RESOLUTION NO. 9495
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON TERMINATING THE EMPLOYMENT AGREEMENT WITH
BRUCE V. MALKENHORST, JR. AND REPEALING ALL
RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT
THEREWITH
WHEREAS, on January 17, 2007, the City Council of the City of
Vernon adopted Resolution No. 9217 approving an Employment Agreement
effective January 17, 2007 to January 16, 2008 (the "Agreement") with
Bruce V. Malkenhorst, Jr. ("Malkenhorst") for legal services; and
WHEREAS, on March 5, 2007, the City Council of the City of
Vernon adopted Resolution No. 9263 approving Amendment No. One to the
Agreement; and
WHEREAS, on October 2, 2007, the City Council of the City of
Vernon adopted Resolution No. 9423 approving Amendment No. Two to the
Agreement; and
WHEREAS, Section 2 of the Agreement provides that the
Agreement automatically renews for an additional term of one year
unless notice is given in writing thirty (30) days prior to the
anniversary date, or January 17, 2008; and
WHEREAS, the City desires to terminate the Agreement with
IMalkenhorst.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
Ifinds and determines that the recitals contained hereinabove are true
land correct.
SECTION 2: The City Council of the City of Vernon hereby
1 terminates the Agreement with Malkenhorst effective December 17, 2007.
2 SECTION 3: The City Council of the City of Vernon hereby
3 authorizes the City Attorney to provide a notice of termination to
4 Malkenhorst.
5 SECTION 4: The City Council of the City of Vernon hereby
6 authorizes the City to pay Malkenhorst for his services pursuant to
7 the Agreement.
8 SECTION 5: The City Clerk of the City of Vernon shall
9 certify to the passage of this resolution, and thereupon and
10 thereafter the same shall be in full force and effect.
11 APPROVED AND ADOPTED this l7th day of December, 2007.
