Resolution No. 93251 2 3 4 5 6 7 8 X 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9325 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ESTABLISHING HEALTH PERMIT, HAZARDOUS MATERIALS ESTABLISHMENT PERMIT, AND APPLICATION FEES FOR PERMITS GRANTED BY THE CITY OF VERNON PURSUANT TO SECTIONS 11.9.4, 13.7, 13.31, 13.53, 25.12, AND 25.13-6 OF THE VERNON CITY CODE AND REPEALING RESOLUTION NO. 8768 WHEREAS, Sections 11.9.4, 13.7, 13.31, 25.12, and 25.13-6 of the Vernon City Code provide for the issuance of health permits for various types of businesses, vehicles, facilities and uses; and WHEREAS, Section 13.53 to the Vernon City Code provides for the issuance of permits for hazardous materials establishments; and WHEREAS, Sections 11.9.4, 13.8, 13.34, 13.55, and 25.12-4 of the Vernon City Code provide that the City Council of the City of Vernon shall establish health permit fees, hazardous materials establishment permit fees, and application fees therefor by resolution; land WHEREAS, on June 7, 2006, the City Council of the City of Vernon adopted Resolution No. 9058 establishing health permit fees, hazardous materials establishment permit fees, and application fees in accordance with the Vernon City Code; and WHEREAS, the amount of the fees do not exceed the reasonable cost of providing the services necessary to the activity for which the fees are charged; and WHEREAS, the fees are not levied for unrelated revenue purposes; and WHEREAS, the Director of Health & Environmental Control has recommended that health permit fees be increased effective July 1, r 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2007, in order to make the fees established by Resolution No. 9325 consistent with the fee structure used by other jurisdictions for similar services and to account for the effects of the Consumer Price Index changes; and WHEREAS, a notice of the public hearing was posted on May 24, 2007; and WHEREAS, the City Council of the City of Vernon held a duly noticed public hearing in this matter on June 5, 2007, at which time all interested persons were given an opportunity to be heard; and WHEREAS, the City Council has heard and considered all evidence, both written and oral, presented in consideration of the establishment of health permit, hazardous materials establishment permit, and application fees for permits; and WHEREAS, the City Council of the City of Vernon intends to establish new fees for such categories as set forth herein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true land correct. SECTION 4: The City Council of the City of Vernon hereby establishes the following issuance fees and annual renewal fees for permits granted by the City of Vernon pursuant to Section 13.34 of the Vernon City Code: - 4 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19' 20 21 22 23 24 25 26 27 28 TYPE OF BUSINESS OR VEHICLE ANNUAL FEE (a) Underground Hazardous Substances Storage Facility $76 (b) Annual Tank Operating Permit $84 per tank (not to exceed $420 per facility) SECTION 5: The City Council of the City of Vernon hereby establishes the following permit and application fees for hazardous materials establishments pursuant to Section 13.55 of the Code of the City of Vernon: DESCRIPTION FEE APPLICATION FEE (one time) PERMIT FEE (initial and renewal): Class A: Handling of less than 100 kilograms (220 lbs.) of hazardous materials per month; or less than 1 kilogram (2.2 lbs.) of extremely hazardous waste per month. Class B: Handling of 100 kilograms (220 lbs.) to 1,000 kilograms (2,200 lbs.) of hazardous materials per month; or 1 kilogram (2.2 lbs.) to 10 kilograms (22 lbs.) of extremely hazardous waste per month. Class C: Handling of over 1,000 kilograms (2,220 lbs.) of hazardous materials per month; or over 10 kilograms (22 lbs.) of extremely hazardous waste per month. $357 $119 $357 $592 CERTIFICATE OF CLOSURE $357 For the purpose of determining the above fees, 1 gallon (3.79 liters) of liquid shall be equivalent to 7 pounds (3.18 kilograms). Establishments which have hazardous substances stored in underground storage tanks, for which a valid operating permit has been issued by - 5 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 the City of Vernon, shall be exempt from including the volume of the underground storage capacity when determining the permit fee classification for a hazardous materials establishment. SECTION 6: The City Council of the City of Vernon hereby establishes the following application fees, fee for filing an appeal, and fee to amend a well permit granted by the City of Vernon pursuant to Section 25.12-4 of the Vernon City Code: TYPE OF BUSINESS OR VEHICLE ANNUAL FEE (a) Drilling a water well or destroying or converting an existing