A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF VERNON GRANTING A
CONDITIONAL USE PERMIT TO BON
APPETIT DANISH, INC FOR THE
OPERATION OF AN ACCESSORY
WAREHOUSE AT 4820 50' STREET
WHEREAS, Bon Appetit Danish, Inc (hereafter referred to as
"Bon Appetit") has applied for a conditional use permit to
operate an accessory warehouse at 4820 50th Street in the City of
Vernon; and
WHEREAS, Bon Appetit currently has manufacturing,
packaging, warehousing, and office space at 4525-4529 District
Boulevard and 4500 District Boulevard; and
WHEREAS, the City Council of the City of Vernon held
hearing on said application for a conditional use permit on May
21, 2007; and
WHEREAS, the proposed site is a permitted use in the
General Industry (M) Zone with approval of a conditional use
permit; and
WHEREAS, City staff has determined that the project is
categorically exempt from the California Environmental Quality
Act pursuant to Section 15301, existing facilities; and
WHEREAS, the proposed use, as to location, operation and
design is consistent with the General Plan and Zoning Ordinance
of the City of Vernon; and
WHEREAS, a conditional use permit is required under the
Zoning Ordinance Section 26.3.5-3(j) in order to operate an
accessory warehouse greater than 50,000 square feet in the M-
Zone; and

WHEREAS, the proposed operation will be an integral part of
the manufacturing operation and will include the storage of
goods produced in the Bon Appetit's manufacturing operation in
the City of Vernon; and
WHEREAS, Bon Appetit proposes to occupy approximately
90,480 square feet of the building on the site, and the site is
adequate in size, shape and topography for the proposed
operation; and
WHEREAS, the proposed site is surrounded by industrial,
warehouse, commercial, residential, and other uses which are
compatible with the proposed use and no adverse effects from
traffic, parking, noise, odors, dust, smoke, light or glare, or
risk of fire, infection or explosion is anticipated from the
proposed operation; and
WHEREAS, the site has access to 50th Street, and Gifford
Avenue, which is adequate in width and pavement type to carry
the quantity of traffic generated by the proposed use; and
WHEREAS, the conditions imposed on the conditional use
permit will adequately protect the public health, safety and
general welfare and the operation is consistent with all
applicable rules and laws of the City of Vernon; and
WHEREAS, the City Council has received a Staff Report,
dated May 8, 2007 upon which it has relied on making the
foregoing recitals; and

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
VERNON AS FOLLOWS:
SECTION l: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are
true and correct.
SECTION 2: Subject to the conditions set forth below, the
conditional use permit is hereby granted to Bon Appetit for the
operation of an accessory warehouse at 4820 50th Street.
SECTION 3: In order to adequately protect the public health
and general welfare the following conditions are required:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, and regulations
including any required fees as adopted by the City of Vernon not
otherwise addressed by this grant of a conditional use permit.
b. All required federal, state, local and regulatory
agency permits shall be obtained prior to operation. Prior to
occupancy a business license and occupancy permit shall be
obtained.
C. Prior to occupancy all parking and loading facilities
shall be paved with a concrete or asphalt concrete paving and
shall be adequately drained, and kept free of dust, mud, trash
and weeds. Where parking or maneuvering areas adjoin the public
street a barrier wail or landscaping shall be installed and
maintained to meet City standards. Adequate on -site parking
shall be maintained so that no on -street parking or staging will i

occur.
d. Prior to occupancy all parking and loading areas
necessary for Bon Appetit operations shall be striped in an
acceptable manner to the Director of Community Services & Water.
e. The facility shall be operated in a manner that will
prevent unsanitary conditions, odors or other nuisances. The
property shall be provided with adequate refuse containers and
refuse disposal services.
f. The project site shall be maintained substantially in
compliance with the site plan submitted as part of this
conditional use permit application.
g. Bon Appetit shall structurally maintain 4820 50th
Street to exclude rodents and the property shall be maintained
rodent free. The site shall maintain adequate drainage to
eliminate potential mosquito harborage.
h. Servicing of vehicles, including but not limited to,
washing, steam cleaning and repairing, shall not be permitted on
the premises. No inoperative vehicles shall be stored on -site.
All vehicles operated at the facility shall be tuned and
maintained in accordance with applicable emission standards.
i. No equipment or.freight shall be stored or assembled
on the site other than in buildings or trailers (outside storage
is prohibited).

k. If required a hazardous materials permit shall be
obtained from the City of Vernon Environmental Health Department
for all hazardous materials/waste used, handled, or stored at
the site. Hazardous materials/waste shall be handled and managed
in compliance with all appropriate federal, state and local
laws. Prior to occupancy a plan shall be prepared on how
hazardous materials will be stored and contained in case of a
spill. Adequate plans and materials must be available for
handling leaks or spills from vehicles during storage, loading
or transportation.
1. The facility shall be operated in a manner that will
not impede traffic on 50th Street and Gifford Avenue. 50th Street
shall be repaired and maintained to meet City Standards.
M. The usage of the eight non -conforming truck docks that
front Gifford Avenue shall be limited to six trucks per day, and
small vans and trucks that can maneuver onsite. No trucks parked
at or using the loading docks shall extend into the street
right-of-way as shown on the Master Plan of Streets, dated
November 17, 2004.

