RESOLUTION NO. 9436
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON DISSOLVING, CANCELLING AND TERMINATING ALL
AGREEMENTS WITH ALBRIGHT, YEE & SCHMIT, LLP AND
REPEALING ALL RESOLUTIONS OR PARTS OF RESOLUTIONS
IN CONFLICT THEREWITH
WHEREAS, on November 5, 2003, the City Council of the City of
Vernon adopted Resolution No. 8306 approving a Retainer Agreement (the
"Agreement") with Albright, Yee & Schmit, LLP ("Albright"); and
WHEREAS, Section 6 of the Agreement provides that the
Agreement may be terminated by the City at any time by written notice
effective when received by Albright; and
WHEREAS, the City desires to dissolve, cancel and terminate
all agreements with Albright, including but not limited to the
Agreement with Albright dated November 10, 2003.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
Ifinds and determines that the recitals contained hereinabove are true
land correct.
SECTION 2: The City Council of the City of Vernon hereby
dissolves, cancels and terminates all agreements with Albright,
including but not limited to the Agreement dated November 10, 2003
with Albright effective October 15, 2007.
SECTION 3: The City Council of the City of Vernon hereby
authorizes the City Attorney to provide a notice of termination to
Albright and to instruct Albright to cease providing any services as
of the date of the notice and to incur no further expenses.
1 SECTION 4: The City Council of the City of Vernon hereby
2 authorizes the City to pay Albright for his services pursuant to the
3 Agreement.
4 SECTION 5: The City Clerk of the City of Vernon shall
5 certify to the passage of this resolution, and thereupon and
6 thereafter the same shall be in full force and effect.
7 APPROVED AND ADOPTED this 15th day of October, 2007.
