RESOLUTION NO. 9484
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON ADOPTING THE CITY OF VERNON GENERAL PLAN AND
THE VARIOUS ELEMENTS INCLUDED THEREIN AND REPEALING
ALL RESOLUTIONS IN CONFLICT HEREWITH
WHEREAS, the City of Vernon ("City") is a chartered municipal
corporation of the State of California; and
WHEREAS, the City Council adopted a General Plan for the
City of Vernon by Resolution No. 5609 on April 18, 1989, as revised by
Resolution Nos. 6109 and 7711 on June 16, 1992 and February 21, 2001,
respectively; and
WHEREAS, City is proposing to adopt an amended City of
Vernon General Plan (the "Plan"), pursuant to Government Code Section
65358; and
WHEREAS, the City Council of the City of Vernon held a public
hearing during its regularly scheduled City Council meeting on
December 3, 2007, to consider the proposed Plan; and
WHEREAS, the City Council of the City of Vernon has not
created a separate planning commission and performs all of the
functions of a planning commission as authorized by Government Code
Sections 65100 and 65861; and
WHEREAS, the City Clerk gave the required notice for said
hearing for the purpose of considering the adoption of the Plan at
which public hearing the Plan was displayed, discussed and explained;
and
WHEREAS, the proposed Plan has been referred to cities
adjoining the City of Vernon, to the Local Agency Formation Commission,
to area -wide planning agencies, and to the State of California for

(review and comment by each such agency as required by Government Code
Section 65352; and
WHEREAS, on December 3,.2007, the City Council of the City of
Vernon held a hearing on the environmental impact of the Plan and, by
lResolution No. 9483 certified the Environmental Impact Report for the
IPlan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION l: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon, pursuant
to Chapter 3, Title 7 of the Government Code of the State of
California, does hereby approve and adopt the City of Vernon General
Plan as the General Plan of the City of Vernon, including the land
use, circulation, infrastructure, housing, safety, resources and noise
elements covering the principles, objectives and standards which will
be used to develop the City of Vernon as more fully described in the
City of Vernon General Plan dated November 2007, a copy of which is
being presented to the City Council concurrently with this Resolution,
and the City Council hereby orders the Plan to be received and filed
by the City Clerk. The Plan submitted herewith is incorporated herein
by this reference as though fully set forth at length, along with any
amendments thereto whichhavebeen approved at the public hearing.
SECTION 3: The City Council of the City of Vernon does
hereby find and determine that the public interest, convenience and
necessity require that the Plan be adopted as amended covering the
objections, principles and standards used as guidelines to develop the

1 City as specified in Article 5 of the Government Code of the State of
2 California, Section 65300, et seq.
3 SECTION 4: The City Council of the City of Vernon does
4 further find and determine that, in accordance with Government Code
5 Section 65863.6, which requires that any ordinance that limits the
6 number of housing units which may be constructed on an annual basis
7 contain findings as to the public health, safety, and welfare of the
8 City that is promoted by the adoption of the ordinance, many of the
9 housing goals and programs which are desirable in non -industrial
10 jurisdictions are not feasible in the City. The noise, dust,
11 vibration and chemical wastes and odors from the City's local
12 industries (many of which operate around the clock) serve as a
13 deterrent to housing development. Moreover, housing should not be
14 encouraged in close proximity to heavy industry for health and safety
15 reasons. Future housing growth has been deemed inappropriate in the
16 City due to the City's pervasive industrial environment and land use
17 incompatibilities related to hazardous materials, background
18 contamination, noxious odors, noise pollution, and truck and railroad
19 traffic. Due to the environmental factors affecting any future
20 residential development, the City has determined that limiting the
21 number of building permits that may be issued for residential
22 construction to zero is necessary for the protection of the public
23 health, safety, and welfare of the residents of the City and the
24 viability of the businesses operating in the City.
25 SECTION 5: The City Council of the City of Vernon intends
26 that this Resolution supersede any previous General Plan or element
27 which has been heretofore been adopted.

SECTION 6 The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and thereafter
the same shall be in full force and effect.
APPROVED AND ADOPTED this 3Id day of December, 2007.
