A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON GRANTING A VARIANCE TO BCBG MAXAZRIA GROUP,
INC FROM SECTION 26.4.2-8(b) OF THE COMPREHENSIVE
ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 4701
SANTA-FE AVENUE IN THE CITY OF VERNON
WHEREAS, BCBG Maxazria Group, Inc (hereinafter referred to as
"BCBG") is an apparel manufacturer in the City of Vernon; and
WHEREAS, BCBG is requesting a variance from Section 26.4.2-
8(b) of the Comprehensive Zoning Ordinance; and
WHEREAS, 4701 Santa Fe Avenue is located in the CM -Zone,
Commercial Industrial and the operation is consistent with the
objectives of the General Plan and Comprehensive Zoning Ordinance; and
WHEREAS, BCBG proposes to occupy the entire building at 4701
Santa Fe Avenue as an accessory warehouse, however, a portion of the
building has been vacant for more than one year which will require it
to be brought into compliance with the automobile and truck parking;
and
WHEREAS, Section 26.4.2-8(b) allows the parking facilities to
be on the same lot as the occupant or on a separate lot or parcel
located within one thousand (1,000) feet from the main building; and
WHEREAS, when parking is on a separate lot, a covenant is to
be recorded restricting the use of the property to parking for the
benefit of the use requiring the parking; and
WHEREAS, BCBG has leased a separate lot located at 2651 45th
Street from 45th Street, LLC, for the required automobile and truck
parking spaces; and

WHEREAS, 45th Street, LLC does not desire to execute a
covenant restricting the use of its property; and
WHEREAS, given the physical conditions of the property,
strict compliance with Section 26.4.2-8(b) would force BCBG to
demolish portions of its existing facility in order to provide
additional required automobile and truck parking thus creating an
unreasonable hardship; and
WHEREAS, Section 26.5.1-6 permits the City Council to grant
variances from the Comprehensive Zoning Ordinance; and
WHEREAS, a variance relieving BCBG from the covenant
recordation requirement will not adversely affect the interest of the
public or the interest of other residents and property owners within
the vicinity of the premises because this requirement is a mechanism
of ensuring the parking restrictions and does not affect the actual
parking requirements; and
WHEREAS, BCBG proposes to pave and stripe the leased lot and
provide 145 automobile parking spaces and 15 truck parking spaces; and
WHEREAS, BCBG has agreed to cease operations and/or reduce
the size of the operation as determined by the City of Vernon so that
sufficient parking is provided or provide alternative parking within
1,000 feet of the subject site if its lease with 45thStreet, LLC
should expire or terminate for any reason; and
WHEREAS, with the approval of this variance, BCBG will bring
its nonconforming automobile and truck parking spaces into compliance
and its facility will then meet the number of automobile and truck
parking spaces required by Section 26.4.2-6 of the Comprehensive
Zoning Ordinance and is consistent with the objectives of the General
Plan and the Zoning Ordinance; and

WHEREAS, the granting of a variance will not constitute a
11granting of a special privilege inconsistent with the limitations on
other nearby properties but will allow BCBG to use the parking option
in Section 26.4.2-8(b) as other property owners would be able to do;
11 and
WHEREAS, the existing use does not and will not adversely
I1affect the surrounding area because the site has historically been
used for manufacturing and warehousing; and
WHEREAS, the project is categorically exempt from the
California Environmental Quality Act pursuant to Section 15301; and
WHEREAS, the City Council has received a Staff Report dated
June 5, 2007, upon which it has relied in making the foregoing
recitals; and
WHEREAS, the City Council of the City of Vernon held a
hearing on said application for a variance on June 19, 2007; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: Section 26.4.2-8(b) of the Comprehensive Zoning
Ordinance, requiring covenant recordation and full compliance with the
Comprehensive Zoning Ordinance at the time of any expansion of use.
SECTION 3: The variance from the requirement of Section
26.4.2-8(b) is granted subject to the following conditions:
a) The facility shall be operated in accordance with all current
codes, rules, and regulations and subject to permit fees as
adopted by the City of Vernon.

The facility shall be operated in a manner that will prevent

unsanitary conditions, odors or other nuisances.

c)
All parking and loading areas necessary for BCBG operations
4
shall be paved with a hard durable surface material and shall
5
be adequately drained, and kept free of dust, mud, trash and
6
weeds. Where parking or maneuvering areas adjoin the public
7
street, a barrier wall or landscaping shall be maintained to
8
meet City standards. Adequate on -site parking shall be
9
maintained so that no on -street parking or staging will occur.

d)
The project shall be maintained substantially in compliance
11
with the site plan submitted, as part of this variance
12
application.

e)
BCBG shall maintain a lease with 45th Street, LLC to provide
14
the parking in conformance with the City Code. If the lease
15
expires or is terminated for any reason, BCBG shall either
16
cease operation, reduce the size of the operation as
17
determined by the City of Vernon so that sufficient parking is
18
provided or provide substitute parking at a location within
19
one thousand feet walking distance and which site and parking
20
configuration shall be approved by the Director of Community
21
Services & Water.

f)
BCBG shall maintain adequate shuttle service between the
23
subject properties (4701 Santa Fe Avenue & 2651 45th Street) so
24
that no employee/person shall have to wait in excess of 30
25
minutes to be transported between the sites.

