1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9584 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING CONTRACT NO. 612, DEMOLITION OF CITY OWNED BUILDINGS AND STRUCTURES LOCATED AT 2200 55TH STREET AND 2001 57TH STREET; ACCEPTING THE BID OF AMERICAN WRECKING, INC. FOR THE DEMOLITION OF CITY OWNED BUILDINGS AND STRUCTURES IN ACCORDANCE WITH CONTRACT NO. 612 OF THE CITY OF VERNON AND APPROVING THE EXECUTION OF SAID CONTRACT; MAKING CERTAIN FINDINGS RELATIVE TO THE PROPOSED PROJECT; AND APPROVING AND ADOPTING A NEGATIVE DECLARATION FOR THE PROPOSED PROJECT WHEREAS, the City of Vernon intends to demolish approximately 125,000 square feet of City owned buildings and structures which include slab and footings located at 2200 55th Street and 2001 57th (Street, which site was previously operated as a paper mill facility by (Smurfit -Stone, in preparation for a new development (the "Proposed lProject"); and WHEREAS, the Proposed Project is subject to the California (Environmental Quality Act ("CEQA") because it requires discretionary Japproval; and WHEREAS, there has been presented to the City Council of the City of Vernon Contract )No. 612 for Demolition of City Owned Buildings and Structures Located at 2200 55th Street and 2001 57th Street; and WHEREAS, the Director of Community Services & Water sent the proposal for Contract No. 612 to six contractors and six proposals lwere received by March 3, 2008; and WHEREAS, said proposals were referred to Samuel Kevin (Wilson, Director of Community Services & Water, who has reported to the City under the date of March 26, 2008, recommending that Contract No. 612 for the Demolition of City Owned Buildings and Structures 1 located at 2200 55th Street and 2001 57th Street be executed with 2 American Wrecking, Inc. being the highest responsible bidder crediting 3 the City; and 4 WHEREAS, the Director of Community Services & Water has 5 performed an Initial Study dated March 13, 2008, to determine whether 6 the Proposed Project will have adverse impacts on the environment and 7 has determined that the Proposed Project would not have a significant 8 effect on the environment, and the Director of Community Services & 9 Water has recommended that a Negative Declaration be adopted in 10 compliance with CEQA; and 11 WHEREAS, the City of Vernon has provided notice of its 12 intent to adopt a Negative Declaration for the Proposed Project and 13 has provided a public review period of not less than 20 days, as 14 required by the State CEQA Guidelines; and 15 WHEREAS, notice of a public hearing was posted on three 16 official bulletin boards of the City of Vernon on March 13, 2008, was 17 mailed to interested parties and agencies, as required by the State 18 CEQA Guidelines; and 19 WHEREAS, the City Council of the City of Vernon held a 20 public hearing on the Proposed Project and the adoption of a Negative 21 Declaration on April 7, 2008; and 22 WHEREAS, the Director of Community Services & Water by his 23 memo dated March 26, 2008, has indicated that the Proposed Project is 24 consistent with the General Plan of the City of Vernon; and 25 WHEREAS, in accordance with Section 711.4(c) of the Fish and 26 Game Code, no evidence has been found that the Proposed Project will .27 not individually or cumulatively have an adverse effect on wildlife 28 resources; and 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the City Council has heard and considered all evidence, both written and oral, presented in consideration of the Proposed Project and the adoption of a Negative Declaration. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby 11'finds that the Proposed Project is consistent with the General Plan of the City of Vernon. SECTION 3: The City Council of the City of Vernon hereby finds on the basis of the whole record before it (including any comments received) that there is no substantial evidence that the Proposed Project will have a significant effect on the environment individually or cumulatively, and that the Negative Declaration reflects the City of Vernon's independent judgment and analysis, on the basis of said findings the City Council hereby approves and adopts the Negative Declaration for the Proposed Project. SECTION 4: Pursuant to Section 711.4(c) of the Fish and Game Code, the City has found no evidence that the Proposed Project will have the potential for adverse effects on wildlife resources. SECTION 5: The City Council of the City of Vernon hereby approves the Initial Study Checklist Form and Initial Study and Negative Declaration dated on or about March 13, 2008, together with any attachments thereto. Copies of said documents have been submitted to the City Council concurrently herewith, and the City Clerk is directed to receive and file them. Such documents and other materials - 3 - 1 2 3 4 67 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 11which constitute the record of proceedings in this matter shall be 11maintained in the office of the City Clerk, who is and shall be the Ilcustodian thereof. SECTION 6: The City Council of the City of Vernon hereby directs the City Clerk, or her designee, to file a Notice of Determination in regard to the environmental impact of said Proposed Project and to pay the appropriate fees. SECTION 7: The City Council