Resolution No. 94621 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9462 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING A LOT LINE ADJUSTMENT REQUESTED BY DYNAMIC BUILDERS INC. FOR 3200 AND 3185 WASHINGTON BOULEVARD WHEREAS, Dynamic Builders Inc. is the owner of two adjoining parcels of land (Parcel No. 5169-023-014 and 5169-023-015) located at 3200 Washington Boulevard partly in the City of Vernon and partly in the City of Los Angeles, and the Merco Group, who is the owner of one parcel of land (Parcel No. 5169-023-012) located at 3185 Washington Boulevard partly in the City of Vernon and partly in the City of Los Angeles, all as described and shown on the attached Exhibit "A" consisting of three (3) pages which are incorporated herein by this reference as though fully set forth at length; and WHEREAS, Dynamic Builders Inc. desires to adjust the common boundaries, between the parcels whereby said adjustment will create the properties as described and shown on the attached Exhibit "B" consisting of three (3) pages which are incorporated herein by this reference as though fully set forth at length; and WHEREAS, Dynamic Builders Inc. has applied for a lot line adjustment pursuant to Government Code Section 66412(d), which provides, in part, that the Subdivision Map Act does apply to the following: (d) A lot line adjustment between four or fewer existing adjoining parcels, where the land taken from one parcel is added to an adjoining parcel, and where a greater number of parcels than originally existed is not thereby created, if the lot line adjustment is approved by the local agency or 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 advisory agency." and WHEREAS, Government Code Section 66412(d) permits a local agency to impose conditions or exactions on its approval of a lot line adjustment so long as they relate to a property's conformity with the (local general plan, any applicable coastal plan, and zoning and building ordinances, or require the prepayment of real property taxes prior to the approval of the lot line adjustment, or facilitate the relocation of existing utilities, infrastructure, or easements; and WHEREAS, Dynamic Builders Inc. formally submitted its lot line adjustment on or about February 21, 2007; and WHEREAS, Samuel Kevin Wilson, Director of Community Services I& Water, has recommended that said lot line adjustment be approved; 1� WHEREAS, the parcels resulting from the lot line adjustment will conform to the zoning and building ordinances of the City of Vernon once the conditions specified herein are met. NOW, THERFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The request for lot line adjustment dated February 21, 2007, to adjust the common boundaries of parcels 1 and 2 described in the attached Exhibit "A," whereby said adjustment will change the common boundaries as described as parcels 1 and 2 in the attached Exhibit "B" is hereby approved in accordance with the recommendation of Samuel Kevin Wilson, Director of Community Services & Water. - 2 - 1 2 3 4 5 6' 7 8i 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 3: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect.
