A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF VERNON GRANTING A
CONDITIONAL USE PERMIT TO HK
INTERNATIONAL ENTERPRISE, LLC FOR
THE OPERATION OF AN EXISTING
FREIGHT TERMINAL AT 4423 HAWTHORNE
AVENUE
WHEREAS, HK International Enterprise, LLC ("HK
International") has applied for a conditional use permit to
operate an existing freight terminal at 4423 Hawthorne Avenue in
the City of Vernon; and
WHEREAS, the City Council of the City of Vernon held a
hearing on said application for a conditional use permit on May
21, 2007; and
WHEREAS, the proposed site is a legal non -conforming use in
the General Industry (M) Zone which has been used previously as
a freight terminal by Refrigerate Transport Service; and
WHEREAS, a conditional use permit is required under the
Zoning Ordinance in order to continue the use as a freight
terminal; and
WHEREAS, the proposed operation will include the hauling
and temporary storage of general products; and
WHEREAS, the proposed site is approximately 12,000 square
feet in size, and is adequate in size, shape and topography for
the proposed operation and has adequate drainage; and
WHEREAS, the proposed site is surrounded by industrial uses
compatible with the proposed use and no adverse effects from
traffic, parking, noise, odors, dust, smoke, light or glare, or
risk of fire, infection or explosion is anticipated from the
proposed operation; and

WHEREAS, the streets to be used by the applicant are
sufficient to handle the traffic generated from the proposed
operations; and
WHEREAS, the proposed operation will not generate more
traffic trips than have been generated historically at the site
and there will be no traffic impact; and
WHEREAS, the conditions imposed on the conditional use
permit will adequately protect the public health, safety and
general welfare and the operation is consistent with all
applicable rules and laws of the City of Vernon; and
WHEREAS, the proposed use, as to location, operation and
design is consistent with the General Plan and Zoning Ordinance
of the City of Vernon; and
WHEREAS, the project is categorically exempt from the
California Environmental Quality Act as an existing facility
pursuant to Section 15301 of the California Environmental
Quality Act Guidelines and a Notice of Exemption will be
prepared and filed with the County Clerk; and
WHEREAS, the City Council has received a Staff Report,
dated on May 8, 2007 upon which it has relied on making the
foregoing recitals; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are
true and correct.

SECTION 2: Subject to the conditions set forth below, the
conditional use permit is hereby granted to HK International for
the operation of a freight terminal at 4423 Hawthorne Avenue.
SECTION 3: In order to adequately protect the public health
and general welfare the following conditions are required:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, and regulations
and subject to permit fees as adopted by the City of Vernon not
otherwise addressed by this grant of a conditional use permit.
b. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation. Prior to occupancy
a business license and occupancy permit shall be obtained.
c. Any hazardous substances used, handled and/or stored
shall have prior approval from the Vernon Fire and Health
Departments. A Health Permit shall be obtained if there are
reportable quantities of hazardous materials on the site.
d. All parking and loading facilities shall be paved and
maintained with an asphalt concrete or concrete surface material
and shall be adequately drained, and kept free of dust, mud,
trash and weeds. Where parking or maneuvering areas adjoin the
public street prior to occupancy a barrier wall or landscaping
shall be installed and maintained to meet City standards.
Adequate on -site parking shall be maintained so that no on
street parking or staging will occur.
e. The facility shall be operated in a manner that will
prevent unsanitary conditions, odors or other nuisances. The
property shall be provided with adequate refuse containers and
refuse disposal services.

