RESOLUTION NO. 9216
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING RESOLUTION NO. 8764 RESPECTING
VACATION POLICIES FOR EMPLOYEES OF THE CITY OF
VERNON AND REPEALING ALL RESOLUTIONS IN CONFLICT
THEREWITH
WHEREAS, the City Council of the City of Vernon adopted
Resolution No. 8764 on June 29, 2005, which established the vacation
policies, holidays and "in lieu" holidays for employees of the City of
Vernon (the "Vacation Resolution"); and
WHEREAS, the Vacation Resolution has been amended by the City
Council of the City of Vernon by Resolution Nos. 8795, 9090, 9105, 9130
and 9208 adopted on July 12, 2005, July 5, 2006, August 16, 2006,
September 20, 2006 and January 3, 2007, respectively; and
WHEREAS, the City Council of the City of Vernon desires to
amend Section 9, Accumulation of Vacation Benefits, of Resolution No.
8764.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: Sections 6.4, 6.5, 8, 9 and 11 of Resolution No.
8764, as amended, is hereby amended as indicated on Exhibit A which is
attached hereto and incorporated herein by reference.
SECTION 3: The provisions of Resolution Nos. 8764, 8795,
9090, 9105, 9130 and 9208, not consistent with or in conflict with this
resolution are hereby repealed; in all other respects Resolution No.
8764 shall remain in full force and effect.

SECTION 4: The Acting City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and thereafter
the same shall be in full force and effect.

1 EXHIBIT A
2 6.4. Any employee who is permanently transferred out of the
3 fire suppression service shall be paid for his or her unused shifts off
4 to which he or she became entitled and shall begin to accrue vacation
5 benefits on the date of the transfer in accordance with City ordinances,
6 resolutions and policies applicable to the classification in which he or
7 she works.
8 6.5. Any employee with (1) or more years of continuous service
9 who is transferred to fire suppression shall be entitled to a
10 Proportionate number of shifts off to be scheduled during the remainder
11 of the current year, unless he or she has already received the vacation
12 benefits to which he became entitled in his or her prior classification.
13 SECTION 8: Approval of Vacation
14 All vacation periods shall be authorized or approved by each Department
15 Head and shall be taken by said employee or employees during the
16 applicable calendar year.
17 SECTION 9: Accumulation of Vacation Benefits
18 9.1 Vacation or other benefits provided for herein for any
19 employee of the City of Vernon shall be accumulated from calendar year
20 to calendar year, and shall be compensated for if not utilized during
21 said period(s).
22 9.2 Miscellaneous employees, sworn safety personnel
23 in the Fire Department and sworn management personnel in the Police
24 Department shall be permitted to accumulate a maximum of forty (40)
25 hours of vacation that may be carried over to the following year. If
26 the employee fails to schedule vacation time in excess of said forty
27 (40) hours prior to the end of the calendar year, employee shall be
28 compensated for said unused accumulated vacation benefit.

9.3 Sworn safety personnel in the Fire Department working 24
hour rotating shifts or 48 hour rotating shifts shall be allowed to
carryover a maximum of two and a half (2 &1) shifts per calendar year.
If more than two and a half (2 '-�) shifts are available at the end of the
calendar year, the employee shall be compensated for the shifts/hours
exceeding the two and a half (2 '-�) shift maximum carryover.
9.4 Vacation is computed on the basis of time earned during
the prior working year. No employee while on leave of absence or leave
without pay status may earn vacation credit except where the leave has
been adjudged eligible for duty disability.
9.5 Vacation leave will be reduced in proportion to the
length of leave (excluding leave of absence for duty disability) during
the prior working year.
9.6 Commencing April 1, 2007, vacation leave earned will be
determined by dividing eligible hours by 365 days and then multiplying
by the number of days eligible for regular yearly vacation leave days
based on years of service as set forth in the attached schedules. Any
fractions will be rounded off to the nearest whole number of days.
SECTION 11: City Holidays
The following days shall be deemed to be holidays for the City
of Vernon and the public offices of the City of Vernon shall be closed
on these days:

(6) July 4th;
(7) The first Monday in September known as "Labor Day;"
(8) The second Monday in October, known as "Columbus Day;"
(9) November llth, known as "Veteran's Day;"
(10) December 25th;
(11) Good Friday, from 12 noon to 4:30 p.m.;
(12) The day in November designated as "Thanksgiving Day;"
(13) The Friday after "Thanksgiving Day;"
(14) Every day appointed by the President or Governor for a
public fast, thanksgiving, or holiday; and
(15) Such other days as may be designated as holidays by the
City Council of the City of Vernon.
If January lst, March 31st, July 4th, November llth, or
December 25th falls upon a Saturday, the preceding Friday shall be
deemed to be a holiday; or, if any of said dates falls upon a Sunday,
the following Monday shall be deemed to be a holiday.
The general City offices shall be closed on each Friday,
Saturday and Sunday.