SECTION 4: Bon Appetit and any successors in interest shall
indemnify, hold harmless, and defend the City of Vernon, its
officers, agents, and employees from and against any and all
claims, complaints, or petitions for: (1) damages, losses,
expenses resulting from bodily injury, sickness, disease,
disability or death arising from the operation of the facility
excluding therefrom any such claim resulting from the sole
negligence or intentional wrongdoing of the City of Vernon, its
officers, agents. or employees; (2) a peremptory writ or other
relief by way of injunction, mandamus, or administrative
mandamus; or (3) legal expenses and attorney's fees incurred by,
the City of Vernon on behalf of any party in such actions or

proceedings. The City of Vernon does not waive its right to
participate in the defense of any such action.
SECTION 5: Noncompliance with any condition set forth in
the conditional use permit shall be grounds for voiding the
permit pursuant to Section 26.5.2-10 of the Comprehensive Zoning
Ordinance.
SECTION 6: Not later than sixty (60) days from the date of
this Resolution, Bon Appetit shall indicate, in writing, its
acceptance of and agreement with the conditions contained in
Section 3 of this Resolution and the indemnification provision
contained in Section 4 of the Resolution.
SECTION 7: The Acting City Clerk of the City of Vernon
shall certify to the passage of this resolution and thereupon
and thereafter the same shall be in full force and effect.

Bon Appetit Danish, Inc has submitted an application for a conditional use permit.
They are proposing to operate an accessory warehouse in excess of more than 50,000 square
feet in the building located at 4820 50�' Street in the City of Vernon.
After review of the application by the Community Services Department, it is
recommended that the conditional use permit be granted.
Herewith for your consideration are the following supporting documents:
1. Staff Report.
2. Request for conditional use permit and information supporting the application.
3. Notice of Public Hearing, copies of notification letters to owners and tenants in
the area and affidavits of posting and mailing.
The project is categorically exempt from CEQA because it is an existing facility as
described in Section 15301. Notice of Exemption will be prepared. In my opinion the
proposed operation will pose no adverse effects to the City of Vernon and will have no
significant effects on the environment. The project is consistent with the General Plan as
Adopted by the City of Vernon.

Therefore, it is recommended that the City Council determine:

Bon Appetit Danish, Inc (hereafter referred to as "Bon Appetit") is a wholesale
bakery manufacturer, specializing in gourmet baking and distribution of top quality
Danish, cakes, muffins in the City of Vernon. They are presently operating out of three
locations, the first location is located at 4525 District Boulevard (main office —
manufacturing & warehousing), the second location is at 4500 District Boulevard
(warehousing of baking equip. and files); and the third location is at 4529 District
Boulevard (storage of raw materials, which are used to prepare their manufactured goods).
Bon Appetit is proposing to expand its operation by acquiring an additional building
located at 4820 50t' Street. The proposed site is approximately 90,480 square feet and will
be used as an accessory warehouse for their existing manufacturing facility. The accessory
warehouse will operate as an integral part of Bon Appetit's manufacturing process and
store goods produced in the City.
In order to comply with the Comprehensive Zoning Ordinance and operate an
accessory warehouse greater than 50,000 square feet in the M-Zone, a conditional use
permit is required. As defined in Section 26.3.5.30), an accessory warehouse is an integral
part of a manufacturing operation located in the City of Vernon and storing goods

produced in that operation.
1. GENERAL PLAN The proposed use conforms to the Zoning Ordinance and
the General Plan with the granting of a conditional use permit. The site of the proposed
use is located in the M-zone, General Industrial. An accessory warehouse in excess of
50,000 square feet is permitted in the M-Zone with a conditional use permit.
2. SITE The proposed site is a preexisting building located at 4820 50'b Street.
The property contains a two story concrete building approximately 90,480 square feet in
size. The total size of the parcel is approximately 132,271 square feet. Bon Appetit
proposes to occupy the entire 90,480 square feet of the existing building, which is
currently vacant. The proposed site will be supported by a ninety-two stall surface parking
lot and eight conforming truck parking/loading stalls on the east end of the building and
eight additional non -conforming truck spaces on the west end of the building which front
Gifford Avenue. Bon Appetit has requested permission to continue using these eight non-
conforming truck loading docks. Bon Appetit has stated that only vehicles of smaller
lengths will be used at the non -conforming truck loading spaces. In order for the non-
conforming loading spaces to conform with the current Comprehensive Zoning Ordinance,
a significant portion of the building would need to be demolished and would change the
whole configuration of the building. This option would be very costly and timely and
would cause an unreasonable hardship to the applicant given the fact that Bon Appetit is
providing all the required parking and loading and that these loading spaces are above and
beyond those required by the Zoning Ordinance.