f. The facility shall be operated in such a manner that
noise and vibration shall not be a nuisance to neighborhood
properties. At no time shall noise exceed 65dba or vibration
exceeds two hundredths of an inch per second particle velocity
when measured at the facilities property line. The facility
shall comply with all City of Vernon and CalOSHA noise
requirements at all times.
g. The facility's buildings shall be structurally
maintained to exclude rodents and the property shall be
maintained rodent free. The site shall maintain adequate
drainage to eliminate potential mosquito harborage.
h. Servicing of vehicles, including but not limited to,
washing, steam cleaning and repairing, shall not be permitted on
the premises. No inoperative vehicles shall be stored on -site.
All vehicles operated at the facility shall be tuned and
maintained in accordance with applicable emission standards.
i. No equipment or freight shall be stored on the site
other than in buildings, trailers, or on the docks (outside
storage is prohibited).
j. Prior to occupancy HK International shall submit a
Notice of Non -Applicability of Coverage under the general
industrial activity stormwater permit to the Los Angeles
Regional Water Quality Control Board.
k. Prior to occupancy a hazardous materials spill control
plan shall be prepared. Materials shall be maintained on site
and available for handling leaks or spills from vehicles during
storage or transportation.

1 1. The project site shall be maintained substantially in
2 compliance with the site plan submitted as part of this
3 conditional use permit application.
4 m. Prior to occupancy HK International shall obtain and
5 maintain a Food Warehouse Permit from the City of Vernon
6 Environmental Health Department. This Food Warehouse Permit
7 shall be maintained in good standing during HK Internationals
8 occupancy of the site. All Wholesale Food Vehicles operating out
9 of the subject site shall also obtain a permit from the City of
10 Vernon Environmental Health Department.
11 n. The facility shall be operated in a manner that will not
12 impede traffic on Hawthorne Avenue. All vehicles shall enter and
13 exit the site in a front forward manner. No maneuvering or
14 vehicle parking associated with the facility shall take place
15 offsite or on the public street without prior approval from the
16 Community Services Department.
17 o. Within three months of occupying the site HK
18 International shall repair all existing cracked sidewalk,
19 driveways, curb and gutter adjoining the site on Hawthorne
20 Avenue, all street improvements shall be maintained to meet City
21 standards.
22 p. This Conditional Use Permit (CUP) shall become void on
23 January 1, 2029 in accordance with Section 26.4.6-3 of the
24 Vernon Municipal Code or when HK International no longer is
25 conducting business as a freight terminal at the subject site,
26 whichever occurs first.
27 q. Prior to occupancy a guardrail able to withstand the
28 impact by a truck shall be constructed on the subject property

where automobile or truck parking or maneuvering adjoin a
neighboring parcel. Engineered drawings shall be submitted for
review and approval.
r. The property site shall not generate more than 30 truck,
trips (15 inbound and 15 outbound) per day.
SECTION 4: HK International and any successors in interest
shall indemnify, hold harmless, and defend the City of Vernon,
its officers, agents, and employees from and against any and all
claims, complaints, or petitions for: (1) general and/or special
damages, losses, expenses resulting from bodily injury,
sickness, disease, disability or death arising from the
operation of the facility excluding therefrom any such claim
resulting from the sole negligence or intentional wrongdoing of
the City of Vernon, its officers, agents or employees; (2) a
peremptory writ or other relief by way of injunction, mandamus,
or administrative mandamus; and/or (3) legal expenses and
attorney's fees incurred by the City of Vernon on behalf of any
party in such actions or proceedings. The City of Vernon does
not waive its right to participate in the defense of any such
action.
SECTION 5: Not later than sixty (60) days from the date of
this Resolution, HK International shall indicate, in writing,
its acceptance of and agreement with the conditions contained in
Section 3 of this Resolution and the indemnification provision
contained in Section 4 of the Resolution.

1 SECTION 6: The Acting City Clerk of the City of Vernon
2 shall certify to the passage of this resolution and thereupon
3 and thereafter the same shall be in full force and effect.

HK International Enterprise, LLC ("HK International") has submitted an application
for a conditional use permit to operate an existing freight terminal at 4423 Hawthorne
Avenue. Refrigerate Transport Service previously operated this site as a freight terminal. The
proposed operation will include the hauling and temporary storage of general products, and
provide pick-up and delivery services of a wide range of items. The facility operating hours
will be 7:00 a.m. to 5:00 p.m., Monday through Saturday. The proposed site is located in the
M-Zone, General Industrial.
After review of the application by the Community Services Department, it is
recommended that the conditional use permit be granted.
Herewith for your consideration are the following supporting documents:
1. Staff Report.
2. Request for conditional use permit and information supporting the application.
3. Notice of Public Hearing, copies of notification letters to owners and tenants in
the area and affidavits of posting and mailing.