water well $246 (b) Drilling a monitoring well $148 (c) Repairing/modifying a well $122 SECTION 7: Delinquent fees shall be subject to the penalties set forth in Vernon City Code Sections 13.15, 13.34, 13.55(b), or 25.12-1, as applicable. SECTION 8: In addition to the foregoing, the licensee or permittee shall pay all other necessary fees or deposits which may be required by other ordinances or resolutions of the City of Vernon or applicable State law. R32S Annually we evaluate the Health Department's permit fee schedule through a process of reviewing program costs and revenues, determining the consumer price index (CPI) changes for the preceding year, and comparing Vernon health permit fees with the fees of other local environmental health jurisdictions (Los Angeles and Orange Counties, and the Cities of Long Beach and Pasadena). The process is intended to assess the department's financial balance, consider inflationary aspects, and identify significant disparities between Vernon's fees and the fees charged by the other local jurisdictions. In the past, when program costs changed significantly or large disparities were noted with other local jurisdictions, we have requested the adjustment of fees to levels that were appropriate, yet remained slightly below those of other jurisdictions. Past requests resulted in having our health permit fees increased by 7% in 2006, 8% in 2005 and 5% in 2004. This year's review generated the following results: Health Department operational expenditures and funding for Fiscal Year (F)() 06-07 Expenditures as of 4-30-07 (83.3% of year) $882,367 Expected expenditures to complete FY 06-07 (16.7%) 17$ 6,473 Total expected expenditures for FY 06-07 $1,058,840 Permit Fee Revenue collected $54.9,047 Grants $25,000 Total Fees and Grants $574,047 Balance <$484,793> The balance indicates that the Health Department's operations are underfunded by 46%. However, it should be noted that there is additional revenue (Solid Waste Hauler Franchise fees) that is collected by the Health Department that is not directly related to inspection services. In addition, there are other fees (Hazardous Waste and Solid Waste Business License fees) that are deposited in the General Fund because the City maintains a Health Department. The following is a listing of significant amounts of non -operational yearly revenues that are related to the Health Department, but go directly into the General Fund: Solid Waste Hauler Franchise Fees $900,000 Fund 60 Business License Tax (Haz. Waste) $23,000(Health portion) Solid Waste Processing Business License Tax $280,000 Consumer Price Index (CPI) Publications indicate the CPI during the last year increased by 3.8%. Fee Comparison with Other Local Jurisdictions A chart showing how our fees compare with other local jurisdictions is attached. The chart shows that other jurisdictions consistently have higher fees. Informal discussions with several administrators from these jurisdictions indicate that they are forecasting a 10% increase in their fees this year. Recommendation After considering all the factors in this year's review, I recommend a 5% increase this year is to incrementally address the underfunding of Health Department operations. The new fees can be reasonably applied to Vernon businesses, and stay within mandated guidelines that limit permit fees for certain programs to actual costs of providing the programs. I am including a table showing our current fees and the proposed increased fees for the coming fiscal year. A copy of the previous fee resolution is also attached. The effective date of the new fees would be July 1, 2007. In order to have the proposed fees approved, a public hearing is required. Please advise me of an appropriate date for the public hearing before the City Council. Once a schedule is established, our department will proceed with public posting and publication. Addt'I monitoring 116/repairing/ conversion well modifying mt.excel/H DPerm itFees FY06-07 Page 2 of 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9058 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ESTABLISHING HEALTH PERMIT, HAZARDOUS MATERIALS ESTABLISHMENT PERMIT, AND APPLICATION FEES FOR PERMITS GRANTED BY THE CITY OF VERNON PURSUANT TO SECTIONS 11.9.4, 13.7, 13.31, 13.53, 25.12, AND 25.13-6 OF THE VERNON CITY CODE AND REPEALING RESOLUTION NO. 8768 WHEREAS, Sections 11.9.4, 13.7, 13.31, 25.12, and 25.13-6 of the Vernon City Code provide for the issuance of health permits for various types of businesses, vehicles, facilities and uses; and WHEREAS, Section 13.53 to the Vernon City Code provides for the issuance of Permits for hazardous materials establishments; and WHEREAS, Sections 11.9.4, 13.8, 13.34, 13.55, and 25.12-4 