of the City of Vernon hereby authorizes the City Administrator, or his designee, to execute any and all documents necessary to implement and carry out the purpose of this Resolution. SECTION 8: Contract No. 612 for the Demolition of City - Owned Buildings and Structures located at 2200 55th Street and 2001 57th Street is hereby approved and accepted by the City Council of the City of Vernon. SECTION 9: The City Clerk of the City of Vernon is hereby directed to file in the office at the City Hall of the City of Vernon a copy of said contract. SECTION 10: The City Council of the City of Vernon does hereby award Contract No. 612 to American Wrecking, Inc. in accordance with the recommendation of Samuel Kevin Wilson, Director of Community Services & Water, and authorizes the Mayor or Mayor Pro-Tem to execute the Contract for, and on behalf of, the City of Vernon and the City Clerk is hereby authorized to attest thereto. SECTION 11: All others proposals or bids are rejected subject to execution of the Contract and the City Treasurer or Finance Director is hereby directed to return unsuccessful bidders any cashier or certified checks deposited with said bids upon the receipt of an - 4 - I executed Contract from American Wrecking, Inc. accompanied by all 2 required bonds and certificates. 3 SECTION 12: The City Clerk of the City of Vernon shall 4 certify to the passage of this resolution and thereupon and thereafter 5 the same shall be in full force and effect. 6 APPROVED AND ADOPTED this 7th day of April, 2008. 7 9 Name: Leonis C. EXECUTIVE SUMMARY This report presents the results of the pro -demolition asbestos inspection/ sampling and the necessary Laboratory testing of building components at 5201 District Boulevard, Vernon, California 90058. The asbestos inspection and sampling of suspicious building components was conducted on July 1, 2008 in a vacated, single story, commercial building. Mr. Joseph Somoye, a State of California Certified Asbestos Consultant and an EPA/AHERA Certified Building Inspector for Asbestos Materials in Buildings conducted the asbestos survey and sampling activity. The purpose of the asbestos survey/sampling and laboratory testing was to identify the building materials that contain asbestos fibers that may be friable or rendered friable and released into the environment if agitated during future demolition activities. Sampling of materials suspected to contain asbestos was conducted following the provisions of 40 CFR Part 763.107. Fourteen sample results were generated from the field sampling activity conducted at the project site. Included in the report as the survey sheet is a list of the sampled materials and their locations, Laboratory testing was conducted by a NVLAP certified laboratory (#200037), Western Analytical Laboratory, using the principles of polarized light microscopy and dispersion staining, and the NIOSH approved Method 7403. This method is further defined in the EPA B00/M4-82-020,' "Interim Method for the determination of Asbestos in Bulk Insulation Samples." Polarized Light Microscopy (PLM) bases all percentages on visual area estimates. 1 ENVII�ONIOiETiT'I'AL sEYZIVICES JAS Environmental does not warrant, guarantee or profess to have the ability to locate or identify all asbestos containing materials (ACM) in a building structure. Reasonable effort is made by JAS personnel to locate and sample suspect materials that may be affected by the pending future demolition activities. However, for any building structure the existence of unique or concealed asbestos containing material (ACM) and debris is a possibility. Furthermore, should any suspicious material become exposed during demolition, such material must be tested for negative asbestos content before resuming the demolition activity. Quantities of materials expressed in this report are estimates only; measurements to determine actual extent of asbestos containing materials should be conducted by contractor prior to award of contract to conduct removal. FINDINGS AND CONCLUSIONS: Based on our inspection and laboratory analysis of the bulk samples collected during the inspection, it is our conclusion that asbestos fibers are present in some of the building materials sampled and or inspected in the building located at 5201 District Boulevard, Vernon, California, The asbestos containing materials are: The red linoleum flooring material found in the S. West area of the Warehouse building contains asbestos fibers. The asbestos type is chrysotile. The material is non -friable asbestos containing (ACM) in damaged condition. Extent of the material is estimated at 30 square feet (SF). 2. The Pink 12x12 floor the material found in the Central & North areas of the Warehouse building contains asbestos fibers. The asbestos type is chrysotile. The material is non -friable ACM in damaged condition. Extent of the material is estimated at 850 SF. 3. The window putty material found in the West entrance area of the Warehouse building contains less than (<) 1 % asbestos fiber content. The asbestos type is chrysotile. The material is non -friable ACM in good condition. Extent of the material is estimated at 10 windows. 