RESOLUTION NO. 9428
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING NOTICE INVITING
SEALED PROPOSALS OR BIDS FOR THE PURCHASE OF ONE
2007 CHEVROLET SILVERADO FOR THE POLICE DEPARTMENT
WHEREAS, the Police Department has determined that it needs
to replace unit number 65, which is a 1999 Pontiac Grand Prix vehicle,
because of the significant cost to repair or replace the damaged
engine in said vehicle; and
WHEREAS, the Police Department has determined that a 2007
Chevrolet Silverado is the best vehicle to meet its needs; and
WHEREAS, the Chief of Police has recommended that authority
be granted for the Purchasing Agent, or her designee, to seek formal
bids for the purchase of the 2007 Chevrolet Silverado; and
WHEREAS, a bid specification for the purchase of the 2007
Chevrolet Silverado has been presented to the City Council of the City
of Vernon; and
WHEREAS, the City Council of the City of Vernon has
determined that it is in the best interests of the City of Vernon that
bids be solicited in accordance with the Vernon City Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The bid specification, which is attached hereto
as Exhibit A and incorporated by reference, is hereby approved by the
City Council of the City of Vernon.
I SECTION 3: The City Clerk of the City of Vernon is hereby
2 directed to give notice, in writing, inviting sealed proposals or bids
3 for the purchase of the 2007 Chevrolet Silverado, in accordance with
4 the bid specification, and in accordance with this resolution.
5 SECTION 4: There being no newspaper of general circulation
6 printed, published or circulated in the City of Vernon, the City Clerk
7 is hereby directed to post said notice, or cause the same to be
8 posted, in three of the most public places in the City of Vernon, to
9 wit: the northwest corner of 38th Street and Santa Fe Avenue, the
10 northeast corner of Leonis Boulevard and Pacific Boulevard, and on the
11 bulletin board located outside on the wall near the second floor
12 entrance to the City Hall of said City, located at 4305 Santa Fe
13 Avenue, all in the City of Vernon, County of Los Angeles, State of
14 California.
15 SECTION 5: The City Clerk of the City of Vernon is hereby
16 directed to post said notice forthwith and the first posting of said
17 notice shall be at least ten (10) days before the opening of the bids
18 for the proposed contract. Said notice shall provide that sealed
19 proposals or bids will be received by the City of Vernon at the office
20 of the City Clerk, or her designee, at the City Hall, 4305 Santa Fe
21 Avenue, Vernon, CA 90058-0805.

DETECTIVE VEHICLE
SPECIFICATIONS
GENERAL
The vehicle covered by this specification is for the purchase of a 2007 Chevrolet
Silverado 1500 2WD Crew Cab LS, 4.8L V8 and shall be supplied as specified from the
manufacturers new, unused and latest model complete with all necessary equipment and
accessories.
Camino Real Chevrolet 2401 S. Atlantic Blvd, Monterey Park, Ca 91754 provided the
vehicle information. The contact person is the General Sales Manager, Ed Engle (323)
264-3050 Ext 178.
The vehicle shall be delivered completely assembled and ready to operate. All equipment
normally furnished, as standard shall be included. All separate units or components shall
be new, unused, installed connected and delivered in good operating order.
The subject vehicle shall conform in all respects and be equipped to operate legally on
California State Highways as specified in the California Motor Vehicle Code. The
vehicle shall meet all California State and Federal safety and emissions standards when
delivered to the City of Vernon.
The successful bidder will submit in detail a final draft of all specifications for final
approval by the City of Vernon and the Vernon Police Department prior to purchase.
All bids submitted shall include sufficient associated literature as required to fully
describe and detail the items under consideration. This should include photographs,
performance charts, components list, dimensional drawings, etc. The bidder shall clearly
state any changes, exceptions or substitutions of equivalent equipment or materials to
these specifications.
The successful bidder will arrange to demonstrate a similarly equipped 2007 Chevrolet
Silverado prior to purchase.
Whenever materials or equipment are specified or described in the specifications by using
the name of proprietary item or name of a particular manufacturer, fabricator, supplier of
distributor, the name of the item is intended to establish the type, function and quality
required. Unless the name is followed by words indicating that no substitution is
permitted, materials or equipment of other manufacturers, fabricators, suppliers or
distributors may be accepted by the City of Vernon if sufficient information is submitted
prior to the purchase by the contractor to allow the City of Vernon to determine that the
material or equipment proposed is equivalent to the named. The term "equivalent" as
used in this specification, means "authorized equivalent" and acceptance of the
"equivalent" is subject to the approval of the City of Vernon.
Warranties
The manufacturers warranties on the vehicle and any added equipment shall be delivered
to the City of Vernon without waiver by the city of any recourse under California Law.
Three (3) year / Thirty-six thousand (36,000) miles basic warranty.
Five (5) year / One -hundred thousand (100,000) miles on engine & power train.
Installation:
No installation is needed on this bid.
Inspection:
The bidder shall arrange for pre -delivery inspection and right of refusal by the city of
Vernon Police Department.
Delivery Date
All bidders shall provide a date to deliver the vehicle. It is of utmost concern to the City
of Vernon that the quoted delivery date be met.
Any delay in the delivery shall be immediately reported in writing to the purchasing
agent with a copy to the Police Department representative, Lt. Zack. Any change in the
original quoted delivery date is subject to the approval by the City of Vernon.
The City of Vernon reserves the right to cancel the purchase order for non-performance
of delivery by the quoted date at no cost or obligation to the City of Vernon.
Deliver
The vehicles shall be delivered to 4350 Santa Fe Avenue, Vernon, and CA. 90058. The
vehicle shall be ready for immediate and safe operation, having had completed any
necessary vehicle registration documentation. The invoice, any necessary vehicle
registration documentation, warranty information and manuals must accompany delivery.
Delivery shall be Monday -Thursday from 0800-1400 and a forty-eight (48) hour notice