SECTION 4: Noncompliance with these conditions or upon any
change in use or occupancy shall constitute sufficient grounds for the
City Council of the City of Vernon to void this variance and require
the strict application of Section 26.4.2-8(b) of the Comprehensive
Zoning Ordinance.
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.

BCBG Maxazria Group, Inc has requested a variance from the Comprehensive
Zoning Ordinance Section 26.4.2-8(b) for the property located at 4701 Santa Fe Avenue in
the City of Vernon. The variance is to allow parking to be provided on a separate lot within
one thousand feet from the main building.
After review of the application by the Community Services Department, it is
recommended that the variance application permit be granted.

VARIANCE APPLICATION
June 5, 2007
BCBG Maxazria Group, Inc (`BCBG") an apparel manufacturer and distributor,
has requested a variance from Section 26.4.2-8(b) of the Comprehensive Zoning
Ordinance, Development Standards. BCBG is in the process of occupying the entire
building at 4701 Santa Fe Avenue, approximately 224,854 square feet in size. However, a
portion of this building (The 2nd Floor — approx. 112,427 sq. ft.) has been vacant for more
than one year. So in order to occupy the entire building as an accessory warehouse it must
be brought into compliance with all the current codes, which includes automobile
parking, truck parking, loading, and maneuvering. Pursuant to Section 26.4.6-7 of the
Comprehensive Zoning Ordinance of the City of Vernon requires that if a non-
conforming building or any portion of a non -conforming building is left vacant for a
continuous period of at least one year, then it shall not thereafter be occupied except in
the case that it has been brought into conformity with all of the regulations of the zone
which it is located.
Due to the space constraints within the existing lot, the current parking
requirements would force BCBG to demolish portions of its building in order to meet the
current parking and loading requirements. According to the current parking requirements,
230 parking stalls and 25 trucks stalls are required by the Code. The subject site can only

provide 85 parking stalls, and 10 truck stalls, which is 145 parking stalls short and 15
truck stalls short from the requirements. However, BCBG has obtained a lease from a
property owner at 2651 45 b Street, which will allow them to provide the requisite number
of parking spaces and therefore is requesting a variance from Section 26.4.2-8(b) of the
municipal code.
REASON FOR VARIANCE
BCBG is proposing to expand its operations by acquiring an additional building.
The property site is located at 4701 Santa Fe Avenue. This building will be used as an
accessory warehouse for their existing manufacturing facility. The accessory warehouse
will operate as an integral part of BCBG's manufacturing process and store goods
produced in the City.
As previously mentioned, a portion of this building (The 2nd Floor — approx.
112,427 sq. ft.) has been vacant for more than one year. In order to occupy the entire
building as an accessory warehouse it must be brought into compliance with all the
current codes, which includes automobile parking, truck parking, loading, and
maneuvering. Due to the space constraints on their existing lot, the possibility of
providing additional parking is remote without the demolition of onsite improvements.
However, BCBG has obtained a lease from a property owner at 2651 45`" Street, which
will allow them to provide the requisite number of parking spaces and BCBG is therefore
requesting a variance from Section 26.4.2-8(b) of the municipal code.

VARIANCE METHODOLOGY
BCBG is requesting a variance from the covenant recordation requirement and
distance requirement of Section 26.4.2-8(b) of the Comprehensive Zoning Ordinance.
Section 26.4.2-8(b) states that all required parking facilities shall be located on the same
parcel or lot as the use or occupancy for which the parking is being provided or such
required parking facilities may be provided on a separate parcel or lot. If provided on a
separate lot or parcel, a covenant shall be recorded restricting the use of the property to
parking use for the benefit of the use requiring the parking. Such separate parcel shall be
within one thousand (1,000) feet from the main building or use, measured as walking
distance from such building to the main entrance of the parking facility, and evidence
shall be filed with the City of Vernon assuring the use of such parcel is limited to parking
purposes in connection with that particular use or occupancy requiring the parking so long
as such use exists. BCBG is proposing to use a separate parcel that it is leasing at 2651
45t' Street for the location of required automobile parking and truck parking. The
property owner at 2651 45t' Street will not execute a covenant restricting the use of its
property to parking. BCBG has indicated that if it loses its lease, then BCBG is prepared
to acquire additional land for parking or remove a portion of the structure at 4701 Santa
Fe Avenue to meet the parking requirements.
PARKING ANALYSIS
The property site is a preexisting site that was constructed in accordance to
development standards when it was originally constructed. BCBG is proposing to occupy

