Resolution No. 92721 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 II, 21 22 23 24 25 26 27 28 RESOLUTION NO. 9272 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A FIRST AMENDMENT TO AGREEMENT NUMBER C-1098770F BY AND BETWEEN THE CITY OF VERNON AND THE CITY OF LOS ANGELES REGARDING THE USE OF 2005 URBAN AREA SECURITY INITIATIVE GRANT FUNDS WHEREAS, on May 3, 2006, the City Council of the City of Vernon adopted Resolution No. 9026 approving an Agreement (the "Agreement") with the City of Los Angeles ("Los Angeles") for the distribution of 2005 Urban Area Security Initiative grant funds to the Police and Fire Departments for equipment; and WHEREAS, City staff have recommended that a first amendment to the Agreement with Los Angeles extending the time of performance of the Agreement by three (3) months for a new ending date of March 31, 2007 and making minor revisions to the budget to replace and add additional equipment for the same total grant fund distribution ($70,811.00 for the Police Department and $62,300.00 for the Fire Department) be approved and executed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby (finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby approves the First Amendment to Agreement Number C-1098770F with the City of Los Angeles, in substantially the same form as the copy which is attached hereto as Exhibit A and incorporated by reference. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 3: The City Council of the City -of Vernon hereby authorizes the Mayor to execute said Amendment for, and on behalf of, the City of Vernon and the Acting City Clerk is hereby authorized to attest thereto. SECTION 4: The City Council of the City of Vernon hereby directs the Acting City Clerk, or his designee, to send two executed Amendments to: Laura Shin, Contracts Specialist Office of the Mayor, Homeland Security and Public Safety 200 N. Spring Street, Room 303 Los Angeles, CA 90012 SECTION 5: The Acting City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. WITNESSETH WHEREAS, the City and the City of Vernon have entered into an Agreement wherein the City of Vernon shall provide certain services; and the city shall pay for them using grant funds from the Urban Area Security Initiative ("UASI") for year 2005, said Agreement effective October 1, 2004, shall hereinafter be referred to as the Agreement; and WHEREAS, Section §505 of the Agreement provides for amendments to the Agreement; and WHEREAS, the City and the City of Vernon are desirous of amending the Agreement as authorized by Section 14.8 of the Los Angeles Administrative Code which authorizes the City to prepare and execute an amendment to the Agreement for the purpose of: (a) adding an additional three (3) months for a new ending date of March 31, 2007; and (b) making minor revisions to the budget and (c) making such other changes as are required in connection with the foregoing, all as detailed elsewhere in this Agreement; and WHEREAS, this Amendment is necessary and proper to continue and/or complete certain activities authorized under the Agreement. NOW, THEREFORE, the City and the City of Vernon agree that the Agreement be amended upon execution as follows: First Amendment, UASI 05 City of Los Angeles & City of Vernon 2/07 AMENDMENT § 1. Amend Section 201 Time of Performance by deleting the current ending date of December 31, 2006, and replacing it with the new ending date of March 31, 2007. This amendment adds an additional three (3) months. § 2. Amend Exhibit D, Contractor's Authorized Expenditures, by deleting $1,800 from line item 45, Interoperable Communications, and replacing it with the new amount of $1,200. This amendment subtracts $600 from line item 45. §3. Amend Exhibit D, Contractor's Authorized Expenditures, by deleting line item 142, Radioisotope Monitor, $3,000. This amendment deletes line item 142 and subtracts $3,000 from line item 142. §4. Amend Exhibit D, Contractor's Authorized Expenditures, by deleting line item 143, Radioisotope Monitor, $1,000. This amendment deletes line item 143 and subtracts $1,000 from line item 143. §5. Amend Exhibit D, Contractor's Authorized Expenditures, by deleting $30,000 from line item 144, Scott CBRNE Conversion Kit, and replacing it with the new amount of $25,709. This amendment subtracts $4,291 from line item 144. §6. Amend Exhibit D, Contractor's Authorized Expenditures, by deleting $10,800 from line item 145, Scott 60 Minute Bottle, and replacing it -with the new amount of $9,206. This amendment subtracts $1,594 from line item 145. §7. Amend Exhibit D, Contractor's Authorized Expenditures; by deleting $43,300 from line item 43, Interoperable Communications Equipment, and replacing it with the new amount of $43,900. This amendment adds $600 to line item 43. §8. Amend Exhibit D, Contractor's Authorized Expenditures, by deleting $17,500 from line item 141, Radioisotope Monitor, and replacing it with the new amount of $27,385. This amendment adds $9,885 to line item 141. First Amendment, UASI 05 2 2/07 City of Los Angeles & City of Vernon §9. Except as herein amended, all terms and conditions of the Agreement shall remain in full force and effect. §10. This Amendment is executed in two (2) duplicate originals, each of which is deemed to be an original. This Amendment includes four (4) pages which constitute the entire understanding and agreement of the parties.
