RESOLUTION NO. 9396
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND ADOPTING AN AMENDMENT TO THE
FIRE DEPARTMENT RULES AND REGULATIONS
WHEREAS, by Resolution No. 7066 adopted by the City Council
of the City of Vernon on January 6, 1998, the City Council adopted the
City of Vernon Fire Department Rules and Regulations (the "Rules and
Regulations"); and
WHEREAS, since the adoption of the Rules and Regulations, the
City has adopted revisions or amendments to the Rules and Regulations,
the latest revision being adopted on February 20, 2007 by Resolution
INo. 9239; and
WHEREAS, the Fire Chief has recommended that the Rules and
Regulations be amended to remove sections concerning staffing levels
and overtime procedures as these matters will be handled under Vernon
Fire Department Administrative Directives, in compliance with all City
of Vernon procedures and policies and all State and Federal laws.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon does
hereby find and determine that the recitals contained hereinabove are
true and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves the amendment of the City of Vernon Fire Department Rules and
Regulations by removing Section Q, Overtime Procedures, from Article
III, General Rules & Regulations, Policies & Procedures, pages 38-40.
The Fire Department intends to handle the staff levels and overtime
procedures by Administrative Directive.

SECTION 3: The City Council of the City of Vernon hereby
(declares that all prior drafts of the Fire Department Rules and
Regulations have never been approved, authorized, or in any way
ratified by the City Council and, therefore, have no force or effect.
SECTION 4: The City Council of the City of Vernon hereby
declares that by approving and amending the Rules and Regulations, it
does not intend to create a vested property right for any City employee
in any manner whatsoever, or in any manner obviate the terms and
conditions of the individual employment contracts entered into between
the City and each of its employees.
SECTION 5: To the extent that any provision of the Rules
and Regulations are deemed to be inconsistent with prior City Council
resolutions or ordinances regarding the at -will employment relationship
with its employees, the prior resolutions or ordinances shall prevail.
SECTION 6: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and thereafter
the same shall be in full force and effect.
