Resolution No. 93481 2 3 4 5 Gi 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 J RESOLUTION NO. 9348 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON PROVIDING FOR THE IMPLEMENTATION OF THE CITIZENS OPTION FOR PUBLIC SAFETY (COPS) PROGRAM FOR 2006-2007 WHEREAS, Assembly bill 1913 (AB 1913)(Cardenas) was chaptered into law on September 7, 2000 for supplemental local law enforcement funding pursuant to the bill; and WHEREAS, AB 1913 provides $100,000,000 statewide for the Citizens for Public Safety (COPS) Program; and WHEREAS, the County of Los Angeles has established a Supplemental Law Enforcement Service Fund (SLESF) in accordance with Section 30061 of the Government Code to receive AB 1913 funds which have been allocated for use in Los Angeles County; and WHEREAS, the City has established its own Supplemental Law Enforcement Service Fund (SLESF) in accordance with Section 30061.of the Government Code; and WHEREAS, Assembly Bill 823 (AB 823)(Poochigian) was chaptered into law on April 8, 2002 amending Sections 30061 and 30063 of the Government Code relating to law enforcement funding; and WHEREAS, AB 823 provides that funds received be expended no later than June 30 of the following fiscal year; and WHEREAS, the City of Vernon has participated in the COPS Program since 2001 and receives its share of any funds available for the purpose of ensuring public safety through the procurement of equipment to deter juvenile crime and improving frontline municipal police services and enhancing the effectiveness of its officers; and WHEREAS, by memo dated May 10, 2007, the Chief of Police has 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 !recommended that the Police Department be authorized to purchase equipment, training, and all maintenance associated with the Police Department's canine program and other items as needed in support of future frontline law enforcement needs by using COPS grant funds; and WHEREAS, the City Council has conducted a public hearing to consider 2006-2007 funding requests from the Chief of Police to use COPS grant funds by June 30, 2009 for frontline law enforcement needs, including but not limited to personnel, equipment and programs and shall determine each submitted request as required by AB 823 in order to enhance the effectiveness of its officers. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby directs that the City maintain its own Supplemental Law Enforcement Service Fund (SLESF) as required by AB 823 and State law pursuant to Government Code Sections 30061 and 30063. SECTION 3: The City Council of the City of Vernon finds that all persons have had the opportunity to be heard or to file written comments to the expenditure of 2006-2007 COPS grant funds provided by AB 823, and after due consideration of any and all evidence submitted at the public hearing determines that there are compelling reasons to justify the expenditure of COPS grant funds for the equipment requested by the Chief of Police. SECTION 4: The City Council of the City of Vernon hereby requests that the City's share of the funding be allocated to SLESF - 2 - 1 2, 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 for purposes of frontline law enforcement needs. The use of these funds is for front-line municipal police services and should supplement, not supplant, current front-line law enforcement services. With the recent approval of a plan to implement a Canine Program, the Police Department has . proposed that these funds be used to purchase all necessary equipment, training, r canine maintenance associated with the development of the canine program. I am requesting that the City Council adopt a resolution in support of our continued participation in the Citizen Options for Public Safety (COPS) Fund Program for the fiscal year 2006-2007 and that the funds obtained during this period be used for the purchase of equipment, training and all maintenance associated with the Police Department's canine program and other items as needed in support of front-line law enforcement services. Enclosed is a memo from our Grant Administrator, Cmdr. Daniel Calleros, providing background and analysis of the COPS Grant Program and our proposed use of the funds. Calleros SUBJECT: Use of Citizen Options for Public Safety Program (COPS) Funds BACKGROUND On October 19, 2006, the City of Vernon received $100,000.00 through the Citizen Options for Public Safety Program (COPS) fund provided by Assembly Bill 1913, Chapter 353. This program allows eligible cities, to receive a proportionate share of COPS funds appropriated by the State. The program. began in fiscal year 1996-97 and continues to be funded. The use of these funds is only.for front-line municipal police services and should supplement, not supplant, current front-line law enforcement services. Funds received during fiscal year 2006-07 must be expended or encumbered no later than June 30, 2007. Liquidation of the encumbered funds must be completed no later than June 30, 2009. All related purchases under this grant must be liquidated before the end of the liquidation date. There are no cost -share or match requirements associated with this grant. However, before spending these funds, a public hearing is required. According to information received from the Supplemental Law Enforcement Oversight Committee which oversees the COPS Program, a public hearing for the purposes of this grant can mean a staff report to the City Council outlining what the funding will be spent on and then put on the Council agenda under Public Hearings. It can go as a consent item and then if no one pulls it off the agenda, we have complied with the legislative intent. ANALYSIS With the recent approval for the implementation of a police canine program, the Police Department is requesting to use the available COPS funding towards the purchase of all necessary equipment, training, and canine maintenance associated with the development of a canine program. Lt. Gillman conducted extensive research for the program and identified a start- up cost at approximately $62,361.52. Participation. in this grant has allowed the police department to purchase equipment to improve front-line municipal police services. The development of a canine program will improve police services at reduced costs by utilizing the abilities of specially trained dogs. The incredible sense of smell and the desire to protect, which the dogs possess, enable them to perform several law enforcement functions and reduce the number of police officers otherwise required. Canines are used most often to search buildings and open areas for suspects. They can provide protection to officers and offer an additional level of non -lethal force to apprehend violent suspects. If the proposed grant expense is approved by the City Council, it will be forwarded to the SLESF Oversight Committee for final approval.