However, if granted permission, Bon Appetit is completely aware that these eight
non -conforming truck docks fronting Gifford Avenue will be limited to a maximum of six
tractor -trailers per day, along with small vans and trucks that will complete all
maneuvering onsite and has agreed to permanently seal -off these docks after three years.
Bon Appetit has stated that by allowing the use of these non -conforming truck docks it
would give them the ability to use its land in the most efficient and economic manner,
even though it's only for three years. The existing site is adequate in size, shape,
topography and drainage for the proposed operation. The proposed site shall be paved with
an impermeable surface that meets City of Vernon standards.
The second floor of the structure has been vacant in excess of one year and
therefore cannot be occupied until it is brought into full conformity with the building
codes.
3. ADVERSE EFFECT The proposed use is surrounded by industrial, warehouse,
commercial, residential, and other uses which are compatible with the proposed use. No
adverse impacts from traffic, parking, noise, odor, dust, smoke, light or glare, or risk of fire,
infection or explosion are expected to occur to the adjacent or abutting properties. Pursuant
to Section 15301 of the California Environmental Quality Act, this project is exempt from
CEQA, because it is an existing facility.
4. ACCESS The project site will have access to three driveways, two along 506'
Street, and one along Gifford Avenue. Trucks and automobiles accessing the site will
share the driveways along 50"' Street. 50"' Street is 60 feet in width and is adequate in size

and pavement type to handle the traffic generated by the operation. Gifford Avenue is 60
feet in width and is adequate in size and pavement type to handle the traffic generated by
the operation.
5. VEHICLE MOVEMENTS The proposed site is located at the comer of
Gifford Avenue and 50`h Street. There are three entrances into the property site, two of
which are located on 50'hStreet and one located on Gifford Avenue. Bon Appetit estimates
that approximately 6 to 8 trucks per day will deliver and pick-up product. The proposed
facility will have approximately 20 employees per shift (a total of three shifts - office
clerks and warehouse workers). Traffic to and from the site will primarily stem from the
movements of employees vehicles and trucks delivering and picking up product, during a
typical 24-hour period. The trucks routed to the subject site will travel south on Atlantic
Boulevard from the 710 freeway to District Boulevard (West) to 50t' Street. Motorists
using the surrounding street system will not experience major changes in traffic operations
due the traffic generated by the proposed operation.
6. OPERATIONS Bon Appetit is an existing manufacturing facility in the City
of Vernon that is proposing to expand its operation by acquiring additional warehousing
space at 4820 50t' Street. Bon Appetit manufactures different types of pastry products and
will use the subject site as an accessory warehouse for the storage of its manufactured
products. The facilities operating hours will be 24-hours per day, seven days per week.

7. STATE OR FEDERAL CONDITIONS All Federal, State, and local
regulatory permits shall be obtained as required for the operation.

Operations Report
The applicant, Bon Appetit, is a wholesale bakery manufacturing facility, specializing in
gourmet baking and distribution of top quality Danish, cakes, muffins and a vast
assortment of other fine gourmet products to the retail and convenience store industry.
Goods are manufactured in Vernon and distributed to individual retailers and major chain
stores. Continuing market success has led to a need to expand their warehouse and
distribution areas to meet customer demand. Bon Appetite is now proposing to expand to
the facility at 4820 E. 50th Street in Vernon.
The proposed facility is an existing two story concrete building of approximately 90,480
square feet, of which approximately 7,000 s.f. is office. There are eight code required
truck spaces on the east end of the building a�d eight additional truck spaces (by
requested variance) on the west (Gifford Street) end of the building.
The proposed facility will employ a total of +/- 20 people per shift (office and warehouse
workers). The operating hours of the facility will be 24 hours per day, seven days per
week.
Goods are delivered to the building by bobtail trucks (6-8 deliveries per day). Product is
stored on pallets and then shipped out in full sized (65') semi's f6-8 shipments per day).

Trucks & Loading:
Goods are received six to eight times per 24 hour day in 25' bobtail trucks.
Goods are shipped six to eight times per 24 hour day in full sized (65') semi
trucks.
There are eight code required truck spaces on the east end of the building (4
parking/ 4 loading) and eight additional truck spaces (by requested variance) on
the west (Gifford Street) end of the building.
Parking:
The facility has 92 code required parking spaces. As this is a distribution center,
92 spaces will be far in excess of the actual number of spaces required by Bon
Appetit's operations.