the entire building as an accessory warehouse. However, a portion of the building has
been vacant for a continuous period of more than one year and therefore it is required to
come into complete compliance with the automobile parking, truck parking, truck
loading, and maneuvering requirements of the current City of Vernon Comprehensive
Zoning Ordinance. BCBG has obtained a lease from a property, which will allow them to
provide the requisite number of parking spaces.
The amount of parking spaces required by the Vernon Code is 230 and the amount
of truck spaces required is 25 spaces. BCBG will be providing 10 truck stalls and 85
parking spaces. One hundred forty-five (145) automobile parking spaces and 15 truck
parking stalls will be located in a separate parcel. As previously mentioned, BCBG has
obtained a lease from the property owner at 2651 45"' Street, which will allow them to
provide the requisite number of parking spaces. The lot is located approximately 2,500
feet as measured along the road from 4701 Santa Fe Avenue. Shuttle services will be
provided by BCBG.
The City's parking requirements are based, in part, on the type of use to which the
building is being put. Industrial and manufacturing uses, warehouses, wholesale uses,
public facilities and similar uses require one space per 1,000 square feet of gross floor
area for automobiles. VCC Sec. 26.4.2-6. Retail and commercial uses, general offices,
and similar uses other than set forth in the code or any other uses not defined or specified
require one space per 500 square feet of gross floor area for automobiles. Id. Floor area
is defined as "the total of all floors contained within the exterior walls of all buildings

measured by the exterior dimensions of the building, on a lot or parcel of land." VCC
26.2.6.
In addition, according to Section 26.4.2-8(b) of the Comprehensive Zoning
Ordinance, parking spaces may be provided for on a separate lot within one thousand
(1,000) feet from the main building. The code requires a covenant to be recorded
restricting the property to parking for the benefit of the subject lot. BCBG has entered
into an agreement to lease parking on the separate lot. The owner of the property that will
provide the parking spaces does not want to record a covenant.
CEQA REVIEW
The proposed site is surrounded by industrial uses compatible with the proposed
operation. No potentially significant impacts are expected to result from noise, odor, dust,
smoke, light or glare from the project. The project is categorically exempt under Section
15301 of the California Environmental Quality Act because it is an existing facility. A
Notice of Exemption will be prepared and filed with the County Clerk.
STAFF FINDING AND CONDITIONS
Staff proposes the following findings as required by Section 26.5.1-6, of the City
of Vernon Comprehensive Zoning Ordinance:
a) As previously mentioned BCBG has acquired a building located at 4701
Santa Fe Avenue, approximately 224,854 square feet in size. The building will be used as
an accessory warehouse. A portion of the building has been vacant for a continuous
period of more than one year and therefore it is required to come into complete

compliance with the automobile parking, truck parking, truck loading, and maneuvering
requirements of the current City of Vernon Comprehensive Zoning Ordinance. Due to
space constraints within the existing lot, the parking and maneuvering cannot fully be
provided for on the 4701 Santa Fe Avenue property without demolition of existing
improvements. BCBG has been unable to acquire additional land for parking but has been
able to lease a separate lot for parking. Strict compliance with the City's automobile
parking and truck parking requirements would force BCBG to demolish portions of the
existing facility in order to provide additional required parking spaces.
Alternatively, Section 26.4.2-8(b) of the Comprehensive Zoning Ordinance
permits the use of a separate parcel for required automobile parking if the parcel or lot is
within 1,000 feet of the main building or use, a covenant restricting parking be recorded
or evidence of the parking restriction be provided to the City so long as the use exists.
BCBG proposes to use a separate parcel for required automobile parking. The separate lot
is owned by 45 h Street, LLC and they will not allow the recordation of a covenant
restricting the land for parking use. BCBG will enter into a lease agreement for the
property and agrees to use the land for automobile parking and truck parking. BCBG also
agrees to obtain parking and comply with the automobile and truck parking requirements
in the event it should lose its lease. Granting BCBG a variance from the covenant
recordation requirement of Section 26.4.2-8(b) is appropriate given the unique
circumstances and the hardship of following strict compliance with the automobile
parking requirements.