4. The mastic penetration found at the base of vent pipes on the roof of the building contains asbestos fibers. The asbestos type is chrysotile. The material is non -friable ACM in good condition. Extent of the material is estimated at 5 SF. 2 ENVIR(�N1o'IEN'T�#L SERVICES RECOMMENDATIONS: If any materials are found to contain greater than one percent of asbestos by weight as determined by polarized light microscopy (PLM) method of analysis, EPA mandates that the material (s) be treated as asbestos containing and is subject to regulation under CCR Title 8, Section 1529. Since the surveyed building is scheduled for demolition, it is recommended that the identified ACMs be properly removed by a licensed and DOSH certified abatement contractor and disposed of in compliance with Local, State and Federal regulations, prior to the initiation of any demolition activities. Demolition activities may agitate the asbestos containing materials and release asbestos fibers into the environment, in violation of the Federal NESHAPS regulation's "No Visible Emissions Standards for Hazardous Air Pollutants" as contained in 40 CFR Part 61. It is also recommended that if and when the removal of the asbestos containing components is conducted in the building, the abatement should be professionally managed and monitored to achieve compliance with the above Federal and State of California visible asbestos emissions regulations, as applies to asbestos removal and management activities. The independent air monitoring by the third party professional environmental consultant shall provide proof of acceptable asbestos fiber levels, prior to re -occupancy of the building by unprotected personnel. A post abatement clearance air monitoring shall be performed by a third party professional monitoring (Certified Asbestos Consultant) to obtain the EPA post abatement clearance fiber level of less than 0.01 fibers per cubic centimeter of air (f/cc) for each area in which asbestos removal has been visually inspected and cleared. At the completion of asbestos abatement, building owner shall obtain from professional. management and monitoring service, all records/logs of.the daily abatement activities, including observations, as regards appropriate abatement techniques utilized for the removal, air fiber levels obtained from the daily air monitoring for the outside and inside abatement areas, and final air/visual clearance results. The soil was stockpiled in case backfill material was needed at the facility. As it turns out the soil was not needed and has remained at the 55th Street Recycling Yard for the last several years. The stockpiled soil has hampered operations at the site and quite of bit of vegetation has now covered the soil creating a potential fire hazard. The City is currently demolishing the structures at 2001 57th Street (the former Smurfit Stone facility). As part of this demolition several basements were removed and fill material is needed to bring the property to grade. The City's Health Department has given its approval to allow the soil from the Recycling Yard to be transferred to the Smurfit Stone site and be used as backfill. City staff had sought proposals to have the soil hauled off site and disposed. The cost to perform this work was approximately $300,000. The City sought a proposal from American Wrecking, Inc. to clear, grub and dispose of the vegetation, transfer the soil from the Recycling Yard to the Smurfit Stone site and compact the soil to a relative compaction of 90%. American Wrecking, Inc. has provided the City with an estimate of $48,668 to perform the work. The final cost will be based on the actual number of loads that are transferred. Since the demolition of the Smurfit Stone site is progressing backfill material was needed immediately or a delay in the contract would occur. The Community Services Department issued the enclosed Change Order No. 7 to clear and grub the stockpiled soil and transfer it from the Recycling Yard to the 2001 57th Street property. The City was aware that the site contained an area of non -hazardous regulated waste (petroleum impacted soil) and included the removal of 80 tons in the bid. Unfortunately, when the foundation for the onsite cogeneration facility was removed it was determined that the contamination was more extensive than originally thought. The City requested its contractor, American Wrecking, Inc. to excavate the contaminated material and stockpile the soil until such time as the City could profile the soil to determine the constituents of the contamination and determine where the soil could be disposed. Approximately 1,080 tons of soil was removed and samples were taken to confirm that the soil remaining adjoining the excavation were below regulatory action levels. The City sought and received two proposals to haul off and dispose of the soil. Both bidders propose to have the soil thermally treated at Thermal Remediation Solutions in Azusa, California. Enclosed herewith is a proposal from PIC Environmental Solutions (PIC) and American Wrecking, Inc. whose bids were $60.00 per ton and $55.00 per ton respectively. In addition, PIC's bid did not include the cost of loading whereas American Wrecking, Inc.'s bid is all inclusive. Therefore, it is recommended that Change Order No. 8 be issued to American Wrecking, Inc. for the removal and disposal of the contaminated soil at a cost of $55,000.00.
