Resolution No. 94761 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9476 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ACCEPTING THE BID OF CAMINO REAL CHEVROLET ON BID NO. 1447 FOR THE PURCHASE OF A 2007 CHEVROLET SILVERADO FOR THE POLICE DEPARTMENT AND APPROVING AND AUTHORIZING THE EXECUTION OF A VEHICLE PURCHASE CONTRACT AND THE ISSUANCE OF A PURCHASE ORDER RESPECTING SAID BID WHEREAS, the Police Department has requested the purchase of one 2007 Chevrolet Silverado to replace a vehicle that is too costly to repair; and WHEREAS, pursuant to Resolution No. 9428 adopted by the City Council of the City of Vernon on October 2, 2007, the City Clerk was directed to give notice inviting sealed proposals or bids for the purchase of a 2007 Chevrolet Silverado 1500, 2WD, Crew Cab LS vehicle ("Silverado") in accordance with a bid specification provided by the Police Department; and WHEREAS, based upon the bid specification, the Purchase Department prepared Bid No. 1447 dated October 10, 2007, and proceeded to solicit bids for the purchase of the Silverado; and WHEREAS, sealed bids for Bid No. 1447 were opened on October 31, 2007, and reviewed by the Police Department; and WHEREAS, the Purchasing Agent has recommended that Bid No. 1447 be awarded to Camino Real Chevrolet ("Camino"), the lowest responsible bidder meeting the requirements of Bid No. 1447. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true I and correct. 2 SECTION 2: The City Council of the City of Vernon hereby 3 Awards Bid No. 1447 to Camino and accepts and approves the Vehicle 4 Purchase Contract, a copy of which is attached hereto as Exhibit A and 5 incorporated herein by reference. 6 SECTION 3: The City Council of the City of Vernon hereby 7 authorizes the Mayor or Mayor Pro-Tem to execute said Contract for, 8 and on behalf of, the City of Vernon and the City Clerk is hereby 9 authorized to attest thereto and authorizes the issuance of a purchase 10 order for the purchase of the Silverado pursuant to Bid No. 1447. 11 SECTION 4: The City Council of the City of Vernon hereby 12 directs the City Clerk, or her designee, to send one fully executed 13 Contract to: 14 Camino Real Chevrolet Attn. Camino agrees to sell to the City one new 2 2007 Chevrolet Silverado 1500, 2WD, Crew Cab LS Vortec 4.8L vehicle 3 with V8 SFI Engine, 4-SPD Automatic Transmission, graystone metallic, 4 dark titanium (exterior black or pewter, interior dark color) that 5 meets the specifications contained in City of Vernon Bid No. 1447 6 dated October 10, 2007, and that is consistent with Camino's Bid of 7 October 31, 2007 (collectively referred to as the "Bid Documents"). Consistent with its Bid, Camino agrees to 11 sell and deliver within 8 to 10 weeks, subject to final inspection by the City, the one new 2007 Chevrolet Silverado vehicle for the sum of 12 13 Twenty -Two Thousand Two Hundred Ninety -Five Dollars and No Cents 14 ($22,295.00), plus sales tax, document fees and tire fees and less any applicable discounts. 15 3. Payment Terms. Payment will be made within thirty 19 (30) days net of receipt of the Vehicle. 20 4. Warranties. All manufacturers' warranties, the 21 warranties specified on the Bid Documents and any other warranties 22 made applicable by law, shall apply to the City's purchase of the 23 above -referenced vehicle. 24 5. General Provisions. 25 A. Governing Law. The laws of the State of 26 California shall govern the rights, obligations, duties and 27 liabilities of the parties to this Contract and shall also govern the 28 2 - I interpretation of this Contract. 2 B. Vernon Police Department DETECTIVE VEHICLE SPECIFICATIONS GENERAL The vehicle covered by this specification is for the purchase of a 2007 Chevrolet Silverado 1500 2WD Crew Cab LS, 4.8L V8 and shall be supplied as specified from the manufacturers new, unused and latest model complete with all necessary equipment and accessories. Camino Real Chevrolet 2401 S. Atlantic Blvd, Monterey Park, Ca 91754 provided the vehicle information. The contact person is the General Sales Manager, Ed Engle (323) 264-3050 Ext 178. The vehicle shall be delivered completely assembled and ready to operate. All equipment normally furnished, as standard shall be 'included. All separate units'or components shall be new, unused, installed connected and delivered in good operating order. The subject vehicle shall conform in all respects and be equipped to operate legally on California State Highways as specified in the California Motor Vehicle Code. The vehicle shall meet all California State and Federal safety and emissions standards when delivered to the City of Vernon. The successful bidder will submit in detail a final draft of all specifications for final approval by the City of Vernon and the Vernon Police Department prior to purchase. All bids submitted shall include sufficient associated literature as required to fully describe and detail the items under consideration. This should include photographs, performance charts, components list, dimensional drawings, etc. The bidder shall clearly state'any changes, exceptions'or substitutions of equivalent equipment or materials to these specifications. The successful bidder will arrange to demonstrate a similarly equipped 2007 Chevrolet Silverado prior to purchase. Whenever materials or equipment are specified or described in the specifications by using the name of proprietary item or name of a particular manufacturer, fabricator, supplier of distributor, the name of the item is intended to establish the type, function and quality required. Unless the name is followed by words indicating that no substitution is permitted, materials or equipment of other manufacturers, fabricators, suppliers or distributors may be accepted by the City of Vernon if sufficient information is submitted prior to the purchase by the contractor to allow the City of Vernon to determine that the material or equipment proposed is equivalent to the named. The term "equivalent" as used in this specification, means "authorized equivalent" and acceptance of the "equivalent" is subject to the approval of the City of Vernon. Warranties The manufacturers warranties on the vehicle and any added equipment shall be delivered to the City of Vernon without waiver by the city of any recourse under California Law. SIGN HERE................................................................MAIL TO PURCHASIN 12/02 Vernon Police Department DETECTIVE VEHICLE SPECIFICATIONS GENERAL The vehicle covered by this specification is for the purchase of a 2007 Chevrolet Silverado 1500 2WD Crew Cab LS, 4.8L V8 and shall be supplied as specified from the manufacturers new, unused and latest model complete with all necessary equipment and accessories. The vehicle shall be delivered completely assembled and ready to operate. All equipment normally furnished, as standard shall be included. All separate units'or components shall be new, unused, installed connected and delivered in good operating order. The subject vehicle shall conform in all respects and be equipped to operate legally on California State Highways as specified in the California Motor Vehicle Code. The vehicle shall meet all California State and Federal safety and emissions standards when delivered to the City of Vernon. The successful bidder will submit in detail a final draft of all specifications for final approval by the City of Vernon and the Vernon Police Department prior to purchase. All bids submitted shall include sufficient associated literature as required to fully describe and detail the items under consideration. This should include photographs, performance charts, components list, dimensional drawings, etc. The bidder shall clearly state any changes, exceptions or substitutions of equivalent equipment or materials to these specifications. The successful bidder will arrange to demonstrate a similarly equipped 2007 Chevrolet Silverado prior to purchase. Whenever materials or equipment are specified or described in the specifications by using the name of proprietary item or name of a particular manufacturer, fabricator, supplier of distributor, the name of the item is intended to establish the type, function and quality required. Unless the name is followed by words indicating that no substitution is permitted, materials or equipment of other manufacturers, fabricators, suppliers or distributors may be accepted by the City of Vernon if sufficient information is submitted prior to the purchase by the contractor to allow the City of Vernon to determine that the material or equipment proposed is equivalent to the named.
