City staff 5 notified the property owner that the City had determined 6 that the building had been vacant since December 31, 2004 7 and advised them that if the building was not reoccupied 8 within one year of that date the property shall be brought 9 into conformity with this section. The property owner was 10 well aware of the impending deadline and in fact asked for 11 an extension. The City granted an extension to April 21, 12 2006 based on A.M. Extruders continued occupancy of the 13 structure. 14 3) Due to the unusual circumstances caused by the water main 15 breaks, repairs to the structure were not completed within 16 the one year time frame. Though the property owner was well 17 aware of the vacancy date. The property owner could have 18 deactivated the water line, made the necessary repairs, 19 constructed a new fire service water line and had the 20 building reoccupied within a one year period. 21 4) Section 26.4.6-5 of the City Code does provide guidance on 22 when damaged buildings can be repaired, but is silent on the 23 time frame on when such repairs must be made. 24 5) City Code Section 26.4.6-7 which establishes the requirement 25 that a building that is vacant in excess of one year must be 26 brought into conformity with all City Codes before being 27 reoccupied does not contain any provisions under which the 28 one year vacancy period may be tolled. 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 6) The City Council has the authority to grant a variance, however the mere existence of a particular situation which results in an unreasonable hardship is not necessary grounds for granting a variance. The fact that the owner did not complete the repairs in a timely manner, for whatever reason, including a dispute with its insurance company or failure to protect the building from further damage, caused the hardship to be brought upon itself and therefore does not constitute hardship for which a variance should be granted. SECTION 3: The variance application submitted by On Santa Fe Partners for the continued use of the non -conforming building at 2825 Santa Fe Avenue pursuant to Section 26.4.6-7 in the City of Vernon is hereby denied. SECTION 4: The Acting City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. Director of Community Services & Water SKW/sc Attachments C: City Attorney STAFF REPORT ON SANTA FE PARTNERS, LLC 2825 SANTA FE AVENUE VARIANCE APPLICATION December 7, 2006 The owner of the property, located at 2825 Santa Fe Avenue in the City of Vernon, On Santa Fe Partners, LLC ("On Santa Fe Partners") has requested a variance from Section 26.4.6-7 of the Comprehensive Zoning Ordinance. Section 26.4.6-7 states that a non -conforming building or a portion of a non -conforming building which is vacant for a continuous period of at least one year shall not thereafter be occupied except in the case that it has been brought into conformity with all of the regulations of the zone in which it is located. This site is located in the CM -Zone. BACKGROUND As previously mentioned, On Santa Fe Partners currently owns the property located at 2825 Santa Fe Avenue. The subject property is located in the CM -Zone, Commercial Industrial and is a large industrial structure containing approximately 205,000 square feet of floor area. The site was developed in 1962 for manufacturing and continued to be used for the same purpose until 2004. In 1991, Rampage Clothing Company, a clothing manufacturer occupied the site until 1998, soon thereafter, On Santa Fe Partners, the property owners, leased the subject site to A.M. Extruders, Inc. On November 15, 2004 an 8" fire water -line ruptured which caused water to penetrate into the sub -grade below the slab causing subsidence of the slab -on -grade and stress to the demising wall panels. A.M. Extruders, Inc., the tenant at the time had to cease all -1- operations due to the slab damage and water penetration underground. On November 18, 2004 the City advised the property owner that the building at 2825 Santa Fe Avenue was unsafe and dangerous and ordered On Santa Fe Partners to make immediate repairs to restore the building to a safe condition or demolish the structure. A portion of the building was posted unsafe. City staff was concerned that the building was subject to further collapse in its current condition which could endanger the life, health, property or the safety of the public and adjoining properties. City staff ordered the property owner to either retain the services of an engineer to determine if the subject building may be salvaged or demolish the structure. On December 20, 2004, the property owner's structural engineer submitted a letter stating that the building was not in any danger to collapse. Subsequently a second fire water line breakage unbeknownst to the City occurred in a different location of the property on December 29, 2004. A permit application was filed on January 11, 2005 and issued by the City on March 9, 2005 to make repairs to the damaged slab and walls. No work was ever performed on this permit. On October 1, 2005 according to the property owner, a third water break occurred which caused additional damage. A separate permit application was filed on February 6, 2006 and issued by the City on March 22, 2006 for the repairs caused by the water damage. However, to date no work (repairs) were ever performed. During a recent inspection City staff confirmed that additional damage had occurred since its initial inspection. After the first water main break, City staff has advised the property owner that until such time as the building slab is repaired the portion of the building which was damaged by the water -2- leak the building may not be occupied. In addition the property