Resolution No. 94281 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9428 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE PURCHASE OF ONE 2007 CHEVROLET SILVERADO FOR THE POLICE DEPARTMENT WHEREAS, the Police Department has determined that it needs to replace unit number 65, which is a 1999 Pontiac Grand Prix vehicle, because of the significant cost to repair or replace the damaged engine in said vehicle; and WHEREAS, the Police Department has determined that a 2007 Chevrolet Silverado is the best vehicle to meet its needs; and WHEREAS, the Chief of Police has recommended that authority be granted for the Purchasing Agent, or her designee, to seek formal bids for the purchase of the 2007 Chevrolet Silverado; and WHEREAS, a bid specification for the purchase of the 2007 Chevrolet Silverado has been presented to the City Council of the City of Vernon; and WHEREAS, the City Council of the City of Vernon has determined that it is in the best interests of the City of Vernon that bids be solicited in accordance with the Vernon City Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The bid specification, which is attached hereto as Exhibit A and incorporated by reference, is hereby approved by the City Council of the City of Vernon. I SECTION 3: The City Clerk of the City of Vernon is hereby 2 directed to give notice, in writing, inviting sealed proposals or bids 3 for the purchase of the 2007 Chevrolet Silverado, in accordance with 4 the bid specification, and in accordance with this resolution. 5 SECTION 4: There being no newspaper of general circulation 6 printed, published or circulated in the City of Vernon, the City Clerk 7 is hereby directed to post said notice, or cause the same to be 8 posted, in three of the most public places in the City of Vernon, to 9 wit: the northwest corner of 38th Street and Santa Fe Avenue, the 10 northeast corner of Leonis Boulevard and Pacific Boulevard, and on the 11 bulletin board located outside on the wall near the second floor 12 entrance to the City Hall of said City, located at 4305 Santa Fe 13 Avenue, all in the City of Vernon, County of Los Angeles, State of 14 California. 15 SECTION 5: The City Clerk of the City of Vernon is hereby 16 directed to post said notice forthwith and the first posting of said 17 notice shall be at least ten (10) days before the opening of the bids 18 for the proposed contract. The vehicle shall meet all California State and Federal safety and emissions standards when delivered to the City of Vernon. The successful bidder will submit in detail a final draft of all specifications for final approval by the City of Vernon and the Vernon Police Department prior to purchase. All bids submitted shall include sufficient associated literature as required to fully describe and detail the items under consideration. This should include photographs, performance charts, components list, dimensional drawings, etc. The bidder shall clearly state any changes, exceptions or substitutions of equivalent equipment or materials to these specifications. The successful bidder will arrange to demonstrate a similarly equipped 2007 Chevrolet Silverado prior to purchase. Whenever materials or equipment are specified or described in the specifications by using the name of proprietary item or name of a particular manufacturer, fabricator, supplier of distributor, the name of the item is intended to establish the type, function and quality required. Unless the name is followed by words indicating that no substitution is permitted, materials or equipment of other manufacturers, fabricators, suppliers or distributors may be accepted by the City of Vernon if sufficient information is submitted prior to the purchase by the contractor to allow the City of Vernon to determine that the material or equipment proposed is equivalent to the named. (JAMS). Each party will select an arbitrator. Those two arbitrators will then select a third. The three -member panel will make the final decision. All decisions of the arbitrators shall be in writing, and the arbitrators shall provide written reasons for their decision. The arbitration decision shall be final and binding on the parties. Notwithstanding the foregoing, the parties shall be permitted to access the court system to enforce any arbitration award or to obtain injunctive relief. The exclusive jurisdiction and venue for any such action shall be the Superior Court of California, Los Angeles County. Any and all contracts between Contractor and any subcontractor relating to this Agreement shall include the same arbitration clause. The proposed vehicle was selected because "....it is a desirable vehicle because of the covertness this vehicle affords. It can be used as a surveillance vehicle in surrounding communities without it being identified as a law enforcement vehicle". The detectives often perform surveillance, and it is extremely important to "blend" into the surroundings. The Purchasing Section requests authorization to seek formal bids for the requested vehicle. The department obtained a preliminary proposal from Camino Real Chevrolet, to get an idea of the pricing. The estimated cost of the vehicle is $28,310.00 (does not include sales tax, tire fees or delivery charges). Funds for this purchase have been specifically budgeted and are available. It can be used as a surveillance vehicle in surrounding communities without it being identified as a law enforcement vehicle. One of the functions that detectives carryout on a regular basis are undercover surveillances. The vehicles they use must be able to blend into the surrounding environment for the safety and security of our personnel. Detective Sergeant Rex Hill mentioned that on several occasions, many of the undercover units we currently deploy have been identified as law enforcement vehicles. The vehicle requested blends in easily with vehicles that are found in communities our detectives frequent. Other types of vehicles we have considered, such as the Ford F-150 or the Dodge ram 1500, are not as desirable as a covert vehicle since they are not as popular as the Chevrolet Silverado. We also looked at the Chevrolet Avalanche, however the configuration and cost of that vehicle make it a less desirable option than the Silverado. Attached to this request are the vehicle specifications sheet and a quote from Camino Real Chevrolet. Although we are requesting this specific type of vehicle, we do not have a specific vendor choice. Funds for the purchase of this vehicle have been included in the existing budget.
