Resolution No. 92921 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 19 20 21 22 23 24 25 26 27 RESOLUTION 9292 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT FOR GILBERT AYALA DBA: PREMIER BILLBOARD TO CONSTRUCT AND OPERATE AN OUTDOOR ADVERTISING BILLBOARD LOCATED AT 3278 SLAUSON AVENUE WHEREAS, Gilbert Ayala dba: Premier Billboard ("Premier Billboard") has applied for a conditional use permit to construct and operate an outdoor advertising billboard located at 3278 Slauson Avenue in the City of Vernon; and WHEREAS, the City Council of the City of Vernon held a hearing on Premier Billboard's application for a conditional use permit on April 16, 2007; and WHEREAS, the proposed site is currently being used as gas station/mini-market (also known as The Arco am/pm station); and WHEREAS, retail, office, commercial, and industrial uses are generally permitted in the M-Zone; and WHEREAS, the proposed project is allowed in the M-Zone, with the approval of a conditional use permit; and WHEREAS, the proposed site is adequate in size, shape and topography for the proposed operation; and WHEREAS, the proposed site is surrounded by industrial, office, and commercial uses compatible with the proposed use. No adverse effects from traffic, parking, noise, odors, dust, smoke, light or glare is anticipated from the proposed operation; and WHEREAS, the project site has access to Slauson Avenue, which is 90 feet wide and is of adequate size and pavement -type to handle the traffic generated from the proposed operation; and -1- a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the proposed site will be supported by an eleven stall surface parking lot; and WHEREAS, City staff has determined that the proposed site and development of the proposed project is consistent with the applicable development standards, and therefore, all parking activities will be maintained on -site within the premises and will supply adequate (parking on -site for the proposed development; and WHEREAS, the site has adequate on -site parking facilities in accordance with the Zoning Ordinance; and WHEREAS, the proposed use, as to location, operation and design is consistent with the General Plan and Zoning Ordinance of the City of Vernon; and WHEREAS, City staff has determined that the project is categorically exempt from the California Environmental Quality Act pursuant to Section 15301, existing facilities; and WHEREAS, the conditions imposed on the conditional use permit as set forth herein will adequately protect the public health, safety and general welfare and the operation is consistent with all applicable rules and laws of the City of Vernon; and WHEREAS, the City Council has received a Staff Report, dated March 29, 2007 upon which it has relied in making the foregoing recitals; and —2— 1 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 2 OF VERNON AS FOLLOWS: 3 SECTION 1: The City Council of the City of Vernon hereby finds 4 and determines that the recitals contained hereinabove are true and 5 correct. 6 SECTION 2: Subject to the conditions set forth below, the 7 conditional use permit is hereby granted to Premier Billboard for 8 the construction and operation of an outdoor advertising billboard 9 located at 3278 Slauson Avenue located in the City of Vernon. 10 SECTION 3: In order to adequately protect the public health and 11 general welfare the following conditions are required: 12 a. The facility shall be operated in accordance with, and made 13 to conform with all the current codes, rules, and 14 regulations including any required fees as adopted by the 15 City of Vernon not otherwise addressed by this grant of a 16 conditional use permit. 17 b. All parking and loading facilities shall be paved with a 18 concrete or asphalt concrete paving and shall be adequately 19 drained, and kept free of dust, mud, trash and weeds. Where 20 parking or maneuvering areas adjoin the public street a 21 barrier wall or landscaping shall be installed and 22 maintained to meet City standards. Adequate on -site parking 23 shall be maintained so that no on street parking or staging 24 will occur. 25 C. All required federal, state, local and regulatory agency 26 permits shall be obtained prior to operation. 27 d. The facility shall be operated in a manner, which will not 28 impede traffic on Slauson Avenue. No maneuvering or vehicle parking associated with the existing facility shall take place on the public street. e. All subject work shall be in accordance with City Standards. No changes shall be made in the site development except with the prior approval of the Director of Community Services. f. The proposed billboard shall be constructed and maintained substantially in compliance with the site plan submitted as part of this conditional use permit application. g. No sign face or sign area shall be added to an existing sign unless within a permanent frame or panel indicated for such purpose on approved plans for the total sign structure. h. The Outdoor Advertising Structure shall be maintained in good condition and working order, and free of graffiti, peeling paint, faded colors and/or broken and damaged materials. i. The Outdoor Advertising Structure shall have the sign owner's name, address and telephone number conspicuously and permanently attached on the exterior of the sign. j. All construction and/or improvements associated with the billboard shall be