The project is categorically exempt from CEQA because it is an existing facility as
described in Section 15301. A Notice of Exemption will be prepared and filed with the
County Clerk. In my opinion the proposed operation will pose no adverse effects to the City
of Vernon and will have no significant effects on the environment. The project is consistent
with the General Plan as adopted by the City of Vernon.
Therefore, it is recommended that the City Council determine:
1. That the project is consistent with the General Plan as adopted by the City of
Vernon.
2. That the project will not have a significant effect on the environment.
3. That the project will not individually or cumulatively have an adverse effect on
wildlife resources.
Further, it is recommended that the conditional use permit be granted subject to the
following conditions:
a. The facility shall be operated in accordance with, and made to conform with all

The facility operating hours will be 7:00 a.m. to 5:00 p.m., Monday through Saturday.
1. GENERAL PLAN
The proposed use is a legal non -conforming use in the General Industrial, M-Zone.
The site was previously used by Refrigerate Transport Service as a freight terminal. HK
International intends to use the proposed site as a freight terminal. The General Plan
designates the General Industrial Zone for manufacturing, warehousing, assembly and
wholesale uses. A freight terminal is a non -conforming use in the M-Zone: However,
because it is a pre-existing freight terminal, the non -conforming use may be continued
provided that it shall not be expanded, extended, and/or altered as specified in Section
26.4.6-1 of the Vernon Municipal Code. Section 26.5.2-11, Existing Uses, of the Code
states that permitted uses, subject to a conditional use permit may continue without
securing such a permit, however any extension or expansion of such a use or the issuance

of a new occupancy permit shall require a conditional use permit. In accordance with
Section 24.11 of the Code, HK International is required to obtain an occupancy permit
and therefore a conditional use permit is required.
2. SITE
The proposed site is a preexisting building located at 4423 Hawthorne Avenue.
The property contains a one story building approximately 12,000 square feet in size. The
total size of the parcel is approximately 43,996 square feet. This building was previously
occupied and operated by Refrigerate Transport Service, a freight terminal and will
continue to be used for the same purposes. The applicant has not proposed any changes to
the size, shape of the existing site and is adequate for the proposed operation.
3. ADVERSE EFFECT
The proposed use is surrounded by properties with industrial, commercial, office and
warehousing uses that are compatible with the proposed use. No potentially significant
impacts are expected to result from traffic, parking, noise, odor, dust, smoke, light or
glare, or risk of fire, infection or explosion from the proposed project. The project is
categorically exempt under Section 15301 of the California Environmental Quality Act
(CEQA) because it is an existing facility with no expansion of use. A Notice of
Exemption will be prepared and filed with the County Clerk.
4. ACCESS
The proposed site has one driveway on Hawthorne Avenue located on the east side
of the building, which provides ingress and egress from Hawthorne Avenue. The streets and

highways surrounding the proposed use are adequate in width and are improved as
necessary to carry the traffic expected by this proposed use. The subject site is served by
Hawthorne Avenue, a local roadway with a right-of-way of 60 feet. A barrier in
compliance with Section 26.4.2-8(g) has been proposed where the parking or
maneuvering area adjoin a public street pursuant to the Vernon City Code.
5. VEHICLE MOVEMENTS
Most of the vehicular traffic at the existing freight terminal will continue as before
which includes employee ingress/egress and trucks that will deliver and pick-up product.
HK International will operate approximately four to eight tractor/trailers out of the existing
facility daily. These tractor/trailers will be dispatched at different times throughout the day
between the hours of 7:00 a.m. and 5:00 p.m. The proposed use will not add to the existing
vehicular traffic. The proposed site has ample room to provide adequate on -site parking
and loading facilities. Therefore, the proposed use will not cause a significant traffic
impact.
6. OPERATIONS
HK International will use the facility to operate an existing freight terminal. As
previously mentioned, the proposed operation will include the hauling and temporary
storage of general products, and provide pick-up and delivery services of a wide range of
items. After the drivers arrive at their destination they will drop off the
merchandise/freight. Drivers will then return to the site and wait to be dispatched again.
All merchandise that is stored and transferred is refrigerated goods. No hazardous