4. Warranties. CONTRACTOR shall provide, at a minimum, a three (3) year
factory bumper -to -bumper warranty covering parts and labor to begin upon acceptance of the

5. General Provisions.
A. Governing Law. The laws of the State of California shall govern the

6. Entire Agreement. This Contract is the entire agreement of the parties,

and their heirs, successors, and permitted assigns.
8. Forum. Any dispute related to this Contract shall be adjudicated in a state
court serving the County of Los Angeles, California.
9. Arbitration. The parties agree that any and all disputes arising out of or in

relation to this Contract, including without limitation any action in tort, shall be resolved exclusively,
finally and conclusively by arbitration in Los Angeles County, California under the auspices of and
pursuant to the rules of the Judicial Arbitration & Mediation Services Inc. (JAMS). Each party will
select an arbitrator. Those two arbitrators will then select a third. The three -member panel will make
the final decision. All decisions of the arbitrators shall be in writing, and the arbitrators shall provide
written reasons for their decision. The arbitration decision shall be final and binding on the parties.
Notwithstanding the foregoing, the parties shall be permitted to access the court system to enforce any
arbitration award or to obtain injunctive relief. The exclusive jurisdiction and venue for any such action
shall be the Superior Court of California, Los Angeles County. Any and all contracts between
Contractor and any subcontractor relating to this Agreement shall include the same arbitration clause.

Attached for your approval is requisition #0000870. The Police Department is
requesting to purchase (1) 2007 CHEVROLET SILVERADO 1500, 2WD,
CREW CAB LS for use by the Detective unit. The requested unit is to replace
unit #65, which is a 1999 Pontiac Grand Prix. As of September 6, 2007 this unit
has approximately 94,027 miles.
In a memo to me dated September 6, 2007, Capt. James Rodino advised,
"According to Vernon Garage Foreman, Rick Stoykovich, unit #65 also has
significant engine damage (cracked cylinder heads) which necessitates
replacement of the engine. According to Rick, based on the vehicle's mileage;
service history (see attachment); and the cost to replace the engine, replacing the
unit would be the most cost effective option': The existing unit will be listed as
surplus.
The proposed vehicle was selected because "....it is a desirable vehicle because of
the covertness this vehicle affords. It can be used as a surveillance vehicle in
surrounding communities without it being identified as a law enforcement
vehicle". The detectives often perform surveillance, and it is extremely important
to "blend" into the surroundings.
The Purchasing Section requests authorization to seek formal bids for the requested
vehicle. The department obtained a preliminary proposal from Camino Real
Chevrolet, to get an idea of the pricing. The estimated cost of the vehicle is
$28,310.00 (does not include sales tax, tire fees or delivery charges). Funds for
this purchase have been specifically budgeted and are available.

Re: Request Purchase of New Detective Unit
Attached is a request for the purchase of a new detective unit. This unit is intended to replace
detective unit #65 (1999 Pontiac Grand Prix) which now has over 94,027 miles. Unit #65 is currently
assigned to Detective Quinones.
A review of the service history for unit #65 shows that the service costs from 1999 to the present is in
excess of $21,000. According to Vernon Garage Foreman, Rick Stoykovich, unit #65 also has
significant engine damage (cracked cylinder heads) which necessitates replacement of the engine.
According to Rick, based on the vehicle's mileage; service history; and the cost to replace the engine,
replacing the unit would be the most cost effective option.
The vehicle being requested is a 2007 Chevrolet Silverado 1500, 2WD, Crew Cab, LS, V8. Although
this is an atypical vehicle for the detective bureau, it is a desirable vehicle because of the covertness
this vehicle affords. It can be used as a surveillance vehicle in surrounding communities without it being
identified as a law enforcement vehicle.
One of the functions that detectives carryout on a regular basis are undercover surveillances. The
vehicles they use must be able to blend into the surrounding environment for the safety and security of
our personnel. Detective Sergeant Rex Hill mentioned that on several occasions, many of the
undercover units we currently deploy have been identified as law enforcement vehicles. The vehicle
requested blends in easily with vehicles that are found in communities our detectives frequent.
Other types of vehicles we have considered, such as the Ford F-150 or the Dodge ram 1500, are not as
desirable as a covert vehicle since they are not as popular as the Chevrolet Silverado. We also looked
at the Chevrolet Avalanche, however the configuration and cost of that vehicle make it a less desirable
option than the Silverado.
Attached to this request are the vehicle specifications sheet and a quote from Camino Real Chevrolet.
Although we are requesting this specific type of vehicle, we do not have a specific vendor choice.
Funds for the purchase of this vehicle have been included in the existing budget.

NOTICE INVITING SEALED PROPOSALS (BIDS)
NOTICE IS HEREBY GIVEN that the City of Vernon,
(hereinafter "City") invites and will receive sealed proposals (bids) up to
the hour of two o'clock p.m., on October 31, 2007 for the purchase of (1)
2007 Chevrolet Silverado 1500, 2WD, Crew Cab LS, as listed on Bid No.
1447 from the City of Vernon.
At said time, proposals will be publicly opened and
announced at the offices of the City Clerk (Finance). Said bids shall
conform to and be responsive to the bid specifications as called for.
The City Council of the City reserves the right to reject any