in compliance with the most current Building Codes (Building, Fire, Mechanical, Plumbing and Electrical) and Safety Codes and Regulations. The sign shall be 5-feet away from any underground utility line. No portion of the sign shall be within 5-feet of any property line. 1. Any form of moving, animated, oscillating or rotating sign, or any other design intended to attract attention through movement or the semblance of movement of the whole or any part of the sign or any other method or device that suggests movement; Inflatable signs; Flashing signs, containing illuminated light or other devices which are intermittently on and off, which change in intensity, or which create the illusion of flashing in any manner shall not be permitted as an outdoor advertising structure. SECTION 4: Premier Billboard and any successors in interest shall indemnify, hold harmless, and defend the City of Vernon, its officers, agents, and employees from and against any and all claims, complaints, or petitions for: (1) damages, losses, expenses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the sole negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; and/or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. SECTION 6: Not later than sixty (60) days from the date of this Resolution, Premier Billboard shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 3 of this Resolution and the indemnification provision contained in Section 4 of the Resolution. SECTION 7: The Acting City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. The proposed project will entail the construction and operation of an outdoor advertising billboard that will be located on the northwest corner of the property on an existing retail/commercial site (The Arco am/pm station). The proposed billboard will be a maximum of 35' feet in height, double faced l4'x 48' (672' sq. ft. in size on each side). The billboard will be used exclusively to advertise local and national businesses. The proposed billboard will be a stand alone business/operation with no need of occupancy, only with the exception of occasional maintenance work on the billboard itself. The proposed billboard will not change and/or alter any part of the existing daily operations, employees, management, or traffic flow. The project site is located at 3278 Slauson Avenue. 1. GENERAL PLAN The proposed use is in accordance with the General Plan. Section 26.7.3 of the Comprehensive Zoning Ordinance, which states that the construction, modification or replacement of outdoor advertising structures maybe permitted in all zones of the City, subject to obtaining a conditional use permit and complying with all other conditions imposed by this article. The site is located in the M- 9 Zone, General Industrial. 2. SITE As previously mentioned, the proposed project will entail the construction and operation of an outdoor advertising billboard that will be located on the northwest corner of the property, on an existing retail/commercial site. The proposed billboard will be approximately 35' feet in height, double faced 14'x 48' (672' sq. ft. in size on each side). The billboard will be used exclusively to advertise local and national businesses. The site is currently being used as a gas station/mini market (The Arco am/pm station). The proposed site of the billboard shall be paved with an impermeable surface. The proposed billboard will not change and/or alter any part of the existing operation, employees, management, or traffic flow. The proposed site will be supported by an eleven stall surface parking lot. The proposed site is of adequate size, shape and topography for the proposed operation. The proposed site is in conformance with the location requirements contained in Section 26.7.4-4(d) of the City Code which requires a minimum distance of 2,500-feet between outdoor advertising billboards. In addition, the property owner has given approval for Premier Billboard to perform the work and pursue the necessary permitting and conditional use permit procedures. 3. ADVERSE EFFECT The proposed project is in the M-Zone, the uses in the surrounding and adjacent properties include retail, office, commercial, warehouse, wholesale, and general industrial uses and are compatible with the proposed operation. No adverse impacts from traffic, parking, noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion are expected to occur to the adjacent or abutting properties. Pursuant P to Section 15301 of the California Environmental Quality Act, this project is exempt from CEQA, because it is an existing facility with no expansion of use. 4. ACCESS There are three driveways that currently access the existing site, all three driveways are located along Slauson Avenue. Trucks and automobiles accessing the site will continue to share the existing driveways along Slauson Avenue. Slauson Avenue is 90 feet wide and is of adequate size and pavement type to handle the traffic generated from the proposed operation. Motorists using the surrounding street system will not experience major changes in traffic due to the construction and operation of the proposed billboard. 5. VEHICLE MOVEMENTS Most of the vehicular traffic at the existing retail facility will continue as before which includes employee and customer ingress/egress, trucks that deliver/pick-up product and supplies. The proposed billboard will not add to the existing vehicular traffic.
