RESOLUTION NO. 9268
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON TERMINATING THE GAS SYSTEM MAINTENANCE
AGREEMENT WITH PETRELLI UTILITIES, INC. AND
REPEALING ALL RESOLUTIONS OR PARTS OF RESOLUTIONS
IN CONFLICT THEREWITH
WHEREAS, on March 2, 2005, the City Council of the City of
Vernon adopted Resolution No. 8669 approving a Gas System Maintenance
Agreement (the "Agreement") with Petrelli Utilities, Inc. ("Petrelli");
and
WHEREAS, on February 14, 2007, the City received a letter
from Petrelli requesting termination of its Agreement with the City;
and
WHEREAS, the City and Petrelli desire to terminate the
Agreement with Petrelli effective April 4, 2007; and
WHEREAS, the maintenance of Vernon's gas system is of
paramount importance; and
WHEREAS, the City desires to authorize the Director of the
Vernon Municipal Gas Department to negotiate an agreement with a
vendor to continue maintenance of the gas system.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
terminates the Agreement with Petrelli effective April 4, 2007, and
authorizes the Director of the Vernon Municipal Gas Department, or

his designee, to take all steps necessary and appropriate to negotiate
an agreement with another vendor to provide the gas maintenance
services to the City's gas system. Once the negotiations have been
completed, the City Attorney shall submit the final agreement to the
City Council for its approval.
SECTION 3: The Acting City Clerk of the City of Vernon
shall certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