of the Vernon City Code provide that the City Council of the City of Vernon shall establish health permit fees, hazardous materials establishment permit fees, and application fees therefor by resolution; and WHEREAS, on June 29, 2005, the City Council of the City of Vernon adopted Resolution No. 8768 establishing health permit fees, hazardous materials establishment permit fees, and application fees in accordance with the Vernon City Code; and WHEREAS, the amount of the fees do not exceed the reasonable cost of providing the services necessary to the activity for which the fees are charged; and WHEREAS, the fees are not levied for unrelated revenue purposes; and WHEREAS, the Director of Environmental Health has recommended that health permit fees be increased effective July 1, 2006, in order e 1 to make the fees established by Resolution No. 9058 consistent with the 2 fee structure used by other jurisdictions for similar services and to 3 account for the effects of the Consumer Price Index changes; and 4 WHEREAS, a notice of the public hearing was posted on 5 May 23, 2006, and published on May 15, 2006 and May 22, 2006, in a 6 newspaper of general circulation and in a manner consistent with the 7 requirements of Government Code Section 6066; and 8 WHEREAS, the City Council of the City of Vernon held a duly 9 noticed public hearing in this matter on June 7, 2006, at which time 10 all interested persons were given an opportunity to be heard; and 11 WHEREAS, the City Council has heard and considered all 12 evidence, both written and oral, presented in consideration of the 13 establishment of health permit, hazardous materials establishment 14 permit, and application fees for permits; and 15 WHEREAS, the City Council of the City of Vernon intends to 16 establish new fees for such categories as set forth herein. 17 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 18 CITY OF VERNON AS FOLLOWS: 19 SECTION 1: The City Council of the City of Vernon hereby 20 finds and determines that the recitals contained hereinabove are true 21 and correct. 22 SECTION 2: The City Council of the City of Vernon further 23 finds that all persons have had an opportunity to be heard or to file 24 written comments to the proposed establishment of health permit, 25 hazardous materials establishment permit, and application fees for 26 permits, and after due consideration of any and all evidence submitted 27 at the public hearing determines that there are compelling reasons to 28 justify the establishment of the fees. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 3: The City Council of the City of Vernon hereby establishes the following issuance fees and annual renewal fees for permits granted by the City of Vernon pursuant to Section 13.8 of the Vernon City Code: TYPE OF BUSINESS OR VEHICLE ANNUAL FEE (a) Caterer $235 (or $81 per day) (b) Commercial Agricultural Operation $153 (c) Commissary $561 (d) Food Processing Establishment (1) Less than 2,000 sq.ft. $363 (2) 2,000 sq.ft. or more $742 (e) Food Vending Machine Business $29 per machine (f) Food Warehouse $286 (g) Garment Manufacturing Establishment $240 (h) Laundry (including vehicles operating from the City of Vernon) (i) Laundry Vehicle (independent and from outside the City of Vernon) (j) Liquid Waste Pumping Vehicle (k) Mobile Food Facility (1) Whole Produce (RFVV) (2) Prepackaged Food (CART) ( 3 ) Ret . Class B: Handling of 100 kilograms (220 lbs.) to 1,OOO kilograms (2,200 lbs.) of hazardous materials per month; or 1 kilogram (2.2 lbs.) to 10 kilograms (22 lbs.) of extremely hazardous waste per month. Class C: Handling of over 1,000 kilograms (2,220 lbs.) of hazardous materials per month; or over 10 kilograms (22 lbs.) of extremely hazardous waste per month. $340 $113 $340 $564 CERTIFICATE OF CLOSURE $340 For the purpose of determining the above fees, 1 gallon (3.79 liters) of liquid shall be equivalent to 7 pounds (3.18 kilograms). SECTION 6: The City Council of the City of Vernon hereby establishes the following application fees, fee for filing an appeal, and fee to amend a well permit granted by the City of Vernon pursuant to Section 25.12-4 of the Vernon City Code: TYPE OF BUSINESS OR VEHICLE ANNUAL FEE (a) Drilling a water well or destroying or converting an existing water well $234 (b) Drilling a monitoring well $141 (c) Repairing/modifying a well $116 SECTION 7: Delinquent fees shall be subject to the penalties set forth in Vernon City Code Sections 13.15, 13.34, 13.55(b), or 25.12-1, as applicable. SECTION 8: In addition to the foregoing, the licensee or permittee shall pay all other necessary fees or deposits which may be required by other ordinances or resolutions of the City of Vernon or applicable State law.