owner was repeatedly made aware of the Vernon Municipal Code Section 26.4.6-7, which states, "A non -conforming building or a portion of a non -conforming building which is vacant for a continuous period of at least one year shall not thereafter be occupied except in the case that it has been brought into conformity with all of the regulations of the zone in which it is located", including regulations regarding parking and loading, disability accessibility, seismic and fire code regulations. On September 14, 2005, City Staff mailed a letter advising the property owner that the City had determined that the building had been vacant since December 31, 2004 and advised them that if the building was not reoccupied within one year of that date the property shall be brought into conformity with this section. The business license that was issued to A.M. Extruders expired on December 31, 2004. In addition an inspection on April 21, 2005, determined that A.M. Extruders equipment had been removed from the building and therefore their occupancy was terminated. According to City records the only legal occupant of the structure was Just for Wraps, Inc. who occupied 14,255 square feet of the structure. Therefore, the City determined that the remaining 190,745 square feet of the structure has been vacant since December 31, 2004. The City sent a follow up letter to the property owner on September 20, 2005 again advising of the one year vacancy date and the code requirements related to the vacancy issue. On September 29, 2006, a letter was sent to the City from the property owner 9911 requesting that the City reconsider the vacancy date, due to the fact that A.M. Extruders, Inc. while not able to manufacture and use the facility as planned, still used the warehouse for material/equipment storage. On November 22, 2005 the City sent a letter to the property owner that it would reestablish the one year vacancy date to April 21, 2006 based on City's confirmation that A.M. Extruders had moved all of its equipment from the structure as of that date. The fact that A.M. Extruder's lease continued past that did does not constitute grounds that they continued to occupy the structure. While the property owner was well aware of the impending deadline, due to the unusual circumstances the completion of repairs to the structure were delayed and were not completed before the vacancy date. To date no repairs have been performed on the structure. On Santa Fe Partners is requesting a variance from the requirements of Section 26.4.6-7 (one year vacancy) be waived due to the extraordinary circumstances caused by three independent water main breaks causing an unwarranted hardship in getting the repairs completed within the one year time frame. If the variance is granted On Santa Fe Partners agrees to make the necessary repairs and have the structure reoccupied within six months. REASON FOR VARIANCE As mentioned above, in November 2004, the building located at 2825 Santa Fe Avenue was severely damaged by a water leak, which damaged the walls and concrete slab of the structure. The City posted the structure unsafe to occupy and therefore the occupancy, A.M. Extruder had to cease all operations until all repairs were completed -4- before the building could be reoccupied. While in the process of hiring contractors and consultants to evaluate the scope of work, the building remained vacant. Therefore, On Santa Fe Partners is requesting a variance from the requirements of Section 26.4.6-7 (one year vacancy) be issued to it at this time for the continued use of the non -conforming building without being required to bring the building into full conformity. On November 11, 2004, there was a sub -surface break in a high pressure 8" fire water- line, which introduced water into the sub -grade below the slab causing subsidence of the slab -on -grade and stress to the demising wall panels. On December 29, 2004, there was rupture to 8" high pressure water line in a different location of the property introducing additional water to the sub -grade below the slab and causing stress fractures to the demising wall panels. A third (3`d) water rapture occurred on October 1, 2005. This water rapture caused the damage to expand to 25,000 square feet of slab, tilt -up wall panels, plie caps and poured -in concrete pilasters. The above series of incidents has caused the subject property to become vacant longer than permitted by the City of Vernon Zoning Code. It is for that reason that the applicant is requesting and applying for a variance from requirements of Section 26.4. 6-7 of the Zoning Code of the City of Vernon. Given the circumstances as explained above, it would be unfeasible to require the applicant to meet the provisions established under the above section. FINDINGS 1. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not generally applicable to other lands, structures, or buildings in the same vicinity and zone: Given the fact that the property has been vacant because of water damage and beyond the applicant's control, these are special conditions and circumstances that are peculiar to the subject property and not applicable to other structures in the vicinity. 2. That literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other propertied in the same vicinity and zone in which the property is located, under the terms of this chapter: Given the current circumstances under which this variance application is being filed, a literal interpretation of the provisions established by the City of Vernon Zoning Code under Section 26.4. 6-7 will not permit and deprive the applicant to Variance Application 2825 Santa Fe Avenue 2 enjoy rights other property owners in the surrounding areas or properties do. 3.
