A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND RATIFYING THE CITY'S
PARTICIPATION IN THE FY 2006 BULLETPROOF VEST GRANT
PROGRAM BY THE VERNON POLICE DEPARTMENT
WHEREAS, the Bulletproof Vest Partnership Grant Act of 1998
and the 2000 Bulletproof Vest Partnership Act assists states, units of
local government, and Indian Tribes in obtaining funds to purchase
ballistic and stab -resistant vests for their law enforcement officers;
hand
WHEREAS, the purpose of the Bulletproof Vest partnership
Grant program (the "Grant") is to help protect the lives of police
officers by assisting states and units of local government to equip
their officers with body armor vests with the Office of Justice
Programs' Bureau of Justice Assistance administering the program; and
WHEREAS, the Vernon Police Department applied for the Grant
on April 13, 2006, for the purchase of new and replacement ballistic
vests for budgeted sworn police personnel, subject to ratification by
the City Council; and
WHEREAS, on October 20, 2006, the Office of Justice Programs'
Bureau of Justice Assistance sent an announcement of grant application
approval to the City -of Vernon regarding the Grant; and
WHEREAS, the City of Vernon's allotment in the Grant is
$17,850.00 for bulletproof vests, with the City's matching portion
being $17,850.00, and all purchases made under the Grant must be
processed by September 30, 2010; and
WHEREAS, participation in the Grant would enhance the
capability of the Vernon Police Department to respond to threats,

thereby enhancing the services provided to citizens, residents,
businesses and employees in Vernon and neighboring communities; and
WHEREAS, the Acting Police Chief by memo dated January 11,
2007, has recommended the City's participation in the Grant; and
WHEREAS, the City Council of the City of Vernon desires to
approve and ratify the City's participation in the Grant.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves, authorizes and ratifies the City's participation in the FY
2006 Bulletproof Vest Grant Program. A copy of the notification of
approval letter and amount approved regarding the Grant is attached
hereto as Exhibit A and incorporated by reference.
SECTION 3: The City Council of the City of Vernon hereby
authorizes the Acting City Administrator to execute any and all
documents necessary for the purpose of securing grant funds and to
implement and carry out the purposes specified in the grant application
for, and on behalf of, the City of Vernon.

SECTION 4: The Acting City Clerk of the City of Vernon
shall certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.

I am requesting the City Council adopt a resolution in support of our participation in the FY 2006
Bulletproof Vest Program (BVP) Grant. This is a reimbursable grant with a 50% cost share requirement.
The Police Department has been approved for $17,800 in matching funds to be used for the purchase of
ballistic vests for our sworn personnel.
A March 2006 survey of 51 sworn personnel found that 39 had vests that were at or near the end
of the recommended use period. These funds will go a long way towards enabling the officers to replace
their vests.
Attached is a memo from our Grant Administrator, Lt. Daniel Calleros, explaining the program
and a copy of the grant application approval. Once a resolution is adopted, we will process the necessary
information through the BVP on-line process.

BACKGROUND
The Bulletproof Vest Partnership (BVP) Grant Act of 1998 (PL 105-181) and the 2000
BVP Act (Public Law 106-517) assist States, units of local government, and Indian
Tribes in obtaining funds to purchase ballistic and stab -resistant vests for their law
enforcement officers. The BVP Grant Acts of 1998 and 2000 provide funding priority
for jurisdictions with populations under 100,000. Larger jurisdictions are awarded funds
up to 50% of total vest costs, based on remaining funds.
The purpose of the BVP Grant program is to help protect the lives of Police Officers by
assisting states and units of local government to equip their officers with body armor
vests. Since 1999, over 11,500 jurisdictions have participated in the BVP Program. The
Office of Justice Programs' Bureau of Justice Assistance (BJA) administers the BVP
Program.
FUNDING
The Bulletproof Vest Partnership Grant program is a reimbursable grant with a fifty
percent (50%) cost share requirement. The program requires that each jurisdiction be
responsible for providing at least 50 % of the cost of each qualifying vest purchased.
Tribal governments may use other federally appropriated funds to provide their portion of
the total cost; all other jurisdictions must use non-federal funds. Non-federal fund
sources include state and or local jurisdiction revenues, private or personal funds, and
contributions from insurance or worker's compensation consortiums. Asset forfeiture
funds may also be used to meet the jurisdictions financial requirement.
Only vest models that comply with the requirements of the Office of Justice Program's
National Institute of Justice (NIJ) 2005 Interim Requirements for Bullet -Resistant Body
Armor may be purchased with BVP Program funds.
In order to participate in this program, the City must comply with the following
requirements:
• Provide matching funds of at least 50 percent;
• Provide only one vest per officer per fiscal year;
• Purchase vests that comply with the National Institute of Justice Standard
Ballistic Resistance of Police Body Armor;
• Conduct registration, application, and communication via the Internet; and,
• Accept electronic payment.
Note: Transmission over the Internet is handled on secure servers; all information
provided (including passwords) is encrypted to help ensure privacy.
PROGRAM APPLICATION AND FUNDING APPROVAL
On April 13, 2006, the police department applied for BVP grant funding for the purchase
of new and replacement ballistic vests for budgeted sworn police personnel (55). On
October 19, 2006, the police department received notification of BVP Grant funding
approval under FY 2006, for $17,850.00 (federal portion). The City of Vernon required
cost share amount is $17,850.00. The total amount including the approved BVP funds
and the required matching city fund is $35,700.00. The approved BVP funds must be
encumbered by September 30, 2010 (within 4-years).
To receive reimbursement for vests purchased, we will need to process all related
purchase documents showing that the vests were delivered and paid. If this grant is
approved, I will process the necessary information through the BVP on-line process.
ANALYSIS
On an annual basis, sworn personnel purchase between 1-2 vests to replace worn-out or
out dated vests. The number of yearly purchases fluctuates according to replacement
needs and the number of new officers hired.
In March 2006, we conducted an informal survey to determine the make, model, and
service life of ballistic vest used by police personnel. The survey revealed that out of 51
sworn police personnel, there are approximately 39 vests currently in use that are beyond
the recommended service life. The recommendedservice life for ballistic vests is
anywhere from 3-5 years from the date of manufacture.
Based on the number of ballistic vests that are currently in use beyond the recommended
service life, the Police Department is requesting that the City cover the cost (Officer's
50% portion) associated with purchasing ballistic vest using the approved BVP Grant
funds. Purchasing replacements ballistic vests will help provide adequate protection and
ensure the safety of police personnel during critical incidents.
If this request is approved, I recommend that we conduct an agency wide armor purchase.
I contacted Armor Holdings, a ballistics vendor, and they estimated the vest replacement
cost at approximate $700.00 per vest. The cost to replace all the ballistic vests for sworn
personnel is approximately $35,700.00, which is well within the approved BVP amount
and required city contribution.
CONCLUSIONS
Based on the available funding, I request the City consider participation in the BVP Grant
program. This grant will allow the police department to provide up -to- date and adequate
ballistic vest protection for sworn personnel. Although the BVP grant has been available
for a number of years, the City has not participated in this type of grant.
