A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 VERNON AUTHORIZING THE CITY CLERK TO MAKE AND
DELIVER A CERTIFICATE OF ELECTION TO COUNCIL MEMBER
4 WILLIAM J. DAVIS AND TO ADMINISTER THE OATH OF
5 OFFICE
6 WHEREAS, the City Council of the City of Vernon by
7 Resolution No. 9534 on January 22, 2008, appointed William J. Davis as
8 a member of the City Council to serve a term of four (4) years
9 pursuant to Section 2.90 of the Vernon City Code and Elections Code
10 Section 10229; and
11 WHEREAS, the General Municipal Election scheduled for
12 April 8, 2008, was thereafter cancelled by Resolution No. 9558 adopted
13 on February 19, 2008, because no more than one person filed nomination
14 papers for each office; and
15 WHEREAS, Section 10229 of the Elections Code provides, in
16 part, as follows:
17 "The person appointed, if any, shall qualify and
18 take office and serve exactly as if elected at a
19 municipal election for the office;" and
20 WHEREAS, Section 3.4 of the Vernon City Charter requires the
21 City Council to canvass the returns of an election on the first
22 Tuesday following a City Council election or such other date within
23 fifteen (15) days of the election as may be provided by ordinance; and
24 WHEREAS, Section 3.4 also states that the term of each
25 elected councilmember shall begin at the hour of the completion of
26 the canvas of the election returns; and
27 WHEREAS, on January 22, 2008, the City Council of the City
28 of Vernon adopted Ordinance 1143 which established the third
1 Monday of the month following an election as the date to canvass
2 returns and install appointed councilmembers; and
3 WHEREAS, Section 10265 of the Elections Code requires that
4 the City Clerk sign and deliver a Certificate of Election to each
5 person elected and administer the oath of office.
6 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
7 CITY OF VERNON AS FOLLOWS:
8 SECTION 1: The City Clerk shall immediately make and
9 deliver to William J. Davis a Certificate of Election signed by the
10 City Clerk and duly authenticated.
11 SECTION 2: The City Clerk shall administer to William J.
12 Davis the oath of office prescribed in the State Constitution of the
13 State of California and shall have them subscribe thereto and file the
14 same in the office of the City Clerk, whereupon, Mr. Davis shall be
15 inducted into the respective office to which he has been elected.
16 SECTION 3: The City Clerk of the City of Vernon shall
17 certify to the passage of this resolution, and thereupon and
18 thereafter the same shall be in full force and effect.
