Resolution No. 93231 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9323 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON SUPPORTING ORANGELINE MAGLEV STATION AREA DEVELOPMENT POLICIES AND THE MAGLEV NOVEMBER 21, 2006 PROPOSAWAPPLICATION TO THE CALIFORNIA TRANSPORTATION COMMISSION AND AUTHORIZING SUCH OTHER MATTERS AS DEEMED NECESSARY WHEREAS, on August 27, 2003, the City Council of the City of Vernon adopted Resolution No. 8267 approving a Joint Exercise of Powers Agreement creating the Orangeline Development Authority (the "Authority"), a Joint Powers Agency and approving the City's participation as a voting member in the Authority; and WHEREAS, the Authority was established to deploy the Orangeline high-speed maglev system in Southern California; and WHEREAS, the City has given careful consideration to the Milestone 7 - Orangeline Maglev Station Area Development report prepared by the Authority and the Authority's development partner, ARCADIS, and presented to the Authority Board of Directors on August 9, 2006, and then duly reported to the City; and WHEREAS, the City has given careful consideration to the Orangeline Maglev Proposal/Application to the California Transportation Commission presented by the Authority and the Authority's development partner, ARCADIS, at the regular meeting of April 2, 2007; and WHEREAS, the City desires to authorize its Finance Director to serve as the Authority's Treasurer for the 2007-2008 fiscal year. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: 1 SECTION 1: The City Council of the City of Vernon hereby 2 finds and determines that the recitals contained hereinabove are true 3 and correct. 4 SECTION 2: The City Council of the City of Vernon generally'', 5 supports the concepts for Orangeline Maglev station area development 6 described in the Milestone 7 report. 7 SECTION 3: The City Council of the City of Vernon supports 8 the recommendation in the Milestone 7 report that the City of Vernon, 9 along with other member agencies of the Authority, undertake a program 10 to review and update its land use plans, including the General Plan, 11 to incorporate those policy recommendations contained in the Milestone 12 7 report that the City Council believes are appropriate for the City 13 of Vernon. 14 SECTION 4: The City Council of the City of Vernon hereby 15 directs the City Administrator, or his designee, to report to the City 16 Council with recommendations for implementing a program to update the 17 City's planning documents as proposed in the Authority-ARCADIS 18 Milestone 7 report, including budget, funding sources, and schedule. 19 SECTION 5: The City Council of the City of Vernon supports 20 the Proposal/Application submitted to the California Transportation 21 Commission by the Authority on November 21, 2006, which seeks a loan 22 guarantee of up to $200 million for the next Orangeline Maglev project 23 development phase_ 24 SECTION 6: The City Council of the City of Vernon urges the 25 State of California to provide additional support to facilitate the 26 next phase of project development (including Environmental Impact 27 Report and Community Outreach) of the Orangeline Maglev, to attract 28 private investment in the project, and to expedite the project's 1 2 3 4 5 6 7 8 9 10' 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 timely development and completion. SECTION 7: The City Council of ,the City of Vernon hereby directs the City Administrator, or his designee, to communicate the City Council's action to the Authority and to the City's state and federal representatives. SECTION 8: The City Council of the City of Vernon hereby authorizes the City's Finance Director to serve as the Authority's Treasurer for the 2007-2008 fiscal year and to so serve without any additional compensation. SECTION 9: The City Council of the City of Vernon hereby authorizes the City Administrator, or his designee, to take any action deemed necessary to carry out or to perform such other acts and deeds, as may be necessary or convenient to effect the purposes of this Resolution and the transactions herein authorized. SECTION 10: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect.