materials will be stored or transferred on site. The hours of operation will be from 7:00
a.m. to 5:00 p.m., Monday through Saturday.
7. STATE OR FEDERAL CONDITIONS
All Federal, State, and Local regulatory permits shall be obtained as required for
the operation.

FREIGHT TERMINAL AND WAREHOUSE
SUBJECT: 1 4423 Hawthorne Ave
Vernon, CA 90058
A) The site for the proposed use is adequate in size, shape and topography, including drainage and
landscaping.
The existing site to operate a freight terminal and warehouse is a flat and rectangular site that
contains approximately 43,996 square feet. The site currently contains a 12,000 square foot
industrial building. This is request of a new conditional use permit due to change in ownership.
The site is adequately landscaped for the use for which it is intended. This site is therefore,
adequate in size, shape and topography for this type of operation.
B) The proposed use will not have an adverse effect upon adjacent or abutting properties in terms of
traffic, parking noise, odors, dust, smoke, light or glare, or risk of fire, infection, or explosion.
This is a request of a freight terminal and warehouse. There is no manufacturing on site. The
proposed use, therefore, will not have an adverse effect upon adjacent or abutting properties in
terms of traffic, parking, noise, odors, dust, smoke, light or glare, or risk of fire, infection, or
explosion.
C) The proposed use will be compatible with the permitted uses of surrounding and adjacent
properties.
The surrounding uses of the subject site include warehousing to the north, east, south, and west.
The proposed use, therefore, will be compatible with the permitted uses of surrounding and
adjacent properties.
D) The site has sufficient access to streets and highways which are adequate in width and pavement
type to carry the quantity of traffic generated by the proposed use, and that the routes which
vehicles will have to follow to reach the site are adequate in width and pavement type to carry the

The site is located on the west side of Hawthorne Ave, just south of Vernon Ave, both of which
are improved with pavement to adequately serve the traffic generated by our proposed use. The
site, therefore, has sufficient access to streets and highways, which are adequate in width and
pavement type to carry the quantity of traffic generated by the proposed use.
E) The site has adequate off-street parking and loading facilities.
The site contains 13 parking spaces,16 truck parking/loading spaces. We will have
approximately five employees at this location. The existing parking spaces on the site can
adequately serve us. The site, therefore, has adequate off-street parking and loading facilities.
F) The use, as to location, operation and design, is consistent with the general plan, any applicable
specific plan and zoning regulations of the City of Vernon and all applicable County, State and
federal law, rules and regulations.
Freight terminals are allowed at this location within the City of Vernon subject to an approved
conditional use permit by the City Council. The freight terminal use at this site is consistent with
the surrounding uses as well as the intent of the Vernon General Plan. It also complies with the
applicable zoning codes of the City, as well as County, Sates and federal rules and regulations.

operate as a freight terminal and warehouse. We will use three tractors and four trailers. Outside
trucks will be engaged to handle any excess. Our hours of operation will be from 7:00 am to 5:00
pm, Mondays to Saturdays. There will be four 53' long trucks and tractors daily on average.

SUBJECT: Conditional Use Permit — HK International Enterprise, LLC located at

HK International Enterprise, LLC has submitted an application for a conditional use
permit to operate an existing freight terminal at 4423 Hawthorne Avenue. The proposed
operation will include the hauling and temporary storage of general products, and provide
pick-up and delivery services of a wide range of items. The facility operating hours will be
7:00 a.m. to 5:00 p.m., Monday through Saturday. The proposed site is located in the M-
Zone, General Industrial. The project is categorically exempt from CEQA because it is an
existing facility as described in Section 15301.
It is recommended that a public hearing for this conditional use permit be held on May
21, 2007
