Resolution No. 93841 RESOLUTION NO. 9384 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 4 VERNON FINDING THE CITY OF VERNON TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM 5 (CMP) AND ADOPTING THE CMP LOCAL DEVELOPMENT REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT 6 CODE SECTION 65089 7 8 WHEREAS, the Congestion Management Program ("CMP") statute 9 requires the Los Angeles County Metropolitan Transportation Authority 10 ("LACMTA"), acting as the Congestion Management Agency for Los Angeles 11 County to annually determine that the County and cities within the 12 County are conforming to all CMP requirements; and 13 WHEREAS, the LACMTA requires submittal of the CMP Local 14 Development Report by September 1 of each year; and 15 WHEREAS, the City Council of the City of Vernon held a 16 noticed public hearing on August 27, 2007, at which time all interested 17 persons were given an opportunity to be heard; and 18 WHEREAS, the City Council has heard and considered all 19 evidence, both written and oral, presented respecting Vernon's 20 conformance with the criteria in the CMP as established by the LACMTA. 21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 22 CITY OF VERNON AS FOLLOWS: 23 SECTION 1: The City Council of the City of Vernon hereby 24 finds and determines that the recitals contained hereinabove are true 25 and correct. 26 SECTION 2: The City Council finds and determines that the 27 City of Vernon has taken all of the following actions, and that the 28 City is in conformance with all applicable requirements of the 2004 CMP 1 adopted by the LACMTA Board on July 22, 2004. 2 A• The City of Vernon has locally adopted and continues to 3 implement a transportation demand management ordinance, consistent with 4 the minimum requirements identified in the CMP Transportation Demand 5 Management chapter. 6 B. The City of Vernon has locally adopted and continues to 7 implement a land use analysis program, consistent with the minimum 8 requirements identified in the CMP Land Use Analysis Program chapter. 9 C. SKW/sc STAFF REPORT CONGESTION MANAGEMENT PROGRAM 2007 CONFORMANCE REPORT August 8, 2007 In 1997, the Vernon City Council approved Ordinance No. 1015 adopting a trip reduction and travel demand program in order to implement the Congestion Management Program ("CMP") of the County of Los Angeles. The CMP was designed to alleviate traffic congestion caused by increases in new development. Pursuant to the CMP, each city has been required to self certify that it is in compliance with all elements of the program. Conformance with local CMP requirements is required for jurisdictions to receive their portion of state gas tax revenues allocated by Section 2105 of the California Streets and Highways Code. Failure to comply with the requirements of the program could result in a loss of state and federal funding for transportation projects. The Countywide Deficiency Plan requires local agencies to offset a portion of the impact of new local development has on the regional transportation system. Historically, each local jurisdiction's responsibilities had been tracked through a point system that reflected the impact of local growth ("debits") and benefits of transportation improvements ("credits"), of which cities were required to maintain a positive balance. In recent years, cities have raised concerns regarding this Deficiency Plan approach, citing their difficulty in maintaining conformance and questioning its effectiveness. In 2003, the MTA Board authorized a Short Range Transportation Plan that authorized a nexus study to evaluate the feasibility of implementing a congestion mitigation fee. The fee would help ensure that new growth directly mitigated traffic impacts on the regional transportation system by helping fund needed local transportation improvements. Said fees would mirror mitigation fees implemented in Orange and Riverside Counties. The purpose of the nexus study was to identify and justify a mitigation fee that would meet CMP Deficiency Plan requirements. -1- Since that time no congestion mitigation fees have been implemented, however, while the nexus study continues, local jurisdictions are still required to keep track of and report all new development activity, which represents new net development after subtracting for building permit revocations or demolitions. However, cities will no longer be required to maintain the "positive credit balance" as mentioned above. The study will further evaluate a range of issues raised by the CMP Policy Advisory Committee ("PAC") which includes crafting sub -regional fees that reflect local conditions, acknowledging local traffic impact fees, and streamlining the administration of the program. Because of this change in reporting requirements, a new reporting form has been created called the Local Development Report ("LDR"). Based on the Local Implementation Report from previous reporting cycles, the new form only calls for information on new net development. The calculation of Countywide Deficiency Plan "debits" is not included. Therefore, the City Council is requested to adopt the attached Congestion Management Program Local Development Report, in accordance with California Government Code Section 65089. -2-
