Resolution No. 93261 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9326 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A GRANT APPLICATION UNDER THE CALIFORNIA BEVERAGE CONTAINER RECYCLING AND LITTER REDUCTION ACT TO THE DEPARTMENT OF CONSERVATION'S DIVISION OF RECYCLING WHEREAS, the State of California has enacted the California Beverage Container Recycling and Litter Reduction Act that provides funds to the cities and counties for beverage container recycling and litter cleanup activities; and WHEREAS, the California Department of Conservation's Division of Recycling has been delegated the responsibility for the administration of the program within the State and setting up necessary procedures for cities and counties or their designees under the program; and WHEREAS, the City of Vernon has applied for grant funds under the program since May of 2000; and WHEREAS, the California Department of Conservation has announced that the City of Vernon is eligible for Five Thousand Dollars and No Cents ($5,000.00) in grant funds over fiscal year 2007- 2008; and WHEREAS, pursuant to Section 14581(a)(4)(E) of the California Beverage Container Recycling and Litter Reduction Act, the eligible participant must submit a Funding Request Form by a certain due date in order to request funds from the Department of Conservation's Division of Recycling; and WHEREAS, by memo dated May 7, 2007, the Director of Health & Environmental Control recommended that the application for the Beverage 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Container Recycling and Litter Reduction grant funds be approved and executed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby approves and authorizes the electronic submittal of the "City/County Funding Request Form (FRF) FY 2007/2008" ("Form"), in substantially the same form as the copy which is attached hereto as Exhibit A and incorporated by reference, to the Department of Conservation's Division of Recycling for all available grant funds under the California Beverage Container Recycling and Litter Reduction Act for the period governing the grant program. SECTION 3: The City Council of the City of Vernon hereby authorizes the Director of Health & Environmental Control to electronically execute said Form for, and on behalf of, the City of Vernon. SECTION 4: The Director of Health & Environmental Control is hereby authorized and empowered to execute all forms necessary to secure, implement and carry out the purposes specified in Section 14581(a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act and to provide information regarding this program to the Department of Conservation's Division of Recycling, upon request. SECTION 5: The City Council of the City of Vernon hereby directs the City Clerk, or her designee, to submit a fully executed - 2 - F 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Form prior to June 30, 2007 to the California Department of Conservation, Division of Recycling. SECTION 6: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. As a result of that application and subsequent applications, the California Department of Conservation has annually approved $5,000 grants to the City of Vernon. We have used the grants to promote and distribute recycling and litter reduction information to businesses in the City and at the Vernon Elementary School. The California Department of Conservation has announced that, pursuant to Sectio' 14581(a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act, the City f Vernon is eligible for $5,000 in grant funds for fiscal year 2007-2008. Because litter is an ongoi problem in our city as well as in neighboring communities, we are proposing to apply for the grant funds and utilize them to develop and distribute public information items as well as to purchase products to promote recycling. The public information efforts would be similar to those used in the Used Oil Recycling Program that has been very successful for the past several years. With your concurrence, I am recommending that the City Council authorize the application for the Beverage Container Recycling and Litter Reduction Grant Funds. For your consideration, I am attaching the completed application, which we will submit electronically, and a partially edited copy of the previous resolution for reference (a copy of the resolution is no longer required for submittal). Please note that the completed application must be received by the Department of Conservation by Thursday June 30, 2007. Please have the document returned to our department for submission to the Department of Conservation. If the Department of Conservation approves our grant, I propose to continue to utilize the services of K.J Services for the Beverage Container Program.