b) A variance relieving BCBG from the covenant recordation requirement will
not adversely affect the interest of the public or the interest of other residents and
property owners within the vicinity of the premises because this variance is a mechanism
of ensuring the automobile and truck parking requirements are met. BCBG has agreed to
obtain parking on a separate lot and shall obtain other automobile and truck parking if it
should lose its lease. In addition BCBG will provide shuttle service between the lots.
c) With the approval of this variance of Section 26.4.2-8(b), BCBG will bring its
nonconforming automobile and truck parking spaces into compliance and its facility will
then meet the number of automobile parking spaces required by the City of Vernon
Comprehensive Zoning Ordinance. The operation is in conformance with the
Comprehensive Zoning Ordinance and the General Plan.
Therefore it is recommended that the variance be granted with the following
conditions imposed on the permit to adequately protect the public interests:
a) The facility shall be operated in accordance with all current codes, rules,
and regulations and subject to permit fees as adopted by the City of Vernon.
b) The facility shall be operated in a manner that will prevent unsanitary
conditions, odors or other nuisances.
c) All parking and loading areas necessary for BCBG operations shall be
striped in an acceptable manner to the Director of Community Services & Water and shall
be paved with a hard durable surface material and shall be adequately drained, and kept
free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the

parking stalls and 25 trucks stalls are required by the Code. The subject site can only
provide 85 parking stalls, and 10 truck stalls, which is 145 parking's short and 15 truck
stalls short from the requirements. However, BCBG has obtained a lease from a property
owner at 2651 45th Street, which will allow them to provide the requisite number of
parking spaces and therefore requesting a variance from Section 26.4.2-8(b) of the
municipal code.
VARIANCE FINDINGS:
1. That special conditions and circumstances exist which are peculiar to the
land, structure, or building involved and which are not generally applicable
to other lands, structures, or buildings in the same vicinity and zone:
The subject lot is approximately 4.05 acres rectangular shape lot on the northwest
corner of Santa Fe Avenue and 48th Street. The building is approximately 224,854
square feet in size. The existing structure covers a large area of the site, rendering
car and truck parking and loading to meet current City requirement difficult. Due
to the existing layout of the building location, the space does not conform to
current development standards. The circumstance of the existing footprint of the
structure is peculiar to this site does not apply to other properties in the same
vicinity and zone.
2. That literal interpretation of the provisions of this ordinance would deprive
the applicant of rights commonly enjoyed by other propertied in the same
vicinity and zone in which the property is located, under the terms of this
chapter:
Due to the large footprint of the existing structure on the site, requiring the car
parking and truck parking and loading to meet the current development standards
would substantially deprive the applicant of rights enjoyed by other properties in
the same vicinity, but denied to the subject.
3. That the special conditions and circumstances do not result from actions of
the applicant:
The building was constructed in accordance to the development standards when it
was originally constructed. The circumstances on the site and building were not
actions of the applicant. BCBG recently purchased the property.
4. That granting the variance requested will not confer on the applicant any
special privilege that is denied by this Chapter to other lands, structures, or
buildings in the same vicinity and zone in which the property is located:
Due to the extenuating existing physical circumstances on the building, the
granting of this variance does in no way constitute any grant of special privilege
to the subject property, but denied to other properties in the same vicinity and
zone.
5. That the granting of such variance will be in harmony and not adversely
affect the Comprehensive General Plan:
The granting of such variance will not adversely affect the City's General Plan.

SUBJECT: Variance — BCBG Maxazria Group, Inc. located at 4701 Santa Fe Avenue
BCBG Maxazria Group, Inc (BCBG) has submitted a complete application for a
variance from Section 26.4.2-8(b) which allows parking to be provided on a separate lot
within one thousand feet from the main building. BCBG is in the process of occupying the
entire building at 4701 Santa Fe Avenue, approximately 224,854 square feet in size.
However, a portion of this building (The 2" Floor — approx. 112,427 sq. ft.) has been vacant
for more than one year. So in order to occupy the entire building as an accessory warehouse it
must be brought into compliance with all the current codes, which includes automobile
parking, truck parking, loading, and maneuvering. Pursuant to Section 26.4.6-7 of the
Comprehensive Zoning Ordinance of the City of Vernon requires that if a non -conforming
building or any portion of a non -conforming building is left vacant for a continuous period of
at least one year, then it shall not thereafter be occupied except in the case that it has been
brought into conformity with all of the regulations of the zone which it is located.
.Due to the space constraints within the existing lot, the current parking requirements
would force BCBG to demolish portions of its building in order to meet the current parking
and loading requirements. According to the current parking requirements, 230 parking stalls
and 25 trucks stalls are required by the Code. The subject site can only provide 85 parking
stalls, and 10 truck stalls, which is 145 parking stalls short and 15 truck stalls short from the
requirements. However, BCBG has obtained a lease from a property owner at 2651 45`t'
Street, which will allow them to provide the requisite number of parking spaces and therefore
is requesting a variance from Section 26.4.2-8(b) of the municipal code
It is recommended that you receive this application and that a public hearing be set for
June 19, 2007